Not Really Accountability

From the Comments (can anyone confirm?):
  • Intresting word from the LT'S class in the academy . ADS kirby, and other came in and really shook things up. It looks as if the recent audits of search warrants will result in CR#s being filed on all members on the warrant including LT. Any officer who has three court absences in a period will be investigated as rogue, even if the absesces are excused. The rational is that the officer must be avoiding the court case. Any officer who recovers 12 guns or more in a period without at least 4 search warrants being executed, will be investigated, because statastics show 4 warrants must be executed to get 12 guns. If you make an arrest, but the offender agrees to show you places of intrest before you bring him into the station, this is considered kidnapping because your holding the person against thier will. Any officers who get an offender to turn in a weapon is guilty of cooersion, and will be investigated, and last but not least, an IAD LT stated that they will continue to investigate CR#'S regardless if a sworn affidavit was obtained or not
Kirby doesn't have much room to stand in judgment seeing as how her people missed a number of large scandals for years and signed off on a huge number of investigations that abetted the cover up. And the statistical bean counting shows a propensity to rush to judgment based on a computer reading rather than, oh we don't know, an actual INVESTIGATION maybe?

The last sentence seems like a contract violation (and a violation of State Law) of rather large proportions and anyone with knowledge of there being investigations of themselves or other officers without a sworn affidavit should bring evidence of such to the FOP for action (the exception being investigations criminal in nature derived from evidence collected by IAD which do not require an affidavit).

Anything in the "GRAY AREA" can be construed as criminal.

IE. PO Smith detained me without reasonable cause for a "Ticket Like Card" Contact Card,for those not familiar with our illustrious police spokeswoman,Monique Bond. Depending upon the "Made Up" circumstances of the beef. IE. Length of time,handcuffed,in the back of a cage car,restricted movement,unfree to leave,etc.

IE. Officer Jones punched me while arresting me for no reason. Battery

IE. Officer Martinez threatened to lock me up with drugs if I keep standing on the corner by my house at Hamlin and Lawndale.
Official Misconduct,etc.

IE. Officer Flaherty squeezed my genitals while frisking me and asked me how do you like that.
Sexual Abuse

IE. Officer Rubinsky gave me a ticket for speeding on LSD and insinuated that a policeman can ge treal hungry at lunchtime.
Bribery

IE. Officer Oslowski just falsely arrested me for walking down the street minding my own business and charged me with reckless conduct.
Official Misconduct

Read the writing on the wall people.

Wakeup,FOP is and will NOT (CAN NOT) do shit to stop this WITCH HUNT. This campaign will destroy and has destroyed many officers lives,families,careers and sanity. You can bet that if you look closely enough you will see what I am conveying...

Then Cline gets involved and diminishes the punishment recommended and meritoriously promotes the fellow. No wonder the public wonders what the hell is going on.
Maybe the Feds should put the Department into receivership!

Here is a question for you armchair lawyers.
Say I get called in for an interview regarding a beef, and I bring in my FOP appointed attorney. According to state LAW, the beef that is being investigated is REQUIRED to have a sworn/signed affadavit from the supposed victim. Are they required to show me or my rep a copy of the affadavit? Am I required to file a freedom of information request and will that cover it?
Now, lets say that the "investigator" assigned says that there is no sworn affadavit, that the complaintant is anonymous. Do I have any right to arrest the "investigator", as I am a PO, who is on duty and who has just observed a crime? If not can I file a civil suit against the department, and if so, What would I allege?

I think it's hilarious to see the same people bitching about IAD letting scandals happen are the same people bitching about and not cooperating with IAD during ANY investigations.

Can't have it both ways. At some point, you start to sound like the fake revs, crying about how high crime is, but also crying about anything done to clean it up.

And while I wasn't in that LT class and I couldn't testify to anything said there, I would bet a pay check that an IAD LT did not say to investigate things without an affidavit. There is a bypass protocol in place when there is enough evidence on the face of the complaint ( like existing video ) to warrant continuing the investigation without a complainant. That doesn't mean if your neighbor says you called him a dick, then refuses to cooperate that they are still going to bypass an affidavit.

I've never seen such IAD induced paranoia in my 21 years on this job. The problem with it is that it doesn't stop the real criminals on this job ( and we can all agree that there a FEW ), it only stops the workers because they are afraid they'll get lumped in with the criminals.

Exactly. And it wasn't until they got the CTA videotape that the truth came out. Before that, the officer, Cline, and the City all backed the phony version of the incident in the report.

With the Abbate incident, it wasn't until the Commander put the squeeze on the media at the courthouse that Cline got fired.

Like every other organization, the CPD has problems. That doesn't surprise anyone, and shouldn't. Nobody holds that against you, at least not anyone with a brain, and without some other agenda.

