The Man Without a Union

Sometimes, you run across the most interesting things. Take for example, the minutes of the Police Board.

The 20 September meeting:
  • Wayne Harej, identified himself as a Chicago police officer and said he would like to initiate a complaint because two sergeants are currently on the board of directors of the Fraternal Order of Police, which is in violation of Rule 54 (b) of the Department rules and regulations. Interim Superintendent Starks asked Mr. Harej to speak with Assistant Deputy Superintendent Debra Kirby of the Internal Affairs Division regarding these allegations.
  • Wayne Harej identified himself as a Chicago police officer and said a complaint log number has been obtained regarding the alleged rule violation he raised at last month's meeting. He said that 325 individuals holding the rank of sergeant and above are members of the Fraternal Order of Police.
It must be nice to appear in the same platform as Pat Hill, who addressed the Board before he did - the same Pat Hill who spent her entire career jamming up working police officers, testifying against police officers and just generally, using her status as a "police officer" to undermine the Department at every turn.

So this guy just got a CR on 325 coppers? For being members of the FOP? Wasn't Cline a FOP member? Wasn't Hillard? Isn't Starks? Isn't it kind of habit that the Superintendent be a member? As was explained to us, these people are Fraternal members. They get invited to the golf outing and dinners, they get the newsletter, and the FOP Book.

If we remember correctly, the national president is a former CPD lieutenant; one of the VP's is a Chief of Police. So is another national officer. The FOP umbrella is supposed to encompass all officers. But we guess if you begin your career as a member of C-5 getting other coppers jammed up, old habits die hard. No wonder the FOP threw this guy out.

Wayne has a valid point. How does an officer initiate a complaint against a supervisor/management when his Union has Supervisor/Mangement on the Board?

That smacks of impropriety,is a blatant conflict of interest & in itself is a violation of the By-Laws.
How does the Union act in the best interests of it's membership when Management can influence dicate policy?
You're way off base on this pertinent issue SCC,Talk about Silly People.

I believe the Wayne Harej complaint is not against the FAIR SHARE Sgt's and above Ranks but against the 2 Sgt's who currently hold positions on our F.O.P. board of directors.

Most of our members would agree that the Sgt's already have their own Union, so why don't they run and get elected to the PBPA board of directors and stay out of F.O.P. business...

You forgot to mention SCC that the 2 Sgt's also get paid $500.00 a month for serving on said F.O.P. board of directors in addition to the extra salary Sgt's receive.

Nice one sided reporting by SCC.

SCC - isn't this the same guy who was passing out information about union corruption before the last FOP meeting? The FOP settled a case against it for over $500,000 including attorneys' fees. No mention of that SCC. THE FOP IS NOT INSURED! The money is going to come out of FOP members' dues. Gee - is SCC part of the FOP Board?

The FOP is a fraternal organization for all police officers regardless of rank.

Since it is a bargaining unit, supervisors can join at a reduced rate but the FOP will not assist them in legal matters, department problems, etc.

What's the harm?

This post is for you because I doubt you will give my response to your readers.

Donahue is the first FOP President that has allowed members of the board who were POs when elected to remain on the board once promoted to Sgt.
I had issues with past FOP President Nolan but at least no board member under his tenure was a Sgt.
How can Voight and Majerczyk wear two hats advising members how to deal with the department and at the same time Sparring the same individuals. Impossible

Take away the $400.00 a month Voight and Majerczyk get of member's union dues, free drinks and they wouldn't be there and if they say they would donate the $15,000 each that you Voight and Majerczyk will get from dues and donate it to the Gold Star Families; knowing those two it ain't happening.

SCC if you believe that Sgts should be on the board why can't they run for office as Sgts. Why didn't you or Donahue's group propose a By Law change to make it happen.

Why?

Because you know and Donahhue knows it would be the end to his $186,000 salary and the gravy train is over if he gave that issue to the members.

As far as the Sgts in FOP they would remain members of the State and National Lodges as they are truly "Fraternal" organizations.

SCC do yourself a favor and instead of being a parrot for Donahue look and the Federal Tax returns for FOP LOdge 7 and the FOP Illinois State Lodge.

Lodge 7 declares as required by IRS to state their purpose to which they respond representing officers in union matters directly opposit to the Illinois State fop declares a "fraternal" benefits for members.

