Guilty Until Proven Guilty

  • The list will show if a complaint against an officer was "sustained" and if it resulted in discipline -- or if the department deemed it to be "unsustained" or "unfounded" or determined the officer was "exonerated."

    The records will identify some officers who have received more than 30 complaints but who did not face any "meaningful" discipline, Loevy said. The documents also will identify the police units with the highest concentrations of cops with 10 or more complaints against them.

So evidently, there is no longer any difference between sustained, not sustained, unfounded or exonerated anymore. The mere fact that a complaint was filed means you are guilty guilty guilty. What the hell? How are we supposed to be disciplined "meaningfully" if the complaint was without merit in the first place?

As we've stated before, a civilian's criminal history cannot be brought into play except for purposes of (A) setting bail or (B) sentencing following conviction. Any other mention is overly prejudicial to the legal process. This lawsuit to produce the list of accused officers without taking into consideration the lack of appropriate standing of the complaint is asinine at best. We don't even want to think about what it is at the worst.

Workers get CRs, let the media know that when these guys stop getting CRs, crime goes up up up.

A civilian's criminal history is also not readily available as public record.

Keep in mind most CRs are for rule violations not for criminal offences.

In the private world your company can get it's ass sued off for disclosing the same information to other potential employers let alone the public.

But you as a Chicago Police Officer are fair game, YOU HAVE NO RIGHTS! The U.S. and State Constitution and the right to privacy do not apply to you!

This clown pushing for the list. stated that if it is released it will decrease the number of claims against the City and save the tax pays Millions and millions of dollars. WHAT?

Sounds to me any one with a brain could target the officers on the list by attempting to engage them in an altercation and then sue based on the history provided by the list.

Whats next? They will sue for a ordinace that all Police officers must post a sign on the front of your residence to let the citizens know you are the Police, with your name and phone number.

And in todays suntimes it was front page news. Stating that over 600 officers have 10 or more complaints over the past 5 years. You can easily get 2 retaliatory complaints a year if you are a working copper, the more you work, the more youll get.
I am sick of seeing the lawyer on the news saying the city is protecting the officers and that it is (rough quote) "a small group of officers causing the most problems". Again, this gives the perception of guilt just because you got a cr#. Surely nobody would make up a complaint on you just because you arrested them, inventoried their gun and narcotics, and impounded their car. No, not the good citizens of chicago. And last time I checked, ops is pretty quick to hand out suspensions for sustained crs.
Working police get cr#'s (even if your coasting by and just answering jobs you will get some). Go ahead and keep taking the drive out of us to do any serious police work in this city, see how that goes.

Complaints against lawyers are not public record.

If the records regarding police officers can be released then how many complaints have been filed against the attorney's who are demanding that these records be released.

Loevy and Flint Taylor should voluntarily authorize ARDC to release the records of everyone associated with their law firms.

From the scumtimes: Michael Pfleger urged Daley to release the full list. After appearing with Daley to publicize a gun turn-in, Pfleger said the list and other secret documents would help the public understand how the Police Department investigates complaints against cops. "We need to know the officers that there's a lot of complaints against," he said.

OK, so then WE need to know the criminal histories of the complainers. and how many times they have complained. And how many times the city has settled suits with them.

If the Courts want to release that information, then thats fine under certain conditions. If the CR was sustained, OK, BUT if it was not-sustained or exonerated then the complainant's name AND Criminal rap sheet should be added to that release.
Also since this "release" is for the good of the Justice System, then let us have FULL access to ALL the Players. Release the Backgrounds on ALL Lawyers that practice and the judge's backgrounds also. Since we all work in the public court system. Let's really have full disclosure! Any and ALL complaint's against them also. Let us set up a true system of responsibility. A office of OPS for Lawyers and Judges!
This way if you don't like a judges ruling, complain against them, or if you feel the lawyer didn't do a good job (they lost the case) get a complaint against them also. Let us be fair in this.

You're public employees, and the people who pay your salary have a right to know what's going on in the department they pay for. Moving to the private sector is always an option if you're worried about oversight by the public.

As far as "less rights" goes, what would happen to me if I decided to stroll through Chicago exercising my right to keep and bear arms?

I havent had a CR # in over 5 years. Then again I havent done anything but answer my calls in 5 years.

