More on Iowa

John Kass in the Sunday Tribune brings some much needed publicity to this travesty:
  • In an Iowa criminal case that smells of a thousand hogs, a young Chicago police officer was sentenced last week to 5 years in prison for defending himself against an attack by two large, drunken men, even though he testified that he repeatedly tried avoiding a fight.

    There is a U.S. Department of Justice office in Iowa. What is happening to Chicago police officer Michael Mette bears some serious federal inquiry.
Go read the whole thing. Kass identifies the political connections of the family involved and takes a number of people to task. People have fired off letters to other media members. Other blogs (like PatHickey's site) are beginning to take up the cause. SecondCitySarge has numerous contact e-mails and telephone numbers at which to register your displeasure (be polite, yet firm - don't come off as an asshole if you write, call or e-mail).

Michael Mette himself has contacted us and offered to provide a complete .pdf file of the judge's poorly written decision. We'll try to figure out a way to post it for everyone to read. We've also offered to give Michael a platform if he needs to get the word out for anything. We get about 2,800 visitors a day. If each one took the time to fire off an e-mail to your friends, family or co-workers outlining Michael Mette's plight and encouraged them to contact media, politicians, and others in their address books, we could create quite a groundswell of support and pressure.

Last year, we called on a boss, any single boss, to take the lead and speak up in support of our dead in trying to derail aldercreature Haithcock's proposal to honor scumbags who supported killing the police. Typically, no one boss stepped up, though we got a few letters that told of quite a bit of dissention taking place among the exempts at 35th Street following our articles calling them out.

We're making that call again. Someone, anyone from downtown, don't you think you ought to stand up and support an innocent officer being railroaded? We're sure the midget running the show will tell you what your opinion will be at some point in time, but with a new Supe on the way in, maybe before you resign to your golden parachute of a pension, you could get a statement out to Kass or Goudie and maybe show the guys and gals out here that deserve your support can get it once in a while?

I've already fired off a few emails to media outlets as well as the City of Dupuke PD to tell them my feelings on this crap. I'm amazed that something so glaringly wrong has been allowed to take place in Iowa. I'm also amazed that another travesty is taking place right here in Illinois. That being that CPD has dropped Officer Mette like a hot potato. If anyone in authority took the time to find out the circumstances of this case, they should be able to tell that Mette acted in a righteous manner and most likely followed all CPD policies for conduct even while he was out of state. That being said, he should be placed on a leave of absence and continue to accrue his seniority until this mess is over. I would also like to see his paycheck continue to be deposited in his account so he has a job and some funds to return to when the time comes.

Speaking on behalf of my NYPD brothers and sisters, we fully support Officer Mette. See the NYPD RANT for posts.

We are now mourning the death of our brother who was shot in a Brooklyn street stop early Monday morning. After a valiant 6-day fight for his life, PO Russell Tomeshenko expired from his wounds at Kings Co. Hospital last night.

All three savages now in custody.

Someone needs to organize a road trip/protest for each day off group. 7 straight days of protest so that each of us can go. Iowa isn't that far of a drive. This is just another example, an extreme example at that, of our judiciary losing all common sense in dealing with the creeps and thugs of our society.

After reading about Officer Mette and what he and his father have gone through,is it any wonder, that we would feel evil has truly won over goodness.

What boggles the mind is this judge's admission that yes, Officer Mette was the victim in this attack and was provoked, still, I sentence him to 5!! years behind bars. Will someone please either in Illinois or Iowa, please see the insanity of this and come to Officer Mette's aid?

Our we as law enforcement officers, because of the actions of a few, regulated to staying at home in our safe homes, fearing that if we travel anywhere, and act as righteous and correct as Officer Mette did in dealing with this creep, we too will lose our job and be thrown in the slammer?

Every law enforcement officer in America should be infuriated with this judge and her decision.

My prayers are with Officer Mette and his family.

The problem with all of this is that you guys are a day late and a dollar short. Innocent or not, this guy has now been convicted. . . his only hope is a winning appeal based upon judicial error. Where were you all when he was awaiting trial??? Where was your outrage then? Don't know this PO and certainly sympathize with his situation but why are we just now hearing about this? Better you should be taking up a collection or throwing a benefit to get him some good legal counsel to handle his appeal.

First, let me say that the length of the sentence is clearly unreasonable given several mitigating factors: Mette's lack of any criminal record; Mette's status as a PO; the alleged victim's admitted aggression against the officer; and, the "victim's" intoxication.