Stay tunes this is just the begining election time creates concern with the executive board of FOP Donahue, Dougherty, Bella, DiMaria Fallon Capprelli and Davis as those $100,000.00 dollar salaries and make your own hours (no one is watching) are over and back to the rank and file.

PS I arrived at the general meeting to past out information about the $$$$Lawsuit and was just in time to see the arrival of Fallon in a cab as his vehicle is parked right in front of the union hall and he didn't want to lose his spot no doubt a little xmas shopping..... and Frankie you were really late.

Do you have an agenda??? The FOP is for members that are NOT management!!!! If you think a Sgt. can provide advice, direction etc. contrary to the goals and mission of management you are absolutley ignorant. Are you aware that once you become a member of management Sgt. LT. You can never return to
D2A-D2 or D1 status?? Thats right you give up the right to return because you are now MANAGEMENT!! The point is they have the responsibility to enforce dept. goals, missions and directives that are OFTEN contrary to the FOP goals for its membership. DO NOT blame one guy for standing up to this blatant contradiction!! Maybe it is because you have such strong ties to BELLA??? I wonder???

pat hill tryed to get a spot at the academy when she came back from her LOA (prior to her retirement), but was told "were not looking at resumes right now". I imagine that she wouldn't have retired if given a slot in which she would be able to produce future pat hills.

You Sir are a moron! There are no mechanisms to remove a trustee who is elected by the members and during his term is then promoted. Your contention that management is dictating policy is an absurd argument. I seriously doubt that these two sergeants represent the management of the Chicago Police Department while serving as trustees. They can only vote on issues that are fraternal in nature i.e. picnic, golf outing, fishing tournament etc. etc. These are hardly issues that have a profound effect on the interest of the membership. I'm confident that the management of the Chicago Police Department gives a rat's ass as to whether the FOP picnic be at Gaelic Park or Santa's Village.
Wayne Harje needs to get a life!
By the way I am a dues paying member of PB&PA and when I was promoted to sergeant I was offered an invitation to remain as a fraternal member of FOP. I pay my $50 a year to keep that membership.

As a man with almost as much time as Bernard Kelly on the job, I have some advice for you young people. I know it seems unnatural to arrest a fellow Officer(you know,we all were blue).The main thing is you cover your ass.Guys like Kelly are out there and they are looking to jam up white coppers. When I was a rookie we had Boise Shorter and Cliff Richardson, who are carbon copies of Bernard Kelly.Once they start with that racial profiling shit and refuse to show identification, place them under arrest, and notify your Sergeant.DO NOT cut them any slack or you will regret it. Agreed. Worked with Wayne in 015 when he was in review. If you guys would stop hating and sit down and talk to the man, you would see for the most part he is absolutely correct. The rules are there, they just don't want to follow them. When he brings this to their attention, they don't want to listen. Why did they file amended political disclosure returns with the State with the correct numbers on them? Because HE made them do so. Not that it really made a huge difference, but they were WRONG and he was RIGHT? Any one else have the BALLS to stand up to their union?
What's the latest movement on the contract? What is their take on the IPRB investigating shootings? You pay these clowns more than a dollar a day, every day of the year? What do you have?

I predict no contract till '09

Remember years ago, had to be over 20 years, when Boise Shorter wore a tape recorder under his clothing and attempted to get a lieutenant or captain from 002 on something or other (I do not recall). They say the boss beat his ass.

When you came to 005 as a PPO the first thing you were told (by black and white) officers was not to trust him. Heck, he was in Cynthia White's test group for sergeant. She was meritorously promoted for wearing a wire for the feds against the 002 district tact team. He was made an FTO.

Well, if I didn't think that you were in the pocket of the F.O.P. before, I sure do now. So let's see just how one-sided your comments are. Your labeling of this topic as "silly people" is remarkable.

First, please notice that Wayne's issue is with the two sergeants that have been using the F.O.P. Board of Director's positions as a part-time job. But his reasoning goes far beyond the approximately $5,000 per year that those TWO sergeants receive EACH. His reasoning is very valid because it is impossible to have a management person on this department protecting your rights. It is very easy for a boss to protect you in an informal setting, but when all hell breaks loose, you can bet their job will come first and you'll be left swinging in the breeze.