Im happier and dont have to deal with the nonsense. Also, I am left alone. Why bother with all this bullshit for a city that could care less about you. Just stop. Answer your calls and write paper for every little thing.

If you are a worker, you will get CR#'s. Been doing it for 15 years. If they want to change the rules on us, that means don't do shit except the bare minimum which I know is hard to do for some of us who enjoy locking up assholes. I would like to know how much cash Lovey & Lovey takes in on a yearly basis. The people they reprsent (drug dealers) pay in cash and I want to know that every single penny is accounted for and reported to the IRS.Why don't you publish that information media? I work in 011 and have done so most of my career, I am pretty sure I'm on this list. I have gotten CR's on my days off and all they did was change the date of the CR in order to fit my work schedule. I think I might be proud of being on this list, after all it means I am the working police.Hell, we could make it a patch "The working 662".

I commented on this topic on another thread last night.

The bottom line is the public has to wake up and quit believing everything it is told by "alleged" community activists and race-baiting, poverty pimp reverends!Remember they have their own agenda. To enrich themselves, just like most politicians, by creating controversy where there is none, and diversions to the REAL ISSUES!

The truth is..YOU SHOULD BE MORE AFRAID THAT THE CRIMINAL RECORDS OF CRIMINALS IN YOUR COMMUNITY AREN'T BEING PUBLISHED FOR YOU TO SEE!

I am more afraid of gang-bangers, thugs, and common criminals in my community..than I am of ordinary everyday police officers that are patrolling it!

Remember, Sueing any public entity has become a source of revenue for the poor and disenfranchised in our city. In order to sue there has to be some sort of wrong. So these people just call the police and bitch about the service or lack of service (your damned if you do, and damned if you don't..as the old saying goes) It's become so that they'll sue at the drop of a hat.

I especially love how two uneducated, unemployed people with no life skills can marry, have 5-6 kids, live in government provided housing, drink, smoke and do drugs 24/7..and when they get in a domestic situation, call 911. At which time, officers arrive and quickly become the target of aggression. They will then fight the police and after the smoke clears, will bitch that you trashed the apartment (when it's obvious it hasn't been cleaned since they moved in many years prior) OR momma will be angry that you are "takin her man" to jail (even though he used her as a punching bag) and NOW IS DEMANDING A SUPERVISOR AND WANTS YOUR NAME AND STAR #, TO LODGE A COMPLAINT.

Every officer on the job has witnessed this scenario at least 100 times and probably has gotten a complaint or two in their careers after handling such a similar situation.

A when it goes to court the public defender makes it sound as if they were having a nice loving family time get-together when the overzealous CPD arrived without warning and started busting heads and violating civil liberties..FOR NO REASON! (I hear that phrase at least once a night from an arrestee)"NO REASON OFFICER"

SO PEOPLE (the public) THINGS AREN'T AS THEY ALWAYS SEEM. KEEP DRINKING THE KOOL-AID THAT THE LIBERAL MEDIA IS FEEDING YOU..and remember these "Lowvey lawyer/activist types" don't give a shit about justice..they just want to make the Porsche payment and have the inground pool maintained!

To the city:

Go ahead and release the "cop complaint" list. But, in fairness, release to the public the arrest histories of everyone ever arrested by CPD(WHETHER CONVICTED OR NOT.)FAIR IS FAIR!

From Jon Burge, to the Weems shooting, to the Jefferson Tap, to the Abbate beating; the stench of favoritism, collusion and privilege hangs heavy in the air.

After all these years, I don't suppose anybody can stop the Chicago PD from lying about its own activities. On the other hand, all of the threats, intimidation, stalling tactics and additional lies in the world can't make people believe what the Department says. Deal with it.

The working police get a lot more cr #'s than coppers that sit on their hands for the most part.

If you go out their and do your job and spread some joy and stir the pot, you'll eventually get some numbers, it comes with the job.

People or lets just call them individuals for sake of argument, that are no fans of the police or are made or hate the police get create and then obtain cr #'s on coppers.

I'll tell you what, when I worked in the 7th district, there was a particular 2 block area that no matter what contact (self initiated or response to a call) you had with individual's they would create a story to RETALIATE against you and your partner and obtain a cr # on you. The lies got pretty deep, all in their attempt for you to stop doing police work and combating crime in that 2 block area. Do you think I put my head down and my tail between my legs and ran away. NOT, I turned the heat up that much more. The same goes for a particular bldg in the Greens. This bldg which is still standing, would beef on you each and everytime you entered the bldg.

