Stop Enforcing the Law

  • Ald. Tom Tunney (44th), the city's first openly gay alderman, said police are wasting time by trying to combat an activity "that has been going on a hundred years."

    Several of his constituents in the heavily gay ward have complained about entrapment during police stings, he said. He called those people "victims."

    Police "are playing a game," said Tunney, whose ward includes the Town Hall police district. "Is this really a priority when we've got violent crime on the street?"
Wasn't this his argument when he hung a police commander out to twist in the wind? Why, yes it was!

Tom Tunney (44th) said today he called a police commander after getting pulled over last week for using his cell phone while driving to question why officers in an “understaffed police district” with serious unsolved crimes are “assigned to pull people over solely for cell phone violations.”
So all you guys and gals in 023 - no more cell phone violations, no more public indecency arrests. Offenders are now "victims" of police entrapment. Just like the "reverends" accuse all the police of being racists and Gestapo for daring to stop gang bangers from shooting up neighborhoods, Tunney has decided police are "homophobes" for daring to enforce a law duly passed by the elected legislative body of the City of Chicago.

NOTE: And note this well - this is not a post for tiny brains to spout their anti gay rhetoric. We give a rat's ass whether you're gay, straight, other, etc., as long as you come running when we call on the radio. Same as we don't give a shit if you're black, white, brown, yellow, green or purple. Yes, we've all had fun with the "luberman" comments. He's out of the closet along with a bunch of other people in this Department and in this city and he's going to make more money than we'll see in five lifetimes because of political connections. Big deal. This post is about Tunney using his position to influence the policy and procedure of the Chicago Police Department outside of the legislative process - that and that only.

Let me ask you something. If I went to City Hall's main floor and opened a garbage bag full of sperm filled condoms and also a jar with just a 1000 guys different sperm and threw it on the floor, would the City say it was ok? Well that is what these cruisers do, they do oral and anal sex and drop their condoms right on the ground.

And now we are in an era that an elected public official would say that these acts of homosexual sex in public places are OK, that these scum bags are the victims?

If I was king for a day, there would be a public lynching of this alderfool!

Maybe next we can say that rapists should not be arrested because it deprives them of their sexuality.

Or child molesters are just living out a fantasy.

We have come to a time in this country where wrong is right, where wrong is rewarded and where the people who are just trying to do the right thing are taxed to death to pay for all these fricken losers.

That white flag is being waived by us all, by omission. We are allowing these people to continue any action they believe they are entitled to.

Tunney is an absolute moron! If I'm in a public park with my daughter I don't want to see people engaged in sexual acts. It's totally inappropriate. I agree with you SCC. Go do whatever you want to do, with whoever you want to do it with. I honestly don't care. Just do it in the privacy of your own home, or a hotel room. For an elected city official to actually condone this type of behavior in public is mind boggling. In the long, long, long list of stupid things said by aldermen over the years, this has to be the stupidest thing ever said. That's quite an accomplishment considering our illustrious catalogue of stupid things said by aldermen. Hey SCC, any way we can find out how Tom "Larry Flynt" Tunney voted on the cell phone law when it passed through city council? Would be interesting to see if he voted for it's passage.

The Cook County Forest preserves are loaded with cruisers, many public washrooms are cruiser friendly, our lake front parks are cruiser hook-ups... when did this homosexual stuff become such an Ok thing? These are place are children roam and play, places where we go as a family to enjoy. Where alderman pass laws for police to enforce - but then expect the police to selectively enforce only some laws. And then get angry when the other laws arent' enforced. You can't win.

