Kirby Sweating - Mayor, Too

Monique here again. Boy it was an interesting day in the media yesterday, wasn't it? I had to field a whole bunch of phone calls regarding Deb Kirby, what she knew and when she knew it. It was like working for the Carter Administration. Or was that the Nixon people? I can never keep those guys straight. Anyway, the heat is on and the mayor himself had to step up and read the media the riot act. I mean, if the mayor has to tell you to shut up and stop asking questions, you know there's got to be a huge story buried in there somewhere:
  • The new head of the Chicago Police Department is standing by his choice to be his top legal adviser, despite a memo that raises questions about how she handled complaints about officers in an elite drug and gang unit. A memo obtained by the Chicago Tribune shows that an internal affairs investigator complained in June 2005 that his superiors had not approved a more aggressive probe of the Special Operations Section, despite mounting evidence of wrongdoing. The unit has since been disbanded, and seven of its former members face charges of robbery, kidnapping and making false arrests.
If I missed like 30 press conferences, someone would be screaming for my head. Well, maybe not. Pat would probably step in and be happy for the face time on the TV (he misses it). But these jokers miss at least that many court appearances? And the CR investigations? And the money beefs? And the alleged home invasions? All mysteriously disappear for years.

Oh, and did everyone see me quoted in the article? I'm soooo excited! I have to remember to get that one for my scrapbook:
  • Kirby's promotion was part of a massive reorganization by Weis that also included replacing 21 of 25 district commanders.

    "The FBI has had a close working relationship with Deb Kirby," police spokeswoman Monique Bond said. "Supt. Weis has full confidence in all of the command changes he made."

    Bond said that prior to the memo being sent, some SOS officers' behavior was "under review" by the confidential investigations section, but that would have been secret, even from other people in internal affairs.
"Massive reorganization" doesn't even begin to describe what I'm doing to my rolodex, let me tell you. And that close working relationship with the FBI? It's a smokescreen seeing as Weis is ex-FBI now and it doesn't really matter. The full confidence thing is a boilerplate phrase we use when there's so much BS in the air, you can't even walk down a hallway without slipping on some.

UPDATE: Here's the mayor defending Kirby. That's kind of unusual. You think Deb knows where the investigations went south? Where the clout was? Who covered up for whom? How high the money went?

UPDATE: Here's the FBI releasing a statement that they aren't investigating Kirby. It sure seems like a lot of people are getting out in front of this media investigation and denying that they have anything to do with any part of it.

Cline was extremely short term in his thinking. SOS did not do big dope for years, in fact , they were not allowed to do search warrants. They were not set up to do those particular missions. Cline let them run loose, hoping that his time would end before the S### hit the fan. He loved parading around with the guns from their missions, etc.. Many people saw the whole thing coming, then there was the no see IAD who actually was on the sidelines. Everyone here can figure out what happened.

when a p.o. has knowledge of any inproprieties committed by any clout heavy po or any politician and he uses the chain of command - that chain of command for some reason informs city hall (da mayor) - who then tells the top of the chain of command how to handle the matter - in most cases - quiet the squeaky wheel.

Taliafero did not know, nor did the Tribune, that there had already been an open investigation in the Confidential Section regarding the SOS mess. Bob Milan is a stone faced LIAR when he says that CPD did not bring this case to them first. And you'd be surprised and worried to find out just how close the working relationship with the FBI has become over the last two years.

Let's not forget that the other p.o., McLaughlin, was kicked out of IAD several years ago due to some sort of connection to Corey Flagg and company.

Everyone is salivating over getting Kirby dirty on this SOS thing. It isn't going to happen. ALL the facts have never been presented because it is still considered an open case, but continue the mindless speculation in the mean time...I mean you read it in a newspaper, it must be true! Right?

Police to watch over buses

When spring break ends next week, Crane students from ABLA -- also known as "the Village" -- will gather at one central location each morning. CTA buses will pick them up after they've walked en masse to the bus stop.