So those 2 lawyers on the tv last night could go fuck themselves. We're not guilty of anything. OPS did their investigation and discovered most of the cr #'s were in-fact BULLSHIT.

Now a list should be also released of the complaintants. There are a few people-- (one woman in particular) that has filed numerous beefs against numerous cops. I know of one woman on north Harding that has file over 20 on her own over the past 5 years. Possibly more before that when a signature wasnt required!

If you actually try and lock up gang bangers and dope dealers in an effort to save this sinking ship known as Chicago you will get CR numbers. People, and their families, are not happy about getting arrested. It is not a pleasant experience. They beef. Active working police officers get CR numbers. I know this is way off the topic, but I didn't see this in any of the papers, or on any of the major news shows [and I don't expect to either], but has anybody heard about the beer vender at Wrigly who was robbing the customers? He was selling beer and not giving any change. When somebody asked for their change he upped his shirt, showing his 9mm, and said "you don't get any change." One of the victims finally got hold of security and pinched the vendor.

First of all..judge...when you had a crisis at your home we did everything we could for you and family...rightly so..as you were a victim of violence...but now you are ruling on "Your beliefs"? We as police officers have rights...though not many but we have certain rights to privacy within our department and for you to take upon yourself to slander our names in the press...you maam are a complete asshole...plain and simple...let me tell you a little about the complaint process ..."ANYONE" can complain about "ANYTHING"....OPS will take a complaint from "The officer said I was foolish" to The officer told me FU^% you."...they will take "Brutality" complaints such as the handcuffs are "too tight" because I sat on them in the back seat and they tightened up ...that becomes brutality....there are certain gangs that have written rules and within those rules it is stated that "If arrested you will lodge a complaint against the arresting officer" The Gangster Disciples and the Latin Kings both have those requirements written into their rules...so...every time they feel "wronged" or get hooked up...they are to complain...You madam judge have NO IDEA where or how these complaints come from...do you think they are legit?? I would venture to say that 30% may be legit...the others are from hurt feelings or because they want to cause the officer grief...plain and simple. Granted we have had some recent incidents in the news lately that has caused controversy...all off duty incidents... and that gives a black eye to all of the hard working police officers in Chicago and I'm sure if you asked 100 officers randomly they would all agree that the stunts that were publicized were done by drunken fools and should NOT reflect upon all of us whatsoever. I would ask you what gives YOU the right to publicize our disciplinary history?? because you are a federal judge?? You will begin a process of slanderous and defamitory alligations within the very communities we are serving and attempting to protect...but you may not care if you are looking forward to retirement soon ...10 complaints in a 5 year span is NOTHING...and in some areas of the city you will get complaints simply for comming to work....and doing your job without even laying your hands on anyone...simply because you are the "White police" or the "Black police" and they didn't like your determination...why don't you consider all of the options before you make "YOUR" ruling based on some liberal crusader looking to change the world...The police department is not "Keeping secrets" from the public...that is absured...you and the crusader and other types such as Mr Pflager and Mr Jackson are nothing but nosey rable rousers who want camera time or ink...You have no business slandering us any more than I have knowing how much money you have in your bank account. It is unfortunate that there have been events recently involving off duty officers and there is a system in place to deal with them...you are not the answer and neither is Mr Pflager or Jackson or the Liberal crusaders...we also have rights governed by ordinances and state law to protect us...not many but we have some...and as police officers we deserve to have our privacy protected to ensure that we can be effective and trusted in doing our jobs...If I have 10 complaints in the last 5 years and that is publicized...will that halp the community or hurt me as a police officer and interfere with me doing my job?? While I don't want any list released, I don't think it will happen because Daley doesn't want the names of all the politicians and bosses children being printed in the papers. Don't get me wrong. I'm not saying they did anything wrong but special units always have a high incident of CRs because the worst scumbags make false accusations all the time thinking it will help beat their case or they can sue the city later and those scumbags are exactgly who specialized and tact units deal with. Quite often it takes a phone call to get to special unit. Just sayin.

ITS ALL A SCAM. THE LAWYERS WANT THE LIST SO THEY CAN GO THROUGH THE COUNTY COURT RECORDS AND FISH FOR OLD CASES.

