No Civil Rights?

This certainly sounds like a winner of a case:
  • SCC, Please post this for all to see…
    During the 1st Watch on 25 MAY, an off duty P.O. from the 008th District was involved in a traffic accident in which a child ran out in front of his vehicle. Luckily, the off duty officer reacted in time and only knocked the child to the ground resulting in minor scrapes. As the off duty officer exited his vehicle to check on the child, several family members ran out from their backyard party and approached the off duty officer in a threatening manner, causing him to identify himself as a police officer before locking himself in his vehicle until 008th District officers arrived. After more than an hour later, one of the family members of the child made an allegation at the hospital that the officer must be drunk, resulting in the off duty officer being ordered into 008 to submit to an administrative blow, as the newly revised order reads. An IAD supervisor arrived in 008 and advised the W/C that field sobriety tests must be performed as well as the complete warning to motorist DUI packet. After the off duty officer called FOP, IAD changed their mind and wanted only an administrative blow. The acting street deputy, Cmdr. Carter, made several calls on his blackberry before finally overriding IAD and ordering an ET to administer FST’s to the off duty officer, now more than five hours after the traffic crash. The off duty officer passed the FST’s without problem but then was led directly into the processing room and ordered to blow. The off duty officer complied and blew a .000 on the breathalyzer machine.
First up, the relative that made the allegation should be sued. An allegation like that in front of witnesses is actionable and has been won in civil court many many times.

Then an investigation of the Acting Street Deputy's actions ought to be initiated.

You have rights as a citizen boys and girls. Get an FOP lawyer and a Field Rep to walk you through the process. This sounds hinky and needs to be investigated. We imagine the officer has a decent chance of owning the Commander's house. We hope it's a nice house.

They confused due process under the 5th amendment to the US constitution with their bonehead internal policy. Big mistake. Due process has been denied you during your arrest (even though you were not charged you were arrested.) Absent probable cause, ie your successful passing of a much delayed sfst performed off-scene, the blow was an illegal seizure. Given all of these elements, you have a well documented case of unlawful restraint. Let me know, I'll go to your early retirement party and you can buy me a beer. -PNDA

off topic, but manpower related, why doesnt the super get rid of the 008 district 806 team.. yes, another made up team. they took 8 guys off the watch to work on this special team.. from what i heard, the tac lt in 008 is working hard to get rid of these guys and doesnt like them. kup and the lt were overheard saying that they will be sent back to the watch and a new 8 guys will replace them.... this doesnt help the watch at all.. we get these guys back..who in my opinion are all great guys and fantastic coppers but take 8 more off the watch.. smoke and mirrors.. just a numbers team that screws the rest of the watch.. but im sure when these 8 guys get dumped back to the watch the fat as@ sgt they have will stay... after all, it was his idea to dump these guys and bring in his own little 011th district dollies who just got sent to 008.. what a joke this place is.. nothing but back stabbing, politics, and whos your chinaman!!

SCC: You're not kidding about the lawsuit. The "Warning to Motorist" is completed after the arrest! Was this officer charged? Nope.
Was a street deputy wrong? Yep.

After talking to my fellow journalists, we have incompetent supervisors too. All you have to do is open a newspaper or turn on the TV; the proofs in front of you. The nonsense that's allowed to pass for journalism is disgusting. We have producers who shouldn't be allowed to work in media. We have editors that deserve public floggings for allowing shit to be printed in our newspapers. In fact, they shouldn't be allowed to carry a pencil due to fact they might write some crap.

What the heck is wrong with the police department? Mc Nulty and Mc Cotter were sharp, but from what I understand, they're retired or retiring. Where are the true leaders of the police department?

Any young kid that's thinking about a career on the Chicago Police Department should read this blog for a month straight. It's guarenteed you'll seek another line of work. If I was young man, I'd think about becoming a master criminal; the morale depleted police department isn't going to want to catch you.

JFED's comment on P.O. Boling's arrest.

At this preliminary stage of the investigation, there is no evidence or information that makes me believe that the officer in question received preferential treatment.