Then a Chicago Police escort will follow the buses to a transfer point, where under the watchful eyes of even more officers, they will board second buses to Crane at 2245 W. Jackson. They will enter the school under police watch.

"On their way home, it will be vice versa," said Ald. Bob Fioretti (2nd).

Fioretti was among the officials who met last Tuesday to negotiate the plan after it became clear that ABLA students were not going to return to school until they felt safe. ABLA parents had called the school, police, their alderman. They said generations of gang violence had taught them what was coming.

Here is why their are beads of sweat on both their foreheads. The story is that the Abate Incident, the tape of it, was known to IAd BEFORE THE MEDIA GOT IT. The tape was brought to the attention of the Mayoral Press secretary, Jackie Heard who instructed Kirby to Bury it , because it was damaging and inflamatory to the little guy. Kirby complied but the tape surfaced anyway, someone has got to pay opps time for a new Supt. Now we have the latest golden boy, J-Fraud who never answered a call in his life, doesnt know how to handle a domestic orhold a roll call with 25 pissed off police officers. He gets his orders from the hall nothing changes, Kirby rewarded to keep quiet.

The FBI has a long standing policy of letting CPD bosses slip thru the cracks while they go after the easier, less connected little guy. The working patrolman has better and longer lasting news copy and cannot ask favors of the editors to lessen the press play.
Anyone who has had long career with the city has seen this. The fact thet DC and MT are protected is nothing new. We even had a boss who wore a wire several years ago, the feds forgave him and let him go onto another clout city job.
After all, don't forget the feds usually coverup their own and let them "retire" rather than prosecute.

Nothing ever changes and nothing ever will. When the deptartment arrests T.H. from 011 for the off duty murder committed on Madison in Jan 1998 then and only then will it be considered legit. While you're at it get Frank "the rat" for covering up the murder. As far as the SOS thing goes Kirby and IAD did what they were told and what would benefit them. If the States Attorney never started the investigation the SOS guys would still be doing what they were doing. Interesting that only the Mayor and CPD remember all these meetings with other agencies even after the other agencies claim these meetings never happened. Same shit different day you got the clout you'll get away with everything including murder, ask T.H. form 011 No clout then IAD and CPD will give you time maybe 30 pending just ask many unfortunate po's who have been the victim's of the no clout system.

So let me get this straight.....Kirby dropped the ball because almost all if not all the complaints against Finnegan and company were not sustained! Where there is smoke, there must be fire....right? So many beefs, even not sustained must be indicative of something.

OK, but on the other side of that coin, FOP and almost everyone in the department bitches about the bullshit beefs that come down, how IAD is out to screw everyone, and it's all just so much of a conspiracy to screw a copper at any cost. If the facts aren't there, then it has to be not sustained or unfounded.

How about there is no conspiracy, everyone thought Finnegan and company were no good, but proof wasn't coming. Not sustained.

If the court section had done their jobs and deviated them for missing court, maybe it would have come to light. As it is, the case went forward under Kirby and Finnegan and company are behind bars.

Which way is it people? Facts speak, not opinions. You can't have it both ways. And anyone who thinks that for one second Kirby would undermine such an investigation or let things like that go are drinking the kool-aid.

Just like in that street fight, don't stop raining blows until the assailant is rendered impotent and thoroughly submissive, preferably because the assailant is unconscious.

Now is not the time for timidity or misplaced mercy.

These assailants on our pocketbooks and on common honesty and decency show us no mercy, thus, they deserve none themselves.

Their sweating needs to evolve into profuse bleeding before they will be rendered impotent.

But it is less clear what that means for the District's 32-year-old ban on handguns, perhaps the strictest gun control law in the nation. The case is likely to produce the most important firearms ruling in generations. A ruling is expected by summer.

