US Supreme Court

Well, on the bright side, it would appear that the fundamental Right to Bear Arms will be upheld:
  • Americans have a right to own guns, Supreme Court justices declared Tuesday in a historic and lively debate that could lead to the most significant interpretation of the Second Amendment since its ratification two centuries ago.
The scope of government regulation permitted will be the key component of the US Supreme Court decision (above link to FT.com - registration may be required):
  • The most difficult question for the court is: what kind of laws can governments pass to restrict the constitutional right to keep and bear a gun?

    Chief Justice John Roberts made clear that the DC law would not meet his test as a reasonable regulation of firearms ownership. “What is reasonable about a total ban on possession of handguns?” he asked. But several other justices defended the ban as a reasonable response to the crime problem in America’s capital city.

    Mr Heller’s lawyer said the court could find that Americans have an individual right to own guns but still allow governments to regulate some types of weapons, such as machine guns, and who can own them.

The talk among Gun Rights advocates is that they are willing to settle for a partial victory permitting households to own firearms because that will give them a lever to take down New York and Chicago total handgun bans. It would also derail various bills the Cook County board is attempting to pass and give ammunition to plenty to other Gun Rights groups to challenge ill conceived rules that only serve to disarm the law abiding.

It's a start.

First of all, nothing is etched in stone, because dicta from the court, while informative is not yet a ruling.

Notwithstanding that, if the court rules as it appears that it will and finds an individual right to keep and bear arms within the second amendment, then this will be more than a "start." This will be a watershed event in the history of our nation and put the socialist left on their asses. Make no mistake about this and don't be taken in by the minimal coverage that mainstream media gives this. This case will be the Brown v. Board of Education of gun rights is America, the greatest nation on Earth.

She can not be happy they used that picture. And you can tell by the dark circles and bags under her eyes that it is taking a toll on her. I haven't seen her in a few years but she couldn't of aged that much in that little of time.

So I saw the fax from the Office of the First Deputy stating that anytime a PO is SUSPECTED of being drunk on or off duty, a W/C is to be called to the scene and IAD is to be notified.

I can see of someone is doing some stupid shit and/or breaking the law in public.

What if I am tipsy at a bar and minding my own business?

What if I am drunk, at home?

Think I am going to open my door for some W/C?

I think not.

If this rule applies to us, I feel every city employee should follow suit. From CFD to Alderscum to old Daley himself.

Look at the statistics of states with concealed carry laws, low violent crime rates, low homicide rates, low burglary rates.

The predators among us won't be so brazen if they had a doubt whether the person they try and carjack will pull out a pistol and defend themselves.

I say let every non felon pack a piece, it will make our job easier in the long run.

About time the average person wins one at the Supreme Court.

some interesting facts from the in-service exempt training
No new Lt's until Sept., meaning no class until Nov.
New recruit class in April
No word on Sgt's or Det's, sorry.
Sgt's in the field will no longer handle CR's, they will be handled by administrative people.
Supt. is VERY adament about drinking off duty--ZERO tolerance is the word. I wonder if it will deter some new exempts from having promotional parties?

Legally speaking, if the Court finds that the right to bear arms is a fundamental individual right, then strict scrutiny applies. As such, any regulation will have to be necessary to achieve a compeling governmental interest, and will have to be the least restrictive means available to achieve that interest.

What this means is that the government will have a hard time keeping common handguns from law abiding individuals. That being said, I foresee limits for weapons such as assault weapons and sniper type rifles.

There is such a thing called Justice and the American way...as I was listening to some of the legal arguments on the radio to work today from bull shit artists trying to con the court into believing that only state militias were meant to bear arms and not really the people. What the fuck does a comma in the middle of the sentence mean? Yes! It means a separation of ideas. Yes! The State has the right to establish militias and the people have the individual right to bear arms. Does anybody remember King George of England?

Well we Got KING RICHARD here in Chicago, a retarded political inbred, who thinks he can fuck with all taxpayers along with all his mixed coalition of mindless minions. Well it ain't for me brothers and sisters. If I had to live in the neighborhoods I worked in without a gun, forget it. A gun saved my life and watch how guns will save many innocent lives. Whatever happened with the retiree that bought a new handgun to replace an inoperable handgun and was refused at gun registration and not allowed to register the new handgun? Anybody know?

In all the concealed carry states I know of, you have to qualify to get the permit. You have to pass a background check, fingerprints and take a law and safty course.

The ONLY people who will be affected by this ruling are LAW ABIDING citizens.

The thugs on the streets are ALREADY convicted felons, and therefore cannot legally possess a weapon.
If they are in possession of a weapon while committing their thug crimes, again, they are in violation of the law WHICH ALREADY EXISTS.