In an effort to be fair, unbiased and sensitive in enforcing the laws, ordinances and sales at Starbucks in and around the Chicagoland area, all officers will be issued a manual titled,“The SBOL” (Silly Book Of Laws). Yes kids, this handy pocket book will list all the silly laws passed by our honorable, respectable, praiseworthy, and ingenuous (ok, even I’m starting to laugh at “ingenuous”), alderman. Some examples of such silly laws are as follows:

1) CELL PHONE LAW- No person(s) will be issued a cell phone citation if they are a Reverend, Alderman or relative of an exempt member. Officers upon learning the identity of such person(s) will humbly kneel before the subject and allow the driver to publicly chastise him/her for having the audacity to curb their vehicle on the premise of enforcing the law.
2) U.U.W. - No person(s) will be shot at who are seen carrying or pointing a .38 revolver, 9mm pistol, or AK-47 if they first identify themselves as an honor roll or medical student. Prior to giving these alleged scholars a personal invitation to meet the ultimate deity of their choosing, officers will simply stop and ask these subjects, for their cap and gown photo, which will prove that they are simply an innocent dude out protecting their hood.
3) PCS- No person(s)in the media, political, or connected spectrums, will under any circumstances be stopped, frisked, or arrested for having illegal narcotics. Rather than arrest these individuals, all officers are to actually offer these individuals rides to the bar/club of their choosing at which time they will again, publicly apologize to the subject for having the nerve to stop them. Officers guilty of such rudeness will right away, immediately, directly, and without delay, return to their district and recite the newly penned prayer, Our Bad, Please Don’t Transfer Me”.

Just another example of why the gay community is not generally accepted by the rest of society: Many (including Ald. Tunney) gays think it is socially acceptable to have anonymous animalistic sex out in public for all to see and that we should all think that this is a normal healthy activity. I say animalistic because this is the same activity that wild animals, wild dogs, engage in: sniff each ohters butts, have sex wherever they are, and then move on to the next bitch, just to satisfy animal urges. Don't agree with you guys much, but this one is too stupid for a rational person to pass up. I live in Tunney's ward. After this and his moronic actions after his cellphone ticket, he will never get my vote. Someone needs to run against him in the next elections. If I remember correctly he was unopposed last time.

This isn't a gay/straight issue. Who the hell wants to go to a park and see this kind of behavior? I was at the Montrose preserve with kids not too long ago. We passed a couple of strange acting guys when we were there, thinking, "that's the city for you." Had we known, we would've gotten the kids the hell out of there.

In defense of Tunney.
There are plenty of idiot laws passed by idiot politicians that should not be enforced!
Gun registration comes to mind immediately.
These laws serve no purpose except to "victimize" regular citizens.
The only reason we enforce seat belt violations under direct supervision via seat belt missions, is because "they" know most regular street cops won't foist such petty BS enforcement on regular citizens.
I've been the police for 25 years, I rarely make dope arrests; because I don't really care if someone wants to string themselves out and die early, their choice. I have not enforced the prostitution laws very hard either; hell, if someone is so desperate that they have to pay for it, I actually feel sorry for them.
There is a concept in the law called jury nullification, the OJ trial is a classic example. Our system has many checks, there is police officer discretion, Sgt oversight, watch commander approval, ASA approval, court, and jury; all are in place to make sure the community gets the enforcement they think is proper.
The Daley micro-management bosses have stripped away much of the street coppers "flexibility", and this current spat with the alderman is the end result.
The alderman though should ask for a recall on the laws he feels are too petty to enforce and have them stricken from the books; we coppers would be all for that!

If we don't enforce the indecency laws aren't we doing exactly what Tunney wants? I work in 023 and Tunney needs to be knocked off his block a little bit. I had a good drug case against two of Tunney's "friends" who during arrest proceedings were boasting how they were going to get out of it. When I showed up at court the ASA told me the case had been nollied that morning. I asked her why and she couldn't even answer me, mumbled something and walked away.

Tunney personally ran 023 officer NM out of the district for doing search warrants on gay drug dealers. The officer, who is gay, was making large quantity drug arrests daily and making a impact on drug sales. It has always been a unwritten law to leave the gay drug scene alone on Halsted street. It makes my skin crawl that no one stands up to this asshole. Enough is enough.

