Heller Today

Since we don't know when Blogger will get around to release the blog from blog-purgatory, we can't definitively say if we'll have an open post for the DC v Heller decision. If we do get publishing, this is the post. If not, this will appear a day or two late and who knows what will have happened in the meantime.

Run with it people.

UPDATE: US Supreme Court strikes down D.C. gun ban. Entire decision can be found here, now. The opinion stresses that the decision won't change "longstanding bans on gun possession by felons or the mentally retarded, or laws barring guns from schools or government buildings, or laws putting conditions on gun sales." (quoting from The Ace of Spades)

Supreme Court strikes down gun ban

Chicago's handgun ban has lasted for more than a quarter-century, but it's under threat after the Supreme Court on Thursday decided that Washington D.C.'s law against handgun ownership is unconstitutional.

In a 5-4 decision, the high court determined that Americans have the right to own guns for self-defense as well as hunting.

The SCOTUS decision in D.C. v. Heller merely upholds the validity of the Second Amendment.

People please don't be mad at us,we really try and protect you and we do respond to your calls as fast as we can. There are only 7,000 policeman in Chicago now,there are supposed to be 13,500 but the Mayor won't hire anymore because he is spending all the money on the 2016 Olympic bid.

Are hands are tied now due to the actions of a few bad apples that have tarnished our image,the wild lititgation that the city pays out on,even when they know it is complete BS and they keep suspending and firing innocent officers that are hard honest working policemen on trumped up charges.

Morale is at an all time low on the Chicago Police Department and everytime we confront an armed offender trying to kill us and win we are tarred and feathered in the media.

If they gave us a decent contract and stopped indiscriminately firing officers for political expediency,quit playing the clout game with unit assignments and promotions and hired a few thousand more officers things would be much better for the citizens of Chicago. The way it is going now it is only going to get worse. I do my job but that is all,I can not take a chance of being sued,stripped,suspended,fired or criminally prosecuted for doing my job or being too aggressive. I have a family to feed and need my job,I know this sounds horrible but it is the truth. The days of the hardcore Chicago Police are over,the criminals are running the streets now,this is the truth,ask an officer how bad things are on the CPD.

I am happy that the Supreme Court upheld the 2nd Amendment,I believe that citizens have the right to defend themselves and their property and I know that the police can not be everywhere.

Please support the Chicago Police,defend us against media abuse and demand that the Mayor give us a fair contract,stop arbitarily firing us for doing our jobs and the he hires several thousand more of us to replenish the ranks.

I'm not crazy about the idea of restarting the registry for handguns, but half a loaf of bread is better than none. The better solution is to say "FOID card = no need to register with any city or county office." I think it'll get abused by the pols, even if it does get re-opened to us plebians. There's going to be plenty of chances to use this against a neighbor you might not like if you've got pull with City Hall. Hopefully the beat cops can think of it less as potential threats and more as "honest enough/ might even back us up."

I could be wrong on the last part, though. There's still going to be mopes on both sides of the badge with an axe to grind, they'll just have to grind it under threat of proportional retaliation. Work for the best effect, prepare for the worst, I guess.

i'm guessing...ownership of handguns/rifles/shotguns now legal in Chicago (city going to fight ruling, may take a couple of years for an expedited court of appeals ruling,with the city as the loser)....uuw laws still apply in Illinois (no carry/concealed for citizens here, like in Indiana, etc.)

What exactly did you win? The Supreme Court decided a whole lot more than the DC ban, they just pretend they did not.

It is going to be interesting to watch all Illinois weapons laws attacked now - even more fun because most of the UUW/Agg UUW statute is arguably out under Scalia's ruling.

The most interesting part of the decision is what they didn't decide - what gun laws ARE valid?

I'm neither an NRA member, nor an antigun nut - but this is NOT a good decision, could've been - but wasn't.

This should be the end to gun registration. The city can not force law abiding citizens to pay money for something that is a Constitutional right.That would be like charging you to vote. How can the city force a law abiding gun owning American citizen to register a legally owned firearm? For that matter it is now illegal for the State to charge money for an FOID card. By this ruling a law abiding citizen does not have to pay an illegal fee to any state or city to own what is legal under the U S Constitution. Sooo my fellow Chicagoans how many millions of our tax dollars will the idiot goof Daley waste fighting what can't be won??? For the petite chick : Find a nice old Colt Cobra .38 revolver, first issue with the skinny barrel...its the lightwieght version of the Detective special. Try gunbroker.com ...these old, no longer made Colts hold 6 instead of 5 like the S&Ws, and you can control them quite well with +P hollowpoints. These would make an excellent "off duty" for the P.O. as well.

A 5 to 4 decision is scary. Think about this, those 4 that voted to uphold the DC ban were voting to deny your 2nd amendment rights. Wrong. UUW laws will continue to be good law. This ruling does not open the door to concealed carry, this ruling allows gun owners to own guns and register them. This case was not about the right to carry, but the right to own. UUW does not apply to a gun in a person's home, but the registration prohibition does. This ruling merely allows owners to register their weapons legally and keep them legally in their residence.

25,001 valid, verified registered City of Chicago residents, PLUS another 25,000, minimum, to overcome the bullshit challenges, PLUS a sharp attorney, just to get your name on the ballot, either in the next Democratic Primary or the General Election.

Colt had a reissue of the classic DS, with the transfer bar mod, about 10+ years ago, with Colt logo rubber grips. Sweet little snubbie, with enough heft to soften recoil on +P loads.