Frankly, I don't have a problem with ANYONE walking down the street with heat provided they are a law-abiding citizen. Why would you? Do you think the gun is going to jump out of their pocket and "go off", as the media loves to say?

For all gun owners..I recently purchased ammo at very reasonable price at one of the big box stores in plainfield on route 59.. I also stopped at menards, jewel and kohls while I was out there. On the ride back I even filled up the car at a cheaper price than the highest taxed county in the country. Up yours daley and toddler. No more buying in the city or county limits for me.

Dude,

Pookie already has a loaded gun, laws and gun bans never bothered him. Now he will have to thinks twice before trying to rob someone because they may have a gun. You can still do your pat down and since pookie has a conviction or he was doing something else illegal he cant have the gun so you lock him up and take it. Besides I would rather see pookie get smoked by a citizen with a gun then lock pookie up. I will be more then happy to do the case report.

Lets not deny the majority of this country their constitutional right to bear arms because of a small segment of society.

Hey anti -NRA guy, try reading the general order on street stops or the ILCS regarding UUW. It's been a while since I've read them but since apparently you never have I'll paraphrase for you. When you have reasonable suspicion that someone has, is or will commit a crime you can stop that person for questioning and pat him/her down for weapons (Terry v. Ohio?)If you find a weapon you may remove it temporarily from his person for your own protection. If your investigation reveals that no crime was committed and the weapon is not otherwise illegal the weapon will be returned to that person. If you wanna be the police, you can do your job better and not sound so idiotic if you would occasionally read the items on the reading guides for promotional exams. Who knows? Jfed may even make future promotional exams at least look legit and you might fall through the cracks. But seriously, at least a couple times a week, pick up a general order or an ILCS, spend a few minutes, read it through. It's amazing how many people with time on the job are so unfamiliar with what they really NEED to know.

Wow, typical liberal spin of the facts. Do you really think that Pookie, Mookie, & G-Rock would be able to legally carry a gun? You would still need to pass a background check, not be a convicted felon, and register the weapon. All of which the sh*theads would not do. Try to keep up with all of the big words we use Clarence and stop trying to cloud the facts. The majority of this country does not have the f**cked up gun ban like Chicago and it's doing fine. I'd bet my next check that if you weren't an armed police officer and lived on the Westside your mindset would be different. I have always thought that the original UUW statute in Illinois was pretty reasonable. It prohibited possession of machine guns, sawed off shotguns and sawed off rifles, as well as knives and similar weapons if they were intended to be used unlawfully. It prohobited concealed firearms on the public way. It did not have a blanked prohibition for cities and villages, and the rest that has been added over the years. Violation of all sections was a misdemeanor. If a provision for legal concealed carry was added, I would think that it would meet the tests of fairness.

Does anyone else see the possibility of the 'supremes' ruling that this Constitutional Right can be 'reasonably restricted' via mandatory registration?

And that the precedent being set might turn out to be the imposition of 'reasonable restrictions' being imposed upon all of our other Constitutional Rights, with the same rational of 'protecting the citizens' from those who pose a 'threat'?

With those in government being the defining authority of who poses a 'threat' and who doesn't?

With Registration being granted or denied based on the assessment, by the government, of whether you pose a 'threat' to the nation or not.

Thus, Freedoms mutate into Privileges, said privileges granted at the discretion of those wielding government authority.

ANYTHING that requires registering with the government cannot be, by definition, a Right.

Even the Right To Vote is restricted by the registration requirement.

Registration requires Identification, which provides the means of inventorying every person who submits to registration.

Registration also provides the means to deny registration, thus denying the very Rights said registration is presented as being the means to uphold.

"they change..." Supreme Court appointments are for life. Unless a Justice dies,retires,or is impeached they cannot be removed. Only if the number of Justices is increased can the court be altered very quickly.

1. If you're patting people down without reasonable suspicion that they've done something wrong, then you're in the wrong and I don't mind that you lose that power.

2. If you're doing an "officer safety" search, then what does it matter whether the gun is legally carried or not? Legal carry won't automatically affect that. Danger is danger and armed is armed.

3. The case at hand is not going to legalize concealed carry. It might be a step toward that, but it's not going to happen as a direct result of any decision in this case.

4. UUW isn't a city ordinance, so it won't change if the city's ordinance goes dead.

Legally speaking, if the Court finds that the right to bear arms is a fundamental individual right, then strict scrutiny applies. As such, any regulation will have to be necessary to achieve a compeling governmental interest, and will have to be the least restrictive means available to achieve that interest.

What this means is that the government will have a hard time keeping common handguns from law abiding individuals. That being said, I foresee limits for weapons such as assault weapons and sniper type rifles.