Cook County prosecutors are reviewing more than 500 DUI arrests made by a Chicago police officer who this month was disciplined for failing to follow proper procedure in a DUI stop, prompting prosecutors to drop 50 of his cases recently.

Prosecutors asked Chicago police more than two years ago to investigate Grand-Central District Officer John Haleas after he allegedly failed to give a man he stopped for suspected DUI a field sobriety test, did not make him aware of his rights to refuse a Breathalyzer exam and did not observe him for 20 continuous minutes before administering the exam, said John Gorman, spokesman for the state's attorney.

As many as 500 DUI arrests from the last 2½ years may be jeopardized by the involvement of Chicago Police Officer John Haleas, according to the Cook County state's attorney's office.

Haleas -- honored as the cop with the most DUI arrests in Illinois -- failed to follow proper procedures during an April 9, 2005, bust, according to state's attorney spokesman John Gorman. The Sun-Times reported Wednesday that prosecutors dropped the charges in that case and 50 others as a result of Haleas' misconduct.

"The entire matter is being reviewed by our special prosecutions bureau," Gorman said.

A source said Haleas could face felony charges of official misconduct, filing a false police report and perjury. Haleas could not be reached for comment.

October 25, 2007 (CHICAGO) - Former governor George Ryan has lost his bid for a fresh appeals court hearing on his racketeering and fraud conviction.

That was the ruling today from the Seventh U.S. Circuit Court of Appeals in Chicago.
The 73-year-old Republican was convicted last year of steering state contracts to well connected cronies, using state money to run his campaigns and killing an investigation of drivers license bribery.

Ryan had asked for a new hearing before all eleven actively sitting appeals judges.

A three-judge panel of the appeals court, in a 2-1 decision, on August 21st upheld his conviction.

Bt. 2005 and the bike units get numerous calls at Osterman beach about men having open sex and sex in the washroom.

Sex in the forest preserves is not uncommon, humping male/female couples in cars is a common sight.

There is a forest preserve out near Western Springs that has the nickname "The Fairy Forest" There is some type of castle structure in it.

I read the blog from time to time and have to admit that it provides good content every now and then. I don't know what the author's main goals are and whether or not he/she/they really care about the blog's mass appeal, but let me give you a few reasons why the blog will remain nothing more than a political satire:

1). You guys do nothing but complain. I've known and worked with scores of CPD officers over the years and the vast majority of them were excellent police officers who were sharp, talented and hard working. Some of them, however, fall victim to a rampant malaise in government- CCS (constant complainer syndrome). Not only is it pathetic, it's a surefire way to alienate a lot of people that are actually reading for the insight.

2). Make a suggestion every now and then. The site's best asset is the hit list on the right of the biggest problems in the department. If you focused on that stuff more, people would respect the blog a lot more than they do and it would actually be relevant. You have some great ideas, why limit it to 7% of the site's content and gripe for the other 93?

3). Quit with the personal attacks. I have no idea why the site bashes Ron Huberman on a daily basis and I'm beginning to just assume it has to do with flagrant jealousy. Today's post about Ald. Tunney was dead on target, so why the heck did you ruin it with an ad hominem assault on someone not even remotely associated with the issue? Are you mad that Ron Huberman has perceived "clout" (not even remotely true) or are you upset that he happens to be exeptionally talented and proved himself at Wisconsin, U of C's GSB, OEMC, CPD, and the Mayor's Office?

4.) Flip flopping. Do you hate Phil Cline? Do you love Phil Cline? Can Starks do the job? Should Starks leave town? Should we go outside Chicago for the next Sup or not? Pick a side and stick to it.

This site has such promise yet it never ceases to amaze me how often it falls victim to unadulterated BS. Whoever writes on here is obviously smart and talented, why do the authors constantly lower themselves by complaining and attacking?