As you had your "team" conduct the same thorough and "impartial" investigation into one of your high ranking team members involvement into having cocaine and illegal firearms recovered in a condo that she owns. The investigation was over within hours after JFED had it swept under the carpet. That was the fastest investigation ever conducted by the CPD. Why wasn't this preferential treatment exposed by the media? DALEY controls most of them with the exception of a few.
Come on KASS - why don't you dig into this a little. Was her condo subject to seizure and forfeiture like any other Joe citizen who lost or had to "fight" to keep their property after narcotics and illegal weapons were recovered in their house or condo?

I had an outrageous accusation years ago after a positive warrant when the owner of the home told my sgt. I had been drinking. I was brought into the closest district and made to blow by the then W/C. Fortunately I had not been drinking. I remember at the time, the terror of realizing that anyone, even some felonious scumbag, could accuse me of anything and I would then have to PROVE my innocence. Keep writing those tickets and making all those great pinches kids, because when u retire and income goes down, your health insurance, prescriptions,etc,go up so high that you'll have to pick and choose what prescriptions you can afford each month and get your health checked at yearly FOP expos for retirees. No one gives a shit except another blueshirt. Your best and only friend. Stick together, it's your only hope.

The Chicago Police Department can do what they want, and when you contact FOP and tell them you wish to have representation against them,for what they'd done to you, FOP declinesl; Indicating if you're the complainant they have no support to offer.

Hey Carter...I know it's been a while since you have seen police work, but do you remember the term probable cause? How about "Reasonable suspicion?" No? I didn't think so. Better call the C.C.'s office and ask them to settle right away.
I don't care what the allegation is, ordering a blow, that is NOT administrative, is illegal without at least reasonable suspicion. Doesn't look, act, or smell intoxicated...Guess what buttercup...No CRIMINAL blow.

It appears that it's open season on us nowadays. We're being given no benefit of the doubt whatsoever. This seems to start with the public and media and extends all the way to shortshanks and JFed. The media is all but trying and convicting cops as soon as one of these story breaks.

Hate to say it boys and girls but the department can order you to blow administrativly. If you fail to do so they will get an insuborination beef on you and look to fire your ass. If you do blow the courts have ruled that the results can be used in a DUI case againt you if you blow above the legal limit. This even if you have already completed the criminal investigation of the dui. The department, ghetto citizens, politicians and courts all will throw you far under the bus. At least Dugan has our backs.

Here you have an armed off-duty police officer realizing the serious of the situation and the threats to do bodily harm to him by staying at the scene.

Realize how the average citizen in a similar situation would want to flee for his life and be justified in doing so, except that the driver would be arrested for leaving the scene.

Nobody has ever talked about this little debacle. Why did they take the Street Deputy away? Instead of 5 men/women controlling the street, now it's a toss up. They have parcelled the responsibility out to all of the Commanders. I don't know about you, but I think some of these Commanders aren't qualified for a District, much less the final say on a street incident after hours.

I have already seen some bonehead moves. There is a learning curve for any job. There were two good Deputies, McNulty and Lopez. The other 3 were at least somewhat competant. They grew into the job and the situation was way better than now. The mistakes will be plenty with the novices and will cost the City big bucks when mistakes are made. Penny wise and pound foolish.

We don't know all of the facts, so it would be difficult to comment intelligently about the situation. On face value, however, it seems as if the officer was grievously wronged. If there are no signs of intoxication, how are tests forcibly administered? Will tests be administered on all parties involved in crashes if one of the parities is a peace officer?

It would be interesting to see how often the civilian party is, in fact, intoxicated. Are citations issued if a civilian violates the rules of the road and causes an on or off duty peace officer to swerve to avoid?

The law works both ways. We should be going out of pocket, if need be, to bring suit against those who attempt to bring question to our reputations and thereby jeopardize our careers. The city is gutless on this issue, so we need to step up and make it happen. Benefits for legal fees should be popping up for situations like this.

By ordering him to submit to those tests as part of the criminal investigation he has violated the officer's civil rights. Also that officer can make a strong case for a false arrest. We need to set a precedent!!! Our rights are not to be compromised just because we are members of the CPD.

Or even better, at the civil suit I would love to hear the one who made the allegation say,"Whatchu mean you can't lie on the police?" This officer can sue and can win. Here's how.

The Illinois Courts have held that DUI tests are not Fourth Amendment "searches" or Fifth Amendment "statements," therefore the test is admissible in court even if there was no probable cause to request the test in the first place.