But the refusal to admit that some police officers do screw up, or do bad things or, worse, covering up things like that, casts doubt on everything every police officer says.

Most of us want to believe the police. Most of the time, we can. But, when we see, time and time again, good officers covering for the bad ones, we have to wonder.

It wouldn't have been a $12 million verdict if the officer had just told the truth, if IAD and OPS had done their jobs, if Cline hadn't stuck up for the officer. The guy that officer killed didn't have $12 million wortht of life in him. But, as it was with Nixon, it aint the crime that gets you -- it's the cover-up.

As a citizen, I genuinely worry about how many bad guys are going to get off now because nobody wants to believe the police. And I genuinely worry about how many good police officers are going to get screwed because nobody wants to believe them.

I still believe, mostly, because it is, mostly, the truth. But you can't blame people for wondering when stuff like this goes down.

I am in one of the teams whose search warrants were audited. Twice now in the last 6 months. There have been NO Cr#'s on anyone generated as a result of the audit, and only suggestions made as how to better document the search warrant process to ensure compliance with the new order. That's it. No witch hunt, just an audit conducted in a reasonable fashion. Sorry to disappoint...

I went to review my cr file a couple of weeks ago. Turns out I discovered that the Dept. had in my file two Log #'s. from last year. A log # is a complaint called in but with no affidavit signed. In addition the dept. is using those numbers just like Cr#'s to justify placement into the "programs". By her own admission a Sgt. who is in charge of the programs agrees that this is a violation of the contract and the G.O. I filed a grievance immediately and am waiting to hear from F.O.P. I advise all members to do the same, make an appointment with records of IAD Sgt. Muzapappa and view your file. If you have log#'s in your file, you should file a grievance.

Per our contract which can be found under appendix L paragraph 10, it states the following: No officer will be required to answer any allegation
of misconduct unless it is supported by an
appropriate affidavit, except as specified in paragraphs
one through five above. In the event that
no affidavit is received within a reasonable time,
the investigation will be terminated and no record
of the complaint or investigation will appear
on the officer’s Disciplinary History make an appointment with records of IAD Sgt. Muzapappa and view your file.

If you have log#'s in your file, you should file a grievance.

In the FOP newsletter this month this subject is also discussed. Here's what supposed to happen to those tracking/log#'s:

Tracking Number
When a citizen’s complaint
against an officer is received,
IPRA issues a tracking number.
The tracking number can
be investigated up to the point
where the officer is to be interviewed
or required to write a
report. At this time an affidavit
is required for the investigation
to go any further. If an
affidavit is not obtained the
tracking number is deleted and
the complaint goes into cyber
space. If an affidavit is obtained
then the tracking number
becomes the C.R. number.

IAD with or without Kirby will always be what it is: If you got the clout then you can commit even murder and get away with it,if you are just the average working copper then any little thing will get you time or fired. Big question is will Jody go after this and change this bullshit or will it all remain the same?
As for search warrants for guns. I know for a fact that certain Area gun teams are producing warrants based on lies and ficticious CI's. The ASA's office knows this also but being true to their lawyer profession they have no qualms about putting people through trials based on lies, hoping the person will plea out because they can not afford to continue the fight. Now no honest copper likes thieves on the job but...I would rather tolerate a thief than a group of coppers who execute search warrants against gun owners based on lies and non existent CIs. A thief is just that but a copper who will sandbag innocent people and lie on search warrants to recover guns and get heads is a dirty rotten piece of shit who has no business being on the job. That also goes for any white shirt who condones these actions. Speaking of white shirts why is Roti always interviewed concerning these gun pinches and gun issues? You gotta ask yourself how these coppers doing these bullshit warrants live with themselves knowing their lies put people in jail. The ASA's being low life lawyers I am sure have no problem sleeping at night. How about it Kirby and IAD what are you gonna do to these gun teams????????

A little bit of what was written was eluded to in class. She never said that any of those things would start an official investigation,however. A lot of that shit is just plain bs and never mentioned by ANYONE in the Lieutenant's training.
This makes me wonder about your sources SCC and your accuracy concerning other subjects on the blog...... Yes, I was there for the aforementioned training.

She might want to investigate those officers / detectives who ignore their assigned jobs because they are too busy studying for grad school. She might want to investigate those officers / detectives who claim they need sleep to attend their day classes and only work a portion of their shifts.

I was in that class. I can only say that if THAT is what you heard, what you understood, then I have no doubt you are one of the people that will be a commander in no time and probably also a merit pick. A lot of liberties taken with the truth there a lot of "color" added to the story.

There was some heated debate regarding the "Rule 14" violations, but other than that, I thought that Kirby and Lt. Nailway were both pretty damn informative and up front.