There was an arson this morning in Mt Greenwood, but before everyone starts getting excited about it and jumping to conclusions, it was a property dispute between next door neighbors. One was putting up a fence, the other objected for some reason, and the next thing you know, the objector's garage was on fire in a corner. A small amount of damage, smoke seen by a third neighbor and put out. Nothing else to this one....10600 block of Kedzie, east side of street.

There was a time that the gay community demanded greater police visibility in the area where their liaisons occurred. Why, because that community experiences numerous crimes in those areas (not always reported)…robberies, thefts, rapes and beatings. Not all people loitering in these areas actually intend to engage in a sexual act, some are predators preying on the gay community.

Years ago I was an active DUI writer in a district. Think 1 year I wrote 68 DUIs and worked hard to get then [many off crashes]. Police that write over 100 a year, much less over 200, pure fiction! Nothing legit about it. You really wana see some sand bag bull-shit, watch the next time there's a DUI special employment roadblock in your district. I've read the proceedures set forth to run these and it has no resemblance to what these morons are doing. Nice to be one of the privaged few to get time and a half to violate department rules and the rights of citizens. You see the same guys/gals in court all the time nearly everyday from the roadblock DUIs. Wonder what that court overtime costs the city for these loser cases. And yes, some of these regular players are so very talented that the ASAs toss the case, rather than get murdered at trial. Most of the defense attorneys see these arrests for what they are and go to trial.
Hope the little brown AAIM awards they give you all help you sleep at night.

ANd by being gay, he probably doesn't have kids, and likely never will. He doesn't have to concern himself about what young, impressionable and vulnerable children see out in the public parks. Well, FUCK YOU, Mr. Tunney.
While I will never criticize what consenting adults do in the privacy of their homes or motel rooms, I definitely will control what my kids see when I take them to enjoy playground activities, like playing on the playground, going to the beach, or kite flying.
No wonder AIDS cases continue to climb. Rather than use your position to preach to your "brethren" about the dangers of unsafe sex, people like you (and let's not forget Rev. Jesse, who has gone to Africa to speak about unprotected/unsafe sex, yet knocked up a 35 year old woman in his organization) pretend it's not a problem. Straighten out the obvious reckless abandon of your community first, Alderman, and then you can work on the rest of society.

It appears the 28 Chicago Alderscum trying to get the CR list released were shot down today by Federal Judge Lefkow.

Now the alderscum are going to sue the city to get the list released. Have alderscum every sued their own city before?

CHICAGO - A federal judge is refusing to order the Chicago Police Department to give aldermen the names of officers accused of misconduct.

U.S. District Judge Joan Humphrey Lefkow denied the request from 28 aldermen to release the names of 662 officers accused of abusing civilians in more than 10 complaints from 2001 to 2006.

The city released documents about the complaints this summer, but the officers' names were blacked out.


The city is appealing an earlier ruling by Lefkow that the documents be released. Lefkow says she no longer has jurisdiction because the case is before the appeals court.

Mayor Richard Daley says officers have a right to privacy.

VERY INTERESTING: Tunney got Jan Arnold (one of his supportes) an exempt job at aviation over a year ago, and now she's 1st Deputy of Buildings. Arnold was in charge of the paperwork for hiring an exmpt employee, but turns out that position wasn't exempt afterall. So, She screwed up filing the paperwork for the hire of a young woman from the IG's office to go to aviation just before Arnold moved to Buidlings. That screw up amounted to an "illegal hire" and now the woman who was hired at aviation from IGO is unemployed and the commissioner of aviation is embarrassed all b/c Arnold is incompetent. Is Tunney or Arnold paying that woman's bills now. Nope, they left her out to dry.
So, Tunney's friends can be completely incompetent and cost a woman her job b/c Arnold doesn't know about SHAKMAN. How can the Mayor's office let this slide! Oh, they gave Arnold a 5 day suspension, and that woman is still unemployed.