But, you do need probable cause to arrest somebody. And somebody is arrested when they are not free to leave.

This is an absolute clear case of false arrest. The idea that police can "hold" somebody for an investigation is total bullshit. Police can only arrest people and they can only do so if there is probable cause.

Here, there was no probable cause to arrest the officer because he didn't have "odor of alcohol" or "bloodshot eyes" or any of those other bullshit excuses that DUI probable cause is often based on.

Please sue, officer. You will be doing us all a favor.

--Administrative blow is different than an DUI blow.



It states the PO was read the warning to motorist.
If you are read the warning to motorist, there must be probable cause to show you were under the influence and you are placed under arrest PRIOR to reading the warnings.

Same thing happened to an off duty cop in 24 who was drinking at a bar. Gangbanger came in and beat him up. Lt. Schlos forced him to blow. He was the victim. This cop should also sue her.

The phone calls have been made and they have been saved. The districts have already created phoney spots and cars in order to keep the chosen few inside. Some of the best spots I heard of were a quality of life car, and a new building security position. Im sure there are some even better ones out there so lets hear them.

I personally know of three seperate cases, where members of the CPD sucessfully sued and won. Needless to say the 4 officers in the three seperate cases were left with grins on their faces that you couldn't chisel off. 3 are no longer on the job and one was made Sgt in a none descript unit, bury so deep, you have to have a GPS to find him. "GO FOR IT:!

Buckle your seatbelts, law enforcement officers are in for the roller coaster ride of their life.

We has a US President that failed to show up for the police memorial service in Washington D.C. but was able to meet with professional basketball players in the White House that night. The previous president not only showed up, he gave speeches and prayers and stayed with the officers for hours talking with them.

This same president is also cutting by 50% the federal funding for law enforcement officers killed in the line of duty. So expect benefits to the family members of officers killed in the line of duty to be substantially reduced in the near future.

Police officers have become Public Enemy Number One. We are targeted by the news media to stir the public up. We have a Mayor who believes that we don't even deserve a cost of living raise.

It's going to be rough sailing waters... be careful.

off topic, but manpower related, why doesnt the super get rid of the 008 district 806 team.. yes, another made up team. they took 8 guys off the watch to work on this special team.. from what i heard, the tac lt in 008 is working hard to get rid of these guys and doesnt like them. kup and the lt were overheard saying that they will be sent back to the watch and a new 8 guys will replace them.... this doesnt help the watch at all.. we get these guys back..who in my opinion are all great guys and fantastic coppers but take 8 more off the watch.. smoke and mirrors.. just a numbers team that screws the rest of the watch.. but im sure when these 8 guys get dumped back to the watch the fat as@ sgt they have will stay... after all, it was his idea to dump these guys and bring in his own little 011th district dollies who just got sent to 008.. what a joke this place is.. nothing but back stabbing, politics, and whos your chinaman!!

I thought that as well so I tried to look up the AO for it and I could only find AO5-08 Which only applies to members of the department that hold CDL and were operating CMV. However according to the AO it only applies when the individual is performing a safety-sensitive function at the time of the incident and the individual was issued a traffic citation. So I am assuming that was not the case.

Can anyone clarify this? I thought there was some roll-call training about administrative blows, but I don't see any order on it. Regardless, what was done doesn't seem right, and hopefully someone can point out the order if there is one so we can all be aware of it.

This was not an administrative blow this was an arrest and the SFTS is only to be given after arrest based upon probable cause. Officer you have an easy win. Let's see false arrest in Federal court, this should start at about 10M asking and the Corp Counsel will be begging you to settle for 20% of 2M.

Carter is a triple merit guy who has no business being anything other than a janitor. He really screwed up this time and this is going to cost the city millions.
You just can't dedtain/arrest anyone for all that time and then let them go after ytour unlawful tests showed nothing.

This won't even go to trial, they will settle after the deposition. Oh and get those calls from his blackberry and watch what happens then, more depositions and more money to you Officer. Enjoy your early retirement with your huge nestegg.

My partner went out there and did our jobs, and we got along fine. Clearly, some of the dogs out there have issues with bosses that hold them accountable; no problem.
Why don't you take it up with the man personally, rather than run a personal tirade against him here for public viewing?

I'm willing to bet that Carter's running the officer through the FSTs and the blow (.00) will protect the city and the ODPO in the coming civil suit which will allege the officer of all sorts of bullshit.