Let's see - a specialized unit goes down for court cases that get nolle'd or sol'd; allegations involving drug dealers, bribery, etc. Does anyone here actually think that anyone besides patrol officers are gonna go down for this? Does "Marquette 10" still ring a bell with anyone? Sure; those guys did it all on their own. If you believe that, I've got some AZ swamp land to sell. Kirby is in a coverup up to her eyeballs and before anyone anoints Taliaferro to sainthood they should read one of his "investigations". What a tool!

Of course this would be like me walking into Obama's office and arresting him for receiving a
bribe(s) from Rezko. Rezko never met a man he didn't bribe. I know he did it, he knows he did it, all true democrats know he did it. But this is Chicago, we have to wait for a Republican U. S. Attorney to take action.

Someday, we can only dream. But in the meantime To all city workers, coppers, firemen, sanitation workers, office clerks etc. DO NOT STEAL ANYTHING... that is the job of our elected officials and their friends.

HEY SCC...Help me out here.
Got into a debate with my partner over DUI. Help us settle this debate. The question is... Can you still be charged with a DUI if you BAC is under a .05? According to IVC...if your BAC is betweeen .05-.08 there is a presumtion that you are not under the influence of alcohol. My partner says that if your BAC is under .05 that the subject has to be released w/o charging. I disagree. It is my understanding that as long as you can show that alcohol impaired someones driving, they still can be charged.
Who is right?

What stellar police work has she performed, and how many cases has she handled in court as an attorney? Public Servant?? Sure, she falls right in with the rest of the corruption in the city. The article states she was aware of SOS problems, no shit, she didn't do a thing about it, that's the problem.

Where was she before IAD? VICE. Any problems with that unit? What person did she get promoted to run her Confidential section and now got promoted to Command the 7th District?

Perhaps the Trib should look into her powerbase on the SW side of the city. Say what you want about who ran SOS...investigations are killed through IAD. KIRBY and ROWAN did exactly what they were told to do. Politicians do not care how we do our job as long as it makes them look good, when we make them look bad, they hang us out to dry. SOS got lots of heads and guns, and the Mayor of the city of Chicago got to stand in press conferences and preen. As soon as these boys got greedy, fucked up and drew attention to themselves...we are now living the results. Nothing will happen to KIRBY or ROWAN, they will continue getting fat off our tax dollars.

Has she ever convicted anyone in a court trial? Defended anyone in a criminal trial? I've been around all the branches during my time and don't recall Ever seeing her.

Lil Rich, how about your expertise in deciding the status of an attorney. I do recall you having to have taken the bar several times before you finally passedand once again I don't remember you in court either. Although you were appointed States Attorney.

How would you know a good attorney?

Also, if she were interviewed as you say and not chosen you must have seen an undesirable side that made her unfit to be Sup.

It's an old story. When they know too much (dirt) bring them into the fold to keep them in line.

How about making this escort duty a secondary employment detail. Time and a half for standing between these gangbangers. The salaries can be paid for by the enterprizes of Rev. J. I was a Houston cop before I came here to Chicago PD (HUGE mistake btw). Trust me, CPD is FUBAR. There are some great coppers here but the organization (leadership) is incompetent to the point of criminal negligence.

After seeing something like this, I think just about every good copper that works in IAD would beg to differ on Daley’s comments about what a “great police officer Kirby is”. Just about everyone there was happy to see her leave!

I worked Confidential Investigations for 6 years with Chris Taliaferro, before Kirby gave me the boot and I’ll be the first to say he’s a great guy. You’re good in Kirby’s eyes until you ask questions and ruffle feathers, like Chris and I did, then you get smacked down! Chris and I worked together on several cases and any time either one of us would dig something up that would strike a nerve with Kirby, she’d shut it down or say she’d look into it. You try doing the right thing, going after the “real” bad coppers, and you hit a political brick wall on anything that is “too hot”.

Daley was right about one thing, we did have solid information on the guys in SOS five and six years ago. The problem was all the guys we wanted to go after were all being protected by Tobias! Allegations would come in on Tobias’s former team members and he would screen them. Then he’d set his supervisors in motion to quash them. Kirby knew this when she got to IAD and did nothing about it!