After looking at Tunney's own words placed in qoutations, Ive' come to the conclusion that all vice arrests are victims of "police playing games" Since people have been using drugs, gambling, cheating on tax revenues like licenses, and yes having sex, for "a hundred of years", gambling and things like theft committed by gypsy groups should also be thrown off the books. No more reverse narcotics stings. No more dice game arrests. Let bookies work in the local bars next to video games that the bartender pays out on from behind the bar. He should be worruing about cutting the city budget so our various taxes and fees will not have to be raised.

He should be worried about the rate of over development in his ward which causes traffic jams and puts an added burden on infrastructure.

I WALKED ABOUT 60-70 FEET AND THEN I SAW WHAT I CAN ONLY DESCRIBE AS "DISGUSTING", ONE MAN ABOUT 60 YRS OLD GIVING A HAND JOB TO A 20 YR OLD MAN WHO LOOKED TO BE MEXICAN. I MUST HAVE SUPRISED THEM BECAUSE THE OLDER MAN SHOUTED SOMETHING AND THEY BOTH STOOD UP AND QUICKLY MADE THEIR WAY OUT. I DECIDED TO LEAVE AS FAST AS POSSIBLE BUT I SAW A POLICE CAR GOING BY AND WAVED HIM DOWN. I'm glad this has come to light. I was down there with my two boys who had to do a project for school last fall. We were there for maybe half an hour and then I heard a guy moaning. I figured some dude fell and hurt himself but I was way off. We went into the bushes and saw two men having anal sex on a piece of cardboard in the grass. I pulled my boys out of there and for the entire ride home they were asking me every question in the book. I can care less who you sleep with but for gods sake don't do it where kids are going to be. I have had sex outdoors with my wife but it was on a high rise roof at midnight or in a tent in the woods. This should be stopped and those arrested should be sent to jail or they will never learn. That alderman is a moron for sticking up for this type of behavior, he must visit the site himself or must not want his friends getting locked up.

Remember the average officer has maybe 2 years of college and 40 hours of law in the police academy.

The average lawyer has 4 years of college and 3 years (full-time law school @ 6,220 hrs) which is about 6,180 hrs more than we have. So they love to get up there in court and make us look less then credible, it's easy for them to do it. They will take a simple arrest that is 15 minutes out of the average cops life and spend the next 18-24 months getting it continued, reassigned to a different courtroom or judge, and about a dozen other dirty tricks they can devise. Then when the aquittal comes down, they get paid and then refer the defendant to one of their buddies that do civil law and they have the press conference saying "the police framed my client, blah,blah,blah and furthermore violated their civil rights..we are asking for $1,000,000.00 to make our client whole!"

As an average citizen AND a mother of two children I was appalled today when I read Alderman Tunney's remarks in the Sun-Times. This is something that's always been done? Police should look the other way? And then he likens the behavior to heterosexuals? First, I would say to anyone, either straight or gay, get a room. Sexual behavior deserves and warrants privacy. If you need to hook up in a public area and I'm walking with my children and see this type of behavior, I will most certainly call the police. And then, GASP, I would expect for them to be arrested. I used to have respect for Tom Tunney but he needs a reality check. I understand he's gay and his constituency is made up of a lot of gays but what about family values? It's indecent, period. It's lascivious and filthy to troll for sex in a forest preserve. I am not anti-gay. Gay's I know are respectable people and
would frown upon anonymous sex simply because it is seedy behavior, whatever your orientation. To have a member of government respond with such remarks in a public forum is just amazing to me. What does he say to his straight constituents? Look the other way if you don't like it? I'm sure there a plenty of gay bars in which to meet people. My personal opinion is that the type of person that would engage in this type of random, irresponsible sex with strangers is a criminal plain and simple. Further, it would lend itself to certain types of people (drug addicts, etc.) and can easily result in personal harm. Look at some of the murders that have occurred in Chicago to gay men in the last few years that went unsolved because they "hooked-up" with strangers. For Christ sake, for an alderman to make the statements he made is just irresponsible and reprehensible. I wish I could ask him, would he recommend a young person who may be gay or struggling with his sexual identity to go the a forest preserve and troll for sex? Is this the gay pride he hopes to instill in his adolescent contituents? Or, if he thinks it's ok, been going on forever, etc., has HE done it or would he feel comfortable doing it? It is dangerous behavior, period! Whether or not gays know of this practice and engaged in it at one time or another, DON'T PROMOTE IT! You are a role model! I am no prude, but my God, this is just beyond disgusting. This is what I pay his salary for? I'm sorry for the rant, but I am so FED UP with the insanity of our public officials I don't even know what to say anymore and the upsetting thing is that there doesn't appear to be any end in sight or anyone on the horizon that society has a chance in hell to look up to.