Second, his issue is not dealing with the members of the F.O.P. who happen to be sergeants. No one has ever said that they can't remain in a VERY different status in the F.O.P., so the fact that you queried as to whether "this guy" got CR's on 325 other sergeants is very disingenuous and shows how ignorant you really are of the facts. "Silly SCC", he got the C.R. on TWO sergeants who are in rule violations for remaining on the Board of Directors of the F.O.P. after their promotion to the rank of sergeant.

Third, maybe you should read minutes of the Board of Directors meetings and the trustee meetings to see just how much input these TWO sergeants have. And this input goes well beyond a picnic or a party. The fact that they are given an opportunity to speak is too much input.

Fourth, the last person prior to these TWO who was on the board who was promoted was Dominic Rizzi. Although he did think about staying in, he did not. Perhaps, he realized that it wasn't the right thing to do, or, perhaps, he just got tired of me yelling at him.

Fifth, at the September 2006 meeting in which by-law changes are brought up, there was a by-law change introduced that would have addressed the issue of TWO sergeants remaining on the board. This was soundly disposed of by President Donahue by his not permitting a separation of the room or a hand-count. The by-law was shot down by a group of "silly people" led by the TWO sergeants who made sure that the "nay" vote was yelled. In fact, one of the TWO sergeants, who shall remain nameless was quite upset that I would question his ethics about his reasons to remain. I suspect that his law practice was not doing all that well and he needed the extra money from that part-time job as a trustee on the F.O.P. for approximately $5,000 per year.

Yes, sometimes I don't always agree with Wayne, but this time you are so far off-base SCC, that it stinks.


Now, as far as the discussion of the very recent apparent settlement against the F.O.P. Maybe you should open up a thread to discuss the settlement of that lawsuit against the F.O.P. Officers. I would really be interested in seeing just how much people do or do not care about the fact that our board chose to "piss away" at least a half a million dollars or more, in some really stupid legal actions. But wait, there was an attorney who was sitting on the board (who just happened to be a sergeant), who probably should have known better. Well, the original request to settle, prior to a lawsuit being filed was a bit over $10,000. Wow, if that sergeant/attorney had any input in the decision to keep on fighting and to proceed through the process of multiple depositions, we just got seriously hosed.

Oh, btw, SCC, just where will that money come from (I ask rhetorically)? Will it come out of the general membership funds? Or will it come out of the Legal Defense funds which should be used to assist a police officer who gets jammed up?

Lastly, here is the info on the apparent settlement. Case No. 05C 7179, in front of Judge Virginia M. No contract now for 2009 because of the proposed changes in discipline and OPS. Money and heath care costs were falling right into line.

It almost kills me to say the Wayne is right about the Sgt.’s but they can’t run as Sgt.’s so the matter will clear it self up an a few months. There is nothing in the by-laws to force them out. Nation wide almost ALL bargaining units cover everyone other than command staff. The city likes the divide and conquer method. They were trying to get the Sgt.’s back into FOP.

Wayne’s # 1 problem with FOP is he is not the President, a little Napoleon. It would be nice if he and his drunken buddy from 16 would just fade away.

Al Jaglowski raises a lot of good points when you take him one on one. But it is hard for him to move around without Wayne’s puppet strings. At the meeting when he was acting as Wayne’s surrogate, he was asked if these were his ideas and not Wayne’s. Al said he did it all by himself. The problem is when Wayne Faxed the paper work for this Al forgot to cut off the Fax to and from message numbers off the top of the paper work. Al turned beat red at being caught in a bold faced lie.

Al has a lot of good ideas but now after almost 30 years of knowing him I can’t depend on him telling me the truth anymore. It is a shame he is Wayne’s puppet now he could have brought a lot to the table without the strings.