The question of why these guys were out there for so long getting away with this stuff wasn’t because we didn’t have good intel on them, it was because Kirby chose NOT to take action on the intel we got! And in doing so, Tobias empowered and emboldened his little army of “rouge cops” until it got so out of hand and in your face in the media that Kirby couldn’t play that game any more.

It was evident to everyone at IAD when she got there that Kirby was all about herself. She wanted to make a name for herself right from the beginning and was more interested in padding her resume with statistics of officers she gave 30 pending to or fired vs. conducting legitimate investigations. Her opinion was that aggressive officers have measurable patterns of misconduct and can be identified through pattern profiling an officers CR history. It didn’t matter how good a copper was at police work, if she could put another notch in her belt, she was happy.

This new strategy was suppose to set a new precedence of how IAD investigations would be conducted, but as she started trumping up allegations and criminal charges on officers and losing cases in court, lawsuits started rolling in. I know of at least 3 federal lawsuits pending against her from police officers, which are going to cost the city’s tax payers millions! It’s amazing how quiet they kept all this.

Supt. Weis is going to be in for a big surprise when trials and litigation start on these cases and Kirby finds herself in a whirlwind trying to justify what she did to these officers.

TO: HEY SCC...Help me out here.
Got into a debate with my partner over DUI. Help us settle this debate. The question is... Can you still be charged with a DUI if you BAC is under a .05? According to IVC...if your BAC is betweeen .05-.08 there is a presumtion that you are not under the influence of alcohol. My partner says that if your BAC is under .05 that the subject has to be released w/o charging. I disagree. It is my understanding that as long as you can show that alcohol impaired someones driving, they still can be charged.
Who is right?

YOU are.....even if the bac is under the driver may still be charged with the 501(a)(2) DUI-ALCOHOL, as long as the officer can still articulate the impairment observed.....DUI Instructor

Why J-Fed put Kirby in as his attorney is beyond me. She is just as much on the hot plate as is everyone else who knew what was going on, but swept it under the rug. This is terrible for our department.

Kirby has always had an attitude problem but she is not the sole reason the IAD is viewed with such disdain.

In my lifetime we had Risley who investigated Superintendent Rodriguez because he felt was unqualified. He denied it but he was pissed that he was passed over for the position twice. In the end his investigations cost the City big money and he ruined his reputation, his integrity and his legacy.

We had Nate "the Skate" Gibson as the ADS of IAD. Gibson was a hater who acould not make a decision and trusted no one to make the decisions for him.

We had a total of seven heads of IAD in seven years prior to Kirby.

They were unable to set any priorities. Why because Hillard was stupid and Cline was at a minimum devious and who knows what else.

Nolan gave away any chance of legitimate promotions when he gave the city 30% merits when he was FOP president.From this last round of promotions,who was he to ask for recommendations? Their all merits!And they recommended all of their friends and fellow bosses.
I'm retiring this year but I hate to see this dept in the shape its in,at one time we were a class act,second to none.
I don't see that anymore,hopefully I'm wrong and J-fed can turn it around,but I doubt it. :-(

You have every right to your opinion, but I have to speak up for Nate. If he was a hater, he had every opportunitry to show it with my situation, and he did the exact opposite.

Straight-up, I am a M/2 street Supervisor that did not know Nate Gibson from Adam, nor did he know me. I never worked in IAD and I never worked for Nate anywhere in the Department.

As the head of IAD, Nate stood face-to-face in the way of a M/2 Deputy Superintendent trying to jam me for no good reason. Nate even refused his direct order. There were two extremely credible witnesses to the event. Both related to me how Nate took the heat for a white guy he didn't even know.

He was quite gracious and related that he was glad to have been in the right place at the right time, but he did wonder aloud how I knew, because he never told anybody.

