Two Years Probation

Abbate sentenced. And if we recall correctly, receives the exact same sentence that Cozzi got prior to his being jackpotted by J-Fed:
  • A Chicago police officer was sentenced to two years probation today for pummeling a woman who was tending bar.

    Anthony Abbate -- who declined to say anything to the judge before he was sentenced -- could have gotten up to five years for beating Karolina Obrycka in February of 2007. The attack was captured by the bar's security camera and the video was shown around the world.

    Judge John Fleming said he decided against jail time, explaining he did not believe the crime was serious enough and that throwing Abbate in prison would not be a deterrent to others.

And any civilians or media types looking to start shit, just about every single reader here deplored Abbate's actions and called for his firing. We also uncovered numerous instances where Abbate should have been fired before or never even hired. Off Topic but will be read here-

Spoke to a Dept of Revenue agent today(van driver). He related to me that there is talk about DOR agents driving thru Station lots looking for Vehicle Violations.

The agent told me that the rank and file agents are resisting this that they feel if the shit hits the fan the CPD will rescue them.

This agent was familiar with the CPD since a family member recently retired from 003 after 30 yrs. He also added that the inspectors are going to be going back to the districts since we are short.

Seems plausible-

Its a bit ironic how people are calling for the judge in the Abbate case to be taken off the stand. However, these same people will express no outrage when a gangbanger with a gun is only given probation by a judge.
Also, they want to talk about penalties not being stiff enough, lets take a look at the NFL scumbag Dante Stallworth. He only got 30 days for a killing a person while DUI.

Amen. Any one bad cop makes 100 good cops look bad. Attacking the clout/political system that lets guys like this get on the job and then act like they are above the law is more complicated than most media can handle, but it would also involve a change in Chicago neighborhood culture. There are a lot of . . . enablers out there.

I wish Fleming had given him jail time, even just a day, to make a point and shut up the folks who will now pile on.

Think of all of the domestics that we/me have been to where some guy beat his girl so bad and the ASA's would not approve felony charges. Would a civilian drunk have gotten a jail sentence?

Abbate is a turd. Flush him outta the department and let's deal with the other issues we have. Also it would be nice to enforce the rules on hiring so a drunk with a recent DUI isn't hired again like turd-boy was.

I can recommend a new career for Anthony though.

Perhaps WLUP can do some nostalgia based commercials.

I was listening to the radio/WBBM-AM today and J-Fraud was saying how he was disappointed in the sentence. What a little punk. I knew there were some bad cops, but I also knew that most of the brave men and women who serve in the CPD were there to do a job--a difficult and demanding job--one that paid less than it was worth.

I assumed that the justice system could, when asked, weed out those who thought of their badge as a license to run amok.

You, Judge Fleming, have now made every police officer that does their job, that honorably serves and protects the citizens of this great city, suspect.

the comment section of the papers are filled with police hate garbage.no one here defends this ding-dong or his actions. my problem is the overcharging of this case. yeah, yeah i know some law school wannabe will post the ILCS charge for AGG BATT. i say this...i have arrested DOZENS of victims hit over the head with bottles or sticks,cut or stabbed and beaten bloody....the dicks NEVER ONCE got the agg bat charge for me. many times when you call the det. you get ''will he live'' ''whats his background'' '' what s the extent of his injuries''.rarely do they even come out. AGG BAT charges are mostly for victims shot or almost dead. the facts.... this woman recieved little to any injuries. black eye? bloody nose? cuts? she refused medical attentions. did she continue to work after being attacked? do the other 100+ offenders in bar battery every weekend get the AGG BATT charge? 2 years probations... also. about 10 years ago a offender bit off a piece of my thumb during an arrest. the charge? you guessed it!

Abbate was convicted by the trial states attorneys presenting lies as evidence. No felony occurred here.

And the acquittal when it was shown that none of the State's evidence showed anything like a brawl, fight, or disturbance amounting to diddly?

Hey, Curious Citizen. The Jefferson Tap guys were not guilty. When "good citizens" start a fight and lose, it doesn't mean that the winners should go to jail because they're cops. Grow up. Of course Weis is disappointed, he doesn't know the law, but sometime between the incident and today he should have looked it up. Judge Fleming has a lot of courage for doing what he did. He's the one that came out the bad guy today for trying to correct an already blatant diregard for Illinois Law. Abatte just walked clean away. I'm dying to know how much the Daley/Burke/Joyce cabal ripped us off for today when we were busy watching this sideshow.

They put their lives on the line every day to protect us - however, now the focus is on this man as a representative of all police officers. My greatest fear? Cops are placed in danger everyday. I fear that now, their job has become even more dangerous (if that is possible). I pray that an ingorant individual or individuals does not attempt to or actually harm a police officer. Hey douchebag...perhaps because the "victims" in the Jefferson tap incident LIED about their "injuries". Doctors testified that the "injuries" these assholes claimed were non-existent. Funny how all of their "injuries" occurred when they were out of camera range. That was a bar fight that was instigated by the alleged "victims"...not an attack. I am not a poice officer, though I work with you every day. I stumbled upon this comment on the suntimes or tribune comment page, which I quote here:

That is the single most absurd thing I have ever read - but the worst part is that people actually believe it.