Must be under arrest then warning to motorist rights are given. They need probable cause to make the initial arrest. Smell of alcoholic beverage alone is not probable cause. They need signs of impairment. Even failing SFST alone is not probable cause. There is a very specific procedure to follow and IAD does not not the sufficient knowledge. Even ASA do not understand the process.

I've been on this job for a while now working mainly in south districts. I've seen many good and bad exempts. However, once Carter came to 004 the moves he made and the leadership errors he has done speaks volume for his character. This action is no different. Doesn't the SENIOR officer present have to notify DCFS since the family was having a party and the children were allowed to run loose and endanger themselves due to the lack of parental supervision?
Also, in this case, did the senior officer present take the father and mother into the station for DCFS and also acertain iof they had been drinking or using other substances? If not, did the boss disobey State Law, and did he also hamper a state investigation and destroy evidence?

Cop was victim of a battery. He was taken into custody and held at the station. He was denied medical treatment for several hours from the battery. That is a violation of civil rights, Goof, and worth a suit.

The thing most pepl don't know about this incident is that the on duty LT, acting WC, told him it was illegal to make him criminally bow. Carter was aware. He was told, we can make him administratively bow...no problem, but he is not drunk and there is no evidence of it so we can not make him criminally blow. After 30 minutes making phone calls because he is a mush, he said, No make him criminally blow. Then tried to get a car from the person's district to adminster it. Fucking intelligent you idiot.

So for all of those, "You have to administratively blow" people, we know. But if you know te law and our orders, they are distinctly different. To give someone PFST, you must have reasonable suspicion that you will have to articulate in court. This case, NONE. SOme idiot two hours later saying "that guy was drunk" once the SGT was doing the witness statement, is not reasonable.
2. To give someone the warnings to motorist, YOU MUST BE UNDER ARREST. What does that mean? The officer's must have had probable cause to arrestthis individual for DUI in order to even give those warnings, much less the actual test for dui. Officer, enjoy the freedom of never having to work another side job unless your wife takes three quarters...I think half is still going to be good enough for this one!!!!

I don't care for Carter but I do want you all to know your what is right and how to protect yourself. Since it was an allegation, we have been all over the news daily for accidents where the officers were DUI, wouldn't it make sense to remove all doubt so this officer would not be drug through the mud by the family and the media stating we covered this up. Carter was doing his job as Street Deputy and I commend him.

He must have one hell of a house for everyone to comment on suing him and taking his house. Of all the things I have seen done over my 32 years, this is not worth the law suit, but go ahead; I have seen things happen for less.

That was not the issue. Th eissue was him disregarding civil rights by making it acriminal matter, before it was administrative. It was never criminal and the administrative portion of the investigtaion would have cleared the officer for any lawsuits....

It seems to me this should have been handled the same way it would have been handled if the guy was not a cop.

Does a driver in an accident have to do the blow if someone just says he is drunk? I kind of doubt it.

OTOH, the guy identified himself as a cop, meaning there is some justification for suggesting it be handled similar to an on duty situation.

This is a really simple story. Here are the facts.

We, just like the citizens we police, do have rights. If we want a right to counsel we are entitled to it. If our counsel suggests we blow and do it thats one thing, to be made to blow thats another thing.

As for saving the city money/image. The citizens and media already have us pegged for what they think we are. One story either good or bad isn't really going to change it. Some think we are always bad and some think we are always good and both are wrong. You don't save the city money and the po's image when he turns around and sues you.

Carter hasn't proven himself as a leader. Because he leaves you alone doesn't mean he is a great boss. Its his history and actions that you have to judge him on. I'm sure some people like him just as I'm sure people hate him. But when you look at how he got where he got and what he did along the way you see he is a typical merit promotion hack who should be sued for violating someones rights.

Now he and others will try to downplay this incident buy saying all this saving money and image crap but simple fact he screwed up. Own up to it like a man, face the consequences, and move on. Thats what a leader does.