THE LAWYER WILL DO PRO BONO WORK FOR GOOD CASES THAT ARE SIMILIAR.

I wish my name was going to be on the list (I have over 10 CR#s but not in the last 5 years, I actually have none since the sworn affidavant went into effect) . I would sue every newspaper and TV station that put my name out in the publics view for defamation of character and more.

I have never had a sustained CR#. There is a reason for all the non police who read this blog. I haven't done anything wrong. Hell, I got a CR# from a district I've never worked in or even driven through. I was in Mexico on vacation the day the alledged incident was supposed to have happened. I know I can't be alone in this kind of CR.

They work on contingency...a percentage of the win from the city goes to the firm. Their clients pay nothing upfront. If the case loses, they get nothing.

The public is willing to file a complaint againtst the police for just about anything. Loevy & Loevy make money suing the police & yes their arguments in some cases are false & unfounded. Courts have ruled against their arguments. How about dropping a dime to the ARDC for their bull shit. Lawyers do not like ARDC complaints because they must answer them!!!

Where is the Union to file suit for malicious prosecution? We need a change in the leadership of the union. Things have happened on the current FOP's watch that should have never happened.
I am a firm believer in picking your battles carefully, this is a battle we need to fight.
We can win this battle united as one.

Funny you should mention that. I made EXACTLY the same comparison between the Catholic Church and the Chicago PD just last night.

Both have a culture of corruption and coverup where public knowledge of the crime is considered worse than the crime itself.

Both have allowed predators into their ranks over a long enough period of time that the predators recruit and promote other predators. The Catholic Church and the Chicago PD have both self-selected a particular type of individual within the ranks. Not all priests are child molestors. Not all Chicago cops are thieves and murderers. But in both cases too many are.

Until the City of Chicago starts getting hammered in court the way the Catholic Church has, it'll still be riddled with Burges, Weemses, and Abbates.

And we'll keep seeing those videos...

Fine....release ALL CR information on ALL police...then publish home address and phone information...then publish the same for judges, state's attorneys, and the like....see what happen's when the L/K's see a gang boss go to jail and they find out where the criminal court judge lives!!!!!

Seriously--when the department gets sued, it's the people--the taxpayers who fund it--who have to pay. Do you think that--just maybe, since we're the ones on the hook for the bill--we might want to see who we're backing?

sure you can look at who you are backing up but look at who is complaining first--people from all walks of life who are CAUGHT by the police.

there might be an argument for accountability but only against sustained CR numbers. if you take into account any/all complaints esp those w/o merit that just give people a reason to complain more.

think about your spouse/teenage children/co-workers they complain about everything. think about all those complaints "honey you're driving too slow" "why didnt you stop at the store on the way home" i need more allowance "why cant i go to the concert with 12 of my friends in the 1988 geo metro?" vs
the officer stopped me for no reason and gave me a ticket for a red light. the officer was rude to me (after i mf-ed him/her for 10 mins). i told the officer that he couldnt arrest me and then he told me he could and i tried to run and got tackled--excessive force. i called 12x about the residential parkers and the officers never responded i even walked the block to where 2 cars were parked guarding a crime scene and they wouldnt leave to write the tickets.

hey you want to evaluate my performance go ahead--but how about the year end bonus as in the private sector based upon my productivity--you'll be owing me a hefty sum. and remember productivity is measured on the number of arrests/movers/tows/impounds/anovs an officer makes. thats your family/friends that mayor daley wants to sap the funds from. so the next time i pull you over as you "slide" through a red light/stop sign and you have to pay the fine(s) plus administrative costs--thats an additional $5 you can donate to my year end bonus.

The CR you mentioned is a clasic.
Other classics from 025 include one for "improper search", which was filed by an offender that was arrested on signed complaints. The offender did not feel as if a search was warranted, since he offered no resistance to the officers.
OPS would not let the 025 commander get a number on the investigator who took this complant.
Another favorite was the beef filed (by the broad on harding) for brutality, because the handcuffs were too tight. She handed the handcuffs to the wagonman when he opened the wagon door at 025.
Sidenote - she also sued the city on this beef, and the city setteled for $15,000.
And even I have had CR's filed against me for evil things I did, on dates when I was RDO. I am assuming that this was fairly common, especially in the days of paper arrest reports.