The men and women of the CPD are among the most professional law enforcement officers in the world - yes that includes the FBI and DEA. And the CPD members do their job every day in a horribly dangerous environment - and do so for lackluster pay and respect.

The people of this fine City, and its elected officials do not deserve the Police they have.

And in the face of all the disrespect the men and women of the CPD have to deal with: loudmouthed assholes, spitting arrestees, garbage complaints, long hours, injuries, public scorn, and yes the gangbanger's bullet that ends their life - there still exist men like Abatte whose crime is bad enough on its own, but worse even still because it causes an otherwise totally misinformed public to futher distrust the police.

I for one am glad he was convicted, and hope he is quickly removed from the department. I also hope against hope that someone (the FOP and CPD seem to not care at all about this) will tell the public what you do, for people you don't know (and who most of the time despise you) - everyday.

And to all of you let me suggest this: the buffoon who wrote that comment has neither the intellect to understand what he is talking about nor the intelligence to refrain from speaking - but in spite of that you would risk your life to come to his/her aid.

And that is why you are better than him.

Although I reserved opinion on the T.A. thing and I am expecting a community backlash from the sentence that was given - police who go to court saw this sentence coming a mile away AS LONG AS the rules that apply to the criminal at large were applied in the same manner in T.A.'s case.

On a positive note, maybe a positive result might come out of this entire fiasco - the public will wake up to the fact that this is the norm when it comes to sentencing - and your police officers see it every day!

You, Mr. and Mrs. John Q. Public, should be upset by this sentence, but not because of the case it is applied to. You should be upset because this is the norm. Your guardians are tired of watching criminals - and I am talking about criminals with guns, knives, and bats who were not afraid to use them, people who pummel a senior citizen to steal her purse b/c she dared resist, people who steal your cars, burglarize your houses...they get the same sentence! Or less! Now you have seen what we see and you are probably sick to your stomach. Welcome to the club. WE founded it.

This decision might have been the most important one of this Judge's career - It might be the decision that makes the public realize that they must demand the same accountability from their judicial system that they demand from everyone else, least of all themselves.

In all fairness, he should have gotten somewhere between 60-180 days in the clink. All of our negative media attention is directly due to this incident. Cline would not have been forced to fall on a sword. The Jefferson Tap incident would never have made the news. The Cozzi incident would have never been given to Weis by the media. Cozzi getting 3.5 yrs is directly related to this piece of shit. I never heard of the Cozzi incident before J-Fed and the media witch hunt. Lawsuits are on the rise due to this incident. This is not the last you have seen of this tape. It will haunt this department for 50yrs. People won't remember Pac-Man Jones, Finnegan, Meizandowski. They will always remember this, always. Every cop voluntarily took the job, knowing full well it was not anything like Adam12 depicted it. Bottom line is if you hate the job enough, move on. For the most part cops are pretty bright and could find other work. If you want to be a cop in Chicago, there are things that go with it that are unpleasant.

Police interaction with generally law abiding citizens is mostly limited to revenue generating traffic stops. You really think that people who mostly just want to be left alone to do their own thing and generally are not harming anyone else don't blame the cop for the ticket rather than the politicians that came up with that sick way of generating revenue?

And part of the deal when you work for a criminal enterprise like the Daley crime machine is that people assume you are not completely on the up and up. Its not an unreasonable assumption.

Why there is not a revolt at the ballot box is beyond me. maybe as a society we just have decided to accept the decay.

My guess is the summer strategy to deal with the almost certain rise in violence is to try and contain it to areas the Daley crime family considers expendable.

Here is a suggestion for a new thread, SCC. How about focusing on all of the volunteer activites that Chicago coppers engage in on their own time (NOT CAPS, not as part of their inside job) to help their community? Let's have a few hundred posts on that -- with names -- to show the none-police readers and reporters that most of us are caring human beings and part of our communities, not violent drunks. Should be a regular feature.

Maybe later we can also post about the cops who have interesting outside activities. I remember one time that short-lived CPD magazine (can't remember the name) had a piece on cops who were artists. It was amazing to see what people who push a beat car can do with canvas and paint. Lots of talented people on this job who have a life when they aren't on the job.

Although I reserved opinion on the T.A. thing and I am expecting a community backlash from the sentence that was given - police who go to court saw this sentence coming a mile away AS LONG AS the rules that apply to the criminal at large were applied in the same manner in T.A.'s case.