I work in 004. Let's set the record straight. Carter brought in EP as his secretary with 3 yrs on the job, after 3 weeks on this job she screwed up everything. Carter wouldn't get rid of her, he still keeps her straight days and weekends off, by the way she only worked a beat car for 4 periods in her entire career. The goof Carter now had to go out and get another secretary. Also how about the lapa member with 4 years on the job also in the front office with straight days and weekends off. Activity in 004 is down 90 percent since this jerk got here. Carter is stupid and doesn't know anything about this job. He illegally held and ordered unwarranted tests on this Officer. THIS IS CALLED FALSE ARREST. Sue him, take a million or 2 and forget about this job.

Department ignores DUI training. The traffic division is a complete joke. The traffic LTS are ignorant of DUI and it is not a priority to them. The department had IAD sgts trained to operate breath machine but not the DUI process. When called to the scene, IAD can only demand a administrative blow. Who can they call if street bosses need advice? Even ASA's are ignorant of the steps to develop a DUI case. DUI is not a priority unless a P.O. is involved.

You can bitch all you want. I am ashamed of being a Police Officer these days. Every little thing that is done by anyone is disected through the department and media. As a 30 plus year veteran and a lawyer(I don't care,so what), I can put a spin on anything and make it stick. Beleive me I have, but this is BS. No matter how much you hate him, he was right. I really don't mind debating back and forth with you but fact is fact. If he does sue him, after it is all said and done because this Commander did his job, the officer will be eligible for him to turn around and sue in return. From looking at his house, I think he can hang in there for the long hall, so be careful what you open yourself up for and ask for, especially when he has the general orders, department policy and the law behind him. It really doesn't matter if we like him or not, fact is fact.

I have found over my 3 decades as a cop, looking back and listening to stories of when my father and grandfather were cops, the bosses people hate the most more often than not, were the best because they did their job and made sure you did yours. They also knew what to do when the shit really did hit the fan. I also know their is more to this story than is being posted, but hey, I like reading this shit so keep it going.

You my friend are a very angry person and need help. I work here also and that is a lie. Why so angry? The last Commander was actually the worst Commander we have had and I have spent my whole career here. Who he has as a secretary does not make him. The old bitter women that have been running this district for years need to go and you know it IF your really work here. If arrests are down it is not because of him. I can't find time to arrest anyone from running from call to call. I actually like it here and like what he has been doing. What are you so pissed about? He has been a stand up guy and a stand up boss. Don't take your anger and make something big out of it. Also, that P.O. is not getting shit. Before you spout out, get the real story first! Finally a boss with some balls. Don't you think he knew we would shit on him? He still did what he thought was right and in the long run, it will help the officer involved.

Lets see how big of a guy you are then Mr. Anonymous. Also, he was not promoted merit to either one of his positions. Why don't you call FOP and ask them yourself. They have the names of all merit promotees from day one and everyone knows someone there. I am not here to take up for him. He is the type of man that can very well take care of himself. Crawl from under your rock and tell him to his face.

004 is really no different than it is city wide. We are severely understaffed and our leadership is nonexistent. Yes that means EC and who would be afraid to tell that to his face? What is he going to do sit on me?

Unfortunately, throughout the history of the department it seems like we can only temporarily solve the staffing issue from time to time. The management issue gets clouded by politics.

Since I don't have a sign in screen name and this computer is at my part time job, I didn't think to just leave my name. Michael Smith I wish SCC would require everyone to leave their name. Like I said, he is not a friend but the few times I have been in his space he has made it clear that he is who he is, he is the real police and he does not give a fuck what me you or anyone else thinks about it. As you recall, me and my partner got into some shit and he was the one that guided us through documenting our actions correctly and doing what we should have to cover our own as becuase the department or FOP sure the fuck wasn't!

Yes idiot and if you recall he was a Sergeant in 007 and a Lieutenant in 003. That is where the 2 came from. Can you count dumb fuck! Everyone knows every Exempt is promoted on Merit, EVERYONE! After enduring all this shit and working at least 14 hours everyday, I bet he wished he had thoght twice before taking on the BS. I work in 004 so I see him every fucking day that I am sentenced here. I don't care how much we hate the bosses, they are fed shit everyday then held accountable for shit they can't control or begin to impact. Tell the fucking truth. Savages are savages and I don't care if we are standing right there,they are going to shoot each other. Since only a few of the 13000 work here, I am running from job to job trying to make sure I at least get a fucking lunch. Mike Masters, come lock some folks up out here hell, we don't have time to make an arrest, but we see you do!