Wayne and Al Jag have run for FOP offices more than Roland Burris has run for statewide offices -- and that's a lot. Time and again, they have both shown themselves to be fringe players who can't get the support of the police. Why, you ask? Simple, I say. Once you meet Al and/or Wayne, you instantly realize that they are both brain damaged freaks that should never hold any elected office. The fact that these morons have remained gainfully employed for the past 20 years proves beyond any doubt that our union is strong. . . maybe too strong. PS for you Wayne Muthafucka, I was at the meeting too. "Frankie" was not late at all, you fat bloated piece of shit. Frankie recently had a severe leg injury that would put you or any pussy such as yourself on disability, but he came back to work ASAP post-surgery with crutches, then a cane, now he is walking unassisted. I'm a sergeant, and I'm still a member of the F.O.P. Lodge 7. But I'm a FRATERNAL member only. I don't get any contractual benefits from the F.O.P. I get the handbook, small amount of life insurance and stickers. I could but do not attend the annual picnic. I still get a ballot in the mail for elections, but I recuse myself from voting.

If the two sergeants on the board of directors had any honor, they'd resign their positions. Actually, they should have resigned right after they took the oath of sergeant.

On the bright side, they cannot run for re-election, so they're lame ducks.

Majerczyl is on the Constitution and By Laws Committee at $50.00 a meeting plus buffet A Sgt determining the Constitution and Bylaws for police officers unbelievable!!!

As long as we're talking about the union. Does anybody know that our union is being sued? there was some kind of sexual harassment beef and out union hired a female lawyer. Before the case could come to fruition, the female lawyer gets herself pregnant. So since she can't finish the case she asks for payment of her fees (aobut 12 thou) and she'll slip off quietly into the sunset. Well our present officers tell her to **** off and refuse to pay. Not only that they start some kind of sexual harassment of their own. They smoke in the building in front of her (even though its against the law), and a host of other kiddie activities. Well the female sued, and will win a hefty sun. She turned down the last offer of about $500,000. Everybody in the union office is mum about it. Now where do we think our union is going to come up with that kind of cash? No matter how you cut it, its going to come out of our pockets. the sad thing is that they're not letting this info out to the rest of us-and why should they? Its going to cost us big bucks. There's a couple mil in the lawyer's fund, but that's for the rest of us isn't it. Somebody has to put this on the record so that the national FOP can take a look at our leadership, and once its on the docket they can't duck the issue any more.

It almost kills me to say the Wayne is right about the Sgt.’s but they can’t run as Sgt.’s so the matter will clear it self up an a few months. There is nothing in the by-laws to force them out. Nation wide almost ALL bargaining units cover everyone other than command staff. The city likes the divide and conquer method. They were trying to get the Sgt.’s back into FOP.

I believe the two Sgt's on the board were PO's when elected to that board. As such there is no mechanism to force them out until the next FOP election, that cannot run again for the FOP board as Sgt's.

Now which PO among you would, once you made Sgt., would quit a side job that meets once a month and pays what, $400 or $500 for that day? Hell, if I were there I would do the same, show me the money. Next election thay can't run. A change in by-laws is needed to force a board member out once promoted or otherwise leaving the rank and file.

So far they have just done what every other copper in this city does, fill their pockets with some free money, and why?

Did the disabled officers that paid you dues know that they were paying part of your mortgage?

If anyone is really interested in knowing how the DCPOA was operated, how the little money we did received was used, they are certainly entitled to have copies under the freedom of information act.

After I receive a written request. indicating what documents someone wanted to look at, I will go to the storage facility and pull the records pertaining to those requests, and make the necessary copies. You just need to send me your name, address and phone and a check for $10 for copying and postage.

We at DCPOA,. Accomplished what we set out to do, and every officer on disability at that time reaped the reward of our hard work. We disbaded our organization since the goals were complete.

The fire department union covers everyone up to the rank of battalion chief, which is equivalent to our captain and they have no problems with it. Our supervisors are not really management, as they don't meet the federal government criteria for true management personnel.

A supervisr should not be on the board for obvious (conflict) reasons.

If there is any grey area, for the good of the entire membership, which they claim to serve, they should step down. NOW!!!

I was a unit rep for over 6 years.

I stopped being the rep because of all the silly BS and lies that went on at the meetings.

The prez, no matter who would have the final say. After some stuttering.

At least nutty RJ would keep talking to have his point heard.

The whole board is screwed up.

I never received any help with anything from Fallon or anyone else. They are police officers, not specialist in contract negotiations or disciplinary issues.

Regardless, like all the other typical Chicago BS, it is a never ending cycle.

As a Sgt. you should realize the appearent conflict.