I wish I could tell you more about the circumstances, but I do not want to relate everything here, but Nate was okay, at least he was to me, and he sure did not have to extend himself because I was in the out-crowd, not the in-crowd. Try and find a boss in our organization today, that would do what Nate did for me. Good luck.

Nate Gibson's reputation was not very good.
He was despised in Area 2 when he was the boss.
When he went to the IAD a large group of individuals either retired or transferred rather than work for him. It was probably Hillard's first big mistake in making him the ADS there but he was highly thought of by Cline who encouraged Hillard to place him in that assignment.

You can't, plain and simple. It screams clout and fraud and JFed now has the opportunity to put it to an end. Just promote off the list and figure out another "merit" system on the next test. Only 5% merit and then the names are pulled out randomly. The 5% merit has to be a combo of clout and no clout (i.e. just plain, hard-working street cop - no office fillers). That will at least give some no-clout guy/gal a chance.

How about all merits must have had at least 5 years street work, and X - amount of arrests. Their police paper work is retrievable, look at that and see how much police work they have done and review their proficiency'cause when they make merit sgt, dic or lt., they must go out on the street and supervise and actually have to know what they are doing.

Another suggestion: all merit must be declared so everyone knows. He/she MUST stay in patrol over 5 years. That's the trade-off. No merit moves to a special unit after doing their 6 month stint on the street. Maybe the merit clouts will study harder to get better placement on the test.

As far as the test goes, absolutely NO table-full of exempts get to "review" the test. This is another way "their" people know what to study. Are you listening Supt Weis?

In defense of Kirby and the IAD it must be pointed out that they do not investigate incidents were the "use of force" is present.

Abbate, "Jefferson Tap", and the Weems' shooting case all involved the "use of force" and should of been investigated by OPS. When the final investigation arrives at the Office of the Superintendent the final determination of the investigation is made by the Superintendent.

If Cline wanted to protect individuals that is the time it occurred.

The SOS investigation was the sole responsibility of Kirby and the IAD. It appears she failed to do her job and allowed the number of crimes to increase greatly.

If this is true then she will have liability when the civil suits go to trial. It will be interesting to review the depositions that will be taken as these suits progress.

The Chicago Police Department IAD Division requested felony charges for Finnegan and other SOS members reguarding a gun case from way back. The States Attorney's Office rejected those charges.

It's funny how all of these "cops" rub their hands and sneer when Kirby is being bashed in the papers with no evidence she did anything wrong.

Just like the ghetto thugs' response to a Police shooting. You "cops" join the bashing bandwagon perpetuating lies and rumors because you love getting back at the man.

To answer the DUI question, at 0.08 the presumption is that you are under the influence. 0.05 to 0.079 is a grey area. 0.04 it is presumed one is not under the influence.

It would seem if you had an 0.04 breath test, then the case has to be dismissed. An ASA told me long ago any presumption can be argued, even the presumption of 0.08.

Truth is, unless you're falling down and a total idiot, an 0.04 case will be tossed. In between results depends on the visual.

Best advice, never have more than two if you're driving, and if you get stiff, take a cab or call a friend. Better safe than a reckless homicide/agg. dui.

I was a Houston cop before I came here to Chicago PD (HUGE mistake btw). Trust me, CPD is FUBAR. There are some great coppers here but the organization (leadership) is incompetent to the point of criminal negligence.

You seem to think that everyone that works in IAD is out to get the working coppers. The truth is, the majority of the personnel that work in IAD are the exact opposite. Many of the cases I investigated were bullshit, but some warranted some sort of disciplinary action, there is no way around that. Everytime I brought an officer in on a complaint I gave him/her the benefit of the doubt. If they fucked up, they fucked up, and they would have to face disciplinary action. If my investigation found that the officers did nothing wrong, I made sure they were cleared. Blame Finnegan and company for the sorry state we're in, not Kirby, or the presonnel in IAD. Someone has to do the job. What if IPRA was investigating all police misconduct....then we would be in some real trouble.