On the otherhand, having read Kass' article (which is my only source of information), and reading between the lines, I get the following take on all of this: Mette, his brother, and their friends (number unknown), are out on the town and are drinking themselves; they invite themselves to a college party, they pay the admission fee, find that the party is over and leave (any good Chicagoan, PO or not, would have demanded his/her money back) and there's the rub. Did the fight ensue when the golfer refused to return the group's money and is that why he's alleging that they stole his cellphone (seems reasonable to me), and did he chase them down and behave belligerantly because he thought he'd been ripped off? Certainly Mette and company felt they'd been ripped off because there was no party and they didn't get their money back. Given this guys alleged injuries, Mette and crew beat the crap out of him. Being a drunken corn-fed Iowa boy, he probably couldn't defend himself against the better trained and more agile Mette and his friends. Why was Mette the only one charged? What about his brother and any of their friends?

Before everybody goes balistic on Iowa and this Judge, let's get more of the story than we're hearing right now.

The arresting officer was Craig Salmonson, Dubuque PD.

The prosecutor was Timothy Gallagher, Dubuque Co. Asst. Atty.

The judge was Monica L. Ackley.

That leaves us with a few million Iowans that have absolutely nothing to do with this outrage.

The right of self defense is one of the bedrock values of civilization; except in Iowa. I hope that muggers, buggers, and thieves from around the country pick up on the fact that in Iowa, self defense is illegal. A mass migration of the criminal population to Dubuque would be well deserved. Both the States Attorney and the judge should be disbarred, at the least. And if any collusion between them to the politically connected family of the "victim" can be shown, they should be imprisoned. Lastly, a boycott should be started. BOYCOTT IOWA! Do not vacation or visit there; do not buy any products made there; divest of any stocks of Iowan companies; do no business with any financial institutions that have branches there; send none of your children to college there, and any that are now there, bring them home for their own safety. This Bullshit needs to be addressed! PLEASE don't let this crap go unheard by the Department. If they continue on the path of termination of this Policeman, You all should shut down. Didn't Mayor Dumbass hire someone recently with a criminal record and state, " everyone desrves a second chance".
If this officers appeal doesn't go through and this Judge doesn't get removed, then what the fuck is the point of a judicial system when a judge doesn't follow the laws. What kind of answer is " cause that's the law" ? What fuckin' law is that?
In my opinion, this officer should never see prison and should be able to sue the, (I know they probably can't..) the ASA and Judge in Iowa.
Furthermore, I for one would be willing to stand with my former brothers and sisters in defying any law enforcement officials in taking him. Remember, you could be next and just because you all believe you have some sort of brotherhood because you are Policemen is false. If you pay attention, you would notice that one gets hung out to dry everyday, unless of course you have clout, then maybe...
Hammering any Iowans may help but it's the officials of IOWA that I would target. Look for Iowa cops and officials on the roadways and nail em'.

everyone is pointingto the judge who is clearly wrong, but there is no mention of the police officers who handle the case and how in the world, they came up with the decision to lock HIM up in the 1st place. He was clearly the victim and at very least, both should have been locked up. Then there is felony review. I'm sure they saw his backgroung as a druken shithead, which would disqualify him as being a reliable witness. But he was not a witness, he was the offender...I forgot. Obviously there was some pressure put on the cop to do this dumb shit and the heat needs to start on him or them. We can find out who ordered this "hit" on P.O. Mette and start preparing the lawsuits from the bottom to top. My prediction is once this really heats up and gets national or even world attention, Mette will be able to retire with a nice piece of change. He'll get to do Oprah and maybe Springer if he is lucky!:) It will go national because now there is an issue of self defense at risk. This ruling clearly paves the way for anyone attempting to defeat a robbery, rape, or assault be arrested as the offender and the rapist, robber or batterer will go free. NATIONAL ISSUE...SOMEONE(S) IN DE PUKE WILL GET FUCKED IN THE END!!! If someone in the judge's family got assaulted, she would just have to lay there and take it, according to this ruling.

The civil rights of this officer are being violated. He is being treated like 2/3 of a citizen just because he is a Policeman. It evokes the emotion of Martin Luther King in his civil rights movement. Like MLK marching on Selma, Ala Edmund Pettus Bridge on Sunday, March 7, 1965 we should march on the Julien Dubuque Bridge. It spans the Mississippi River between East Dubuque, IL and Dubuque, IA. This could make a great statement and grab media attention.

I just read the four page "findings of fact and order" of Judge Monica "The Kangaroo" Ackley. Her (lack of) reasoning was a murky nonsequitur, preposterous on its face.

Did anyone else notice how defensive, even apologetic that Assistant Dubuque Co. Atty. Timothy "Nifong" Gallagher, the prosecutor, came across in his soundbyte on Channel 7?

Mr. Kass' column in today's Tribune was outstanding.

Thank you SCC and John Kass for writing about Officer Mette's legal woes in Iowa.

I don't know this officer, but I feel sorry for him.

Most fights start with mere words. Depending on what happens after the initial verbal joust, one or both parties may elect to take the correct path and walk away. Officer Mette took the correct path and walked away; Jacob Gothard didn't. It's clear Jacob Gothard initiated the physical fight and his actions remind me of a wise saying from Colin Powell:

"Be careful of what you choose. You may get it".