I'm an addictions counselor and I'd like to say Tom Tunney's remarks today did nothing to promote safe sex or positive public policy in the gay community. I have heard some terrifying stories regarding encounters in the forest preserves. Quite often, the people that congregate there, in addition to being gay, have drug habits, STD's, HIV, mental illness and are frequently criminally dangerous. I recently worked with a young man who was beaten and later tested positive for HIV after an unprotected encounter. He, understandably, failed to report the crime due to the nature of the crime and his partial responsibility in being victimized. I would not advocate ANYONE engaging in that type of anonymous sexuality nor do I think it is normal behavior. Gay or straight, civilized people behave in civilized ways. Not only were Alderman Tunney's remarks irresponsible, I now question his definition of morality.

I worked in 023 years ago. The citizens who owned lakeshore property around Diversey north were able to see cruising from their resideces and requested police action. We flushed them with mars lights, sirens etc. Wrote park curfews and disorderlies. Some of these cruisers were affluent, married, from suburbs. Were happy to get off with a park curfew. I told one not to try to cruise with a Bentley, it was too visible. This was years before Tunney. That constrituency must still exists, and they should now see what they voted in. It is very prevalent. They cut a lot of shrubs and trees around Fullerton and Diversey because of the cruisers years ago. In LA they damn near defoliated Griffith Park in the 50's and 60's due to cruisers.

I finally see the light. After 3 years on the job as a highly motivated officer trying to make a difference, I see the light.

Why should I work anymore? Maybe Tom Tunney is right, I am wasting my time combating crimes that have been going on for a hundred years. I used to think that I was improving the quality of life for the people of Chicago, but despite my efforts, crimes of indecency continue everyday.

Tom Tunney is an elected official chastizing the police department for enforcing quality of life crimes. I am simply stunned.

I used to look at the dogs on this job with utter contempt, and wondered how they could cash their checks in good conscience. Now I understand.

Of course I will continue to back up my brothers and sisters, but my days of pro-active, aggressive police work are over. I will respond to my jobs and drop paper, but that's it.

In the unlikely event that the public opinion pendulum swings back in favor of the police enforcing the law, I may reconsider. In the meantime, I am comforted in knowing that I carry a gun, and can protect myself, friends, and family from the savages of the city.

I don't condone the type of public behavior occurring at Montrose and neither do the vast majority of out-of-the closet gay men. To all you straight officers out there, I'll let you in on a secret. Most of us aren't thrilled about the way we present ourselves during the Gay Pride parade down Halsted every year either. But that's a whole other issue. Thanks.

Evidently the people of New Orleans needed big screen plasmas to survive. Mayor Nagin's incompedence was the cause of most of the suffering in NO. That and people building their homes below water level...DUH! He never had anyone man the school buses to transport people out of the city. His police Dept. was, and still is, run by political hacks. He set up the emergency center (Superdome) in the middle of the flood plane. Then when the going got tough he fled the scene. Fifty years of Democratic rule in NO led to a citizenry totally dependant on the government for everything. These people literally couldn't poop without the governments help. And after their DEMOCRATIC mayor let them down what did they do....they reelected him.........now all the billions of dollars sent for relief has been stolen.