Another 27 cents saved by Shit-Cough-Go - the cost of the ribbon. #1. the question was posed rather heatedly that why when a complainant refuses to sign an affidavit do we still have to attempt to identify the accused? IAD was told that if sgt's had as little info as a car# or beat# from the PCAD then we had to identify the person responsible for that car or beat as an accused. IAD said that is not the policy, and it took a few minutes for the sgt/lt to get it into the dept advocates head that the commanders and deputy chiefs, at least in area 1 and 2 are kicking back cr#s and forcing us to identify these officers. the sgt/lt simply asked them to either add a new form or change the classification from accused to "on the scene" or something to that effect. IAD said they would look into the policy and attempt to rectify the situation.
As far as continuing to investigate after a cr affadavit was refused to be signed, IAD said they still go through steps to identify the officer, as the order states, but if all they can come up with is a car# from PCAD then he would never name an officer. can u see the confusion, IAD does it as the order states and we do it as the c/o's and d/c's say, all due to this bullshit accountability that only applies to the working police officer.
so officers be assured that there are some of us in this class that are less worried or afraid as to being sent to a southside district on midnights as we are and hopefully always be looking out for the p/o. now the naysayers can say what they wish but those of us know who we are and so do the people who have worked for us in the past.
#2. Kirby did mention that if an officer comes in with say 12 weapon turn ins inside a week that would be a red flag as to how they are getting them. it was just a message to the new lt's that accountability is starting to work its way to field lt's and sgt's and they are going to be called to the carpet as to what their officers are doing. the one thing kirby didn't understand that in patrol, sgt's and p/o's are in such demand that there is no possible way to keep track of what every one is doing at any given time. IAD wasn't looking to trash coppers this time, they are just so wrapped up in the bullshit at 35th st they just forgot about the backbone of this dept. or "the red headed step children as we are referred to".
#3 tony carothers made it in wed., but he is not the first person promoted who was out of town while a promotion was announced. u know the city does the promotion on friday and expects us to be ready to change our life in 2 days.
#4 and #5 it is interesting how 2 sgts/ lt's still have their company car. maybe they just haven't had a chance to return them due to the incredible pressure they are under in class.

The last sentence seems like a contract violation (and a violation of State Law) of rather large proportions and anyone with knowledge of there being investigations of themselves or other officers without a sworn affidavit should bring evidence of such to the FOP for action (the exception being investigations criminal in nature derived from evidence collected by IAD which do not require an affidavit).

Say I get called in for an interview regarding a beef, and I bring in my FOP appointed attorney. According to state LAW, the beef that is being investigated is REQUIRED to have a sworn/signed affadavit from the supposed victim. Are they required to show me or my rep a copy of the affadavit? Am I required to file a freedom of information request and will that cover it?
Now, lets say that the "investigator" assigned says that there is no sworn affadavit, that the complaintant is anonymous. Do I have any right to arrest the "investigator", as I am a PO, who is on duty and who has just observed a crime? If not can I file a civil suit against the department, and if so, What would I allege?

Kirby inherited all the scandal cases when she took over IAD in July 2004. That shit was happening way before she took over IAD. Why? Especially why "most certainly"? Our teams were picked for the audits because of our numbers of warrants, the type of team, and because of individuals who USED to be on the team. I doubt an audit which found no wrongdoing would cause a confidential to be generated. Sometimes, it just is what it is, no more no less...

Once again we have a policy maker, Kirby, making decisions that govern the actions of working police officers. And therein lies the flaw of this entire department. Until this department promotes people who have actually been police officers the nonsense will never stop. After twenty-one years I have seen so many "clowns" wearing gold stars I sometimes think I work for Ringling Brothers. These so-called leaders within our department are embarrassing and incompetent losers. Throughout all the recent scandals not one of these spineless, gutless "leaders" has stepped up to defend the honest and decent cops who go out every day and do this impossible job with integrity. Like the true cowards they are they hid, afraid to speak up to these porkchop preachers and so-called community activists and speak the truth. The truth that the very people these reverends purport to represent are the same people who drain our society of every available resource.
The response from our "leaders" because of a few goofball cops was to paint all of us with the same brush and all of us are now subjected to scrutiny and our integrity is now questioned.
I've often heard the truth will set you free, but here in Chicago no one wants the truth unless it's self-serving.

All Kirby had to do was receive a phone call from exempts and the complaints were not sustained or unfounded. No clout sustained!
She is definitely guilty when it comes to Finnegan, she had some cases unfounded or not sustained against him, and once he was arrested she immediately had the findings changed to sustained! Remember the lady that Finnegan struck with the unmarked car, cursed out and left the scene.....DK said UNFOUNDED until Finnegan got arrested. After his arrest it was hurry up change this change that sustain,the case......This is 100% TRUE!