Gothard chose to fight, got a fight and the results of the fight are his responsibility alone.

Shame on the prosecutor and the judge. What the heck were they thinking? Or should I ask: What are their political aspirations?

Can you imagine what would have happened in a situation like this. Your vacationing in Iowa (I don't know why you would do that either) and in the middle of the night you hear someone trying to break into your home. He succeeds and comes at you with a knife. You give him several warnings to cease and desist which he refuses and you shoot and kill him. After seeing how they treat the victim of a battery in Iowa (Officer Mette), can you imagine what they would do if you had to use deadly force to save you and yours?

Incidentally, there was incident in Southern New Jersey (Deptford) not far from where I grew up that had a lot of media attention lately that reminds me a bit of the story you posted.

A Philadelphia scumbag motorist testified that two NJ officers beat him (he's a 19-yo POS and he and his family have been known to sue for a fast buck)...

Anyway, Patrol Officer John Gillespie was acquitted just recently of these charges brought against him and it was a huge victory.

Guys, the department has no choice but to terminate his employment when he is convicted, when he wins on appeal, which he certainly should, he will get reinstated with backpay etc..... Fuck IOWA and especially Dubuque!

Though I don’t know Mike Mette personally, I’ve known his father for nearly thirty years; and if anyone believes these comments are bias, they are correct. Judge Monica Ackley decision to convict based on Mike Mette not running away is flawed. Life is full of options. When a burglar breaks into your home, you have the option to run out the back door. You also have the option to stand your ground and protect your property. When confronted with eminent bodily harm, you have an ABSOLUTE RIGHT to use necessary force to defend yourself. The uncontested evidence proved Mike Mette struck the aggressor one time with his fist. The force was reasonable and there was no intent to cause bodily harm. One can only hope the Iowa Court of Appeals will reverse this injustice.

Contact the college University of Dubuque President and tell him what had happened. Tell him to investigate one of his student's conduct, Jacob Gothard and express the the President that Mr. Gothard should be suspended from school because it appears that he cannot control himself outside of the classroom. Tell him how it reflects poorly on the community and the school. Let him hear it from all of us.

Stop and think for just a minute. The judge, in her written ruling, vindicated officer Mette, while at the same time finding him guilty. Seems to me she placated the clout of the real offender, while leaving Mette a very very huge door open for a successful appeal and possible lawsuit against the mope.

This is a poor copy cat of Chicago style politics. Had the judge had any courage, ethics, or morals this case would never have come to trial.

Unfortunately- for those of you who claim to be leagal experts, but your expertise is confined to parking violations- where is the Civil Rights Violation and who can be sued? Judges and prosecutors are immune from suits of this nature, unless there is iron clad proof of malicious prosecution, malice, or personal conflict of interest. The police only responded to a signed complaint.

The only suit is against the kid whose family has deep pockets.

Then finally they ask for prayers and remembrance at our funerals for duty and services rendered.

HOWEVER, THIS WONDERFUL DEPARTMENT DID FIND THAT I BROUGHT "DISCREDIT" TO THE DEPARTMENT BY HAVING A FIGHT IN A BAR AND AFTER FIGHTING THE TIME THE DEPARTMENT WANTED TO GIVE ME, I WAS SENT TO A PANEL OF "MY PEERS" AND MY "PEERS" SAID I WAS LYING AND GAVE ME A 5 DAY SUSPENSION. NOW, LIKE I SAID, THIS WAS A PANEL OF P.O'S SGT, LT, ETC. I REMEMBER CLEARLY THE FEMALE PO SAYING OVER AND OVER TO ME AGAIN...."YOU MEAN THAT YOU WERE BEING CALLED NAMES, A BITCH, ETC. AND YOU DID NOTHING?" OBVIOUSLY NOT BELIEVING A WORD I SAID. AND IT WAS THE TRUTH...NOT UNTIL I WAS GRABBED BY THE BACK OF THE HAIR DID I DEFEND MYSELF AND I GOT A FIVE DAY SUSPENSION. I KNOW FOP AND DEPT ...EVEN SOME OF OUR "PEERS" AREN'T ON OUR SIDE. The city coppers have 3 colleges there & they do nothing but grab college kids for minor shit but theyy won't sit on dope houses or blocks. There I was working today when I saw a car with Iowa plates. Parked illegally in an alley. Then Guido the TMA tow driver pointed out that he was also parked under a fire escape!! 2 hang ons and a tow! Welcome to our kingdom.

Then the TMA showed me the Kass article. He asked what Mette did wrong.

Dont bother with the criticism about that guy had nothing to do with what happend to Mette. It was an illegally parked car under a fire escape that was towed as a hazzard. A hazzard to the safety of Chicagoans(sp)!