Of the first eight Amendments, the second (guns), third (quarter soldiers), seventh (right to jury in civil cases), and eighth (prohibition on excessive bail) have NOT been incorported onto the states. They only apply to the FEDERAL GOVERNMENT.

The Washington DC ban is a FEDERAL BAN on handguns.

Even if the court found the DC ban was too restrictive (which is likely), the decision would not apply to the States. The Court will not decide if the States (which includes cities, counties, etc...) can institute a handgun ban until a State ban is being reviewed.

It could be another 40 years until a State handgun ban is even before the Court.

I'm the retiree that was denied registering a new weapon after the old one failed. We lost at the Admin. Hearing(as expected). It's been appealed to Circuit Court(odds aren't good there either). First time up was mid February and it was transferred out of Chancery to another Division. It should be coming up again soon. If we lose(as expected), next stop Appellate Court. As it stands now, you can never register anything new or used after you retire. I'll post a final disposition when I get one.

Legally speaking, how can you predict that a ban on "assault weapons" or sniper rifles would past strict scrutiny when they account for a fraction of gun crime.

The last full years data from the FBI (2006- see URL below) shows that in our fair state only 4 of the 392 firearm murders were commited with rifles of any kind. If a ban on handguns , which account for 380 of these murders fails, why would a ban on any kind of long arm be sustained? Legally speaking.

As usual, the CPD looked like a bunch of headless chickens doing whatever felt right at the moment. The ONLY professional looking crew there were the guys and gals of the Illinois State Police. They were dressed sharp head to toe riot gear (oh yeah, our riot gear? 2 miles away in the trunks of our cars) with the look of a proud, focused law enforcement officer. I by no means am faulting the average everyday blue shirt as Im sure I looked as unprofessional and goofy as the next guy... But come on! Atleast could we all wear the same damn uniform for such a public appearance? I think in typical CPD fashion there were atleast 3 orders sent out then rescinded then sent out then rescinded etc etc I see everyone is STILL afraid to make a decision.. in the end, wear what you please! So while Jody is busy seeing to it as many POs are fired as possible to please the west side revs, the REAL image that REAL people have of us continues to be that of a pack of clowns at the Barnum and Bailey circus! You could see "orders" being given via sharp whistle followed by angry hand gestures. All this technology, all these black berries, the broken down ambulance spray painted black, "air 1" and when it came time, we resorted to hand signals. Anyways, just thought you all should know that when it comes to a quasi major event, we still fall just a tad shy of a joke department... Just imagine if something real went down... 3 words CHICAGO IS FUCKED!

They also noted that crime in DC and crimes against person were up consideratly since the guns laws were put in place. 4:24 is right. It will likely be years before a state handgun ban is before the Court and even if the Court decides that the 2nd Amendment applys to the states, the states may still have significant power to regulate gun ownership.

Thank you for the update. Good luck to you. It is a sad fact that retirees residing in Chicago will never be able to register their replacement handguns.

A few mentiond going to Indiana. Well, think about the fact that Indiana taxes your pension, as does Wisconsin. If you desire to stay close to Chicago, go to southwest Michigan or stay in Illinois, as neither state will tax your pension.

The answer is, leave Chicago and Cook County, but stay in Illinois or somewhere else of your liking that does not tax your pension. If you do not realize it now, you will when you retire, but any avoidable tax on your pension can really hurt.

Today Barack Obama complained about gas being $3.40 a gallon in Philadelphia. That's cheap compared to purchasing it here in Moscow by Lake Michigan. He says a McCain victory would be akin to a three term Bush Presidency.

Five years later and I don't believe we've been importing any oil from Baghdad yet. It's been over 8 years now since drilling in ANWR in northern Alaska was voted down. No drilling because Robert Redford’s Sierra Club is afraid some caribou won't be horny enough to reproduce.

Probably too late for this post, but for all of you who think you know it all, HELLER vs. DISTRICT OF COLUMBIA is essentially the outright ban of handguns IN THE HOME and of the requirement of keeping guns locked up or dis-assembled.

Read the briefs offered by many, to include some attorney generals from some great states who know a thing or two about what the founding fathers had in mind when they wrote the constitution.

Oh, by the way, we all took an oath to support and defend that same constitution.

Let's honor it, and remember all those, both blue and military members who chose to support and defend it. Some giving the ultimate sacrafice.

Hey anti -NRA guy, try reading the general order on street stops or the ILCS regarding UUW. It's been a while since I've read them but since apparently you never have I'll paraphrase for you. When you have reasonable suspicion that someone has, is or will commit a crime you can stop that person for questioning and pat him/her down for weapons (Terry v. Ohio?)

IF you have reason to believe that he may attack you, then you may "pat down." You have to be able to articulate the reasons both for the stop, and if frisked why you were in fear of an attack.