Actually one had to question the validity of the alledged victims claims in the J tap incident.
The video did not really show anyone getting the crap beat out of them. It showed some pushing and shoving.
Also, the alledged victims where shown in court to be the aggressors in that case = meaning they started the arguement.
In the question came up about their injuries. Officers that finally did respond, asked if they wanted to seek medical treatment for injuries they claimed yet were not visable to the responding officers. All of the alledged victims declined medical treatment that night.
Two of the alledged victims, the brothers, did not seek medical treatment until four (4) days later.
So their credibility was shot in court.
Their credibility will be shot in the civil trial as well.
If their injuries were so severe as they claim, then why wait four days for treatment?

That is why, in the J. Tap case, the officers were aquitted.

Why are people upset with the Judge in the case? At least the Judges in Cook County are consitent with their ruling on cases opposed to the ASA office.
What citizens of Chicago and Cook County should do is pick any Cook County Court House and sit there for a week and listen to the types of cases and how Jutice(cough,cough) is being served.
Every cooper that works in Cook County knew this offense did not rise to the level of a felony. Had this been a regular citizen instead of a Chicago Police Officer for a offender, this would of been Battery Simple. I could imagine calling out the Detectives and Felony Review, the laughs one would get, Felony Charges Denied by ASA X at 0000hrs. See the Judge got it right in this case it was an over zealous Cook County States Attorney that over charged this case worrying about an election problem in the future.Yes, Abatte was guilty of a Simple Battery, but no way of a Felony in the consitent ruling of Cook County Courts. Go to Br. 50 and 23 and see for youself the joke this Justice system we have here in Cook County. The Cases are dimissed before the defendant if reaches the bench! God Bless the CPD and Justice for Cozzi!!!!!!!

We will see now if the Lefty States Attorneys Office will now continue to approve Agg. Battery charges on offenders who cause non-hospitalization minor injuries to other victims. If Abbatte was a minority or female and did the same thing, he would have been given a 1 month Suspension, and at most have been charged with misdemeanor Battery, and if guilty would have gotten 6 months probation. This whole thing is discrimination in case review, charging, trial, and finding and sentencing. Abbatte is an A-Hole max in my opinion, but he definately wasn't given a fair and impartial investigation, and trial. No wonder nobody wants to do much anymore. While you are firing off a response, maybe take a deep breath and reread the post you are responding to - you'd realize we are saying the same thing. I agree that the Judge saw through the actual ramp up in charging and applied the law as it is applied in a case like this one in Cook County - and sentenced that way. If you looked at the case and cases like this one on a regular basis which I have - you could, as the Judge did, see the resulting probation sentence, or a trivial sentence, coming. And I agree it was upgraded because he is a cop. There are no elements of an agg battery here save the rare application of the portion of the statute you pointed out. Maybe we should cite this case in the future when asking for an upgrade, right? And of course, please realize who your friends are before attacking their post. You attacked an ally here...

The Tony that I worked with rarely went to his jobs, never backed up other officers, never wrote a mover, never wrote a parker, told Supervisors (including a Captain) to buzz off with regularity and pretty much just collected his paycheck.

The job is better off without him.

But I do agree that felony battery charges should have never been brought and probation is appropriate.

I feel sorry for Judge Flemming. He didn't trump up these bullshit Agg. Batt. charges. The states attorney did. They used a bullshit sub section of the law that states any battery that takes place on the public way or in a place of amusement qualifies for the upgrade to a felony charge. Not the typical great bodily harm or disfigurement guide lines in which even those usually arent enough for an upgrade by the states attorney. If this charge was ever used, all battery charges would be upgraded except domestic. Hundreds of batteries occur in the bars throught this city on a weekly basis and never ever even considered for an upgrade. I don't think most coppers are even aware this sub section exists let alone the typical citizen. Its like adultry, its in the Ilcs book but never ever used. If someone tried to use it they'd be laughed off the planet. Its not the judges fault he was presented with the charge and after the partial video being broadcast around the world, put him on the hot seat to do something at minimum. What Abbate did was dead wrong, dont misinterpet me, but let the charge and punishment fit the crime. He lost his job, his family has been dragged through the mud and now he's been convicted of a felony. Its still not enough for some people. The tape was made illegally because it had sound recorded with it which is a blatant violation of Ilcs eavesdropping laws and should have been dismissed as evidence. Another set of laws most coppers/people dont use or know much about. He was originally charged with a misdemeanor and 10 days later upgraded to a felony, as soon as the tape hit the airways. Typical knee jerk reaction by our legal system and shows they will do whatever they want to us and you will lose an uphill battle trying to fight it. Cozzi, another sad but prime example. Exactly, the same reason why you haven't heard any more about the off duty Sgt. that beat two hispanic Wrigleyville bar backs bloody in the back of a squad car while they were handcuffed. I could give a shit if he got a bus check, movers or parkers, but the least he could do is his help his fellow officers.

He used to proudly call himself ADS Abbate, ADA stood for "Ain't Doing Shit"
