Arbitration Arrives

At least according to Shortshanks, who once again, throws the negotiations out there in the media in violation of the "gentleman's agreement" not to do so:
  • Mayor Daley said Wednesday he’ll roll the dice and ask an independent arbitrator to dictate new contracts with police officers and firefighters who must do their part to help solve the city’s financial crisis.

    During his annual State of the City address, Daley noted that public safety employees who account for 70 percent of city spending were excused from a cost-cutting plan that required other city unions to choose between layoffs and furlough days and other givebacks.

    “They’re not in the boat. We’re in the boat. ... They have to come back to the boat. ... We’re asking them to get back in the boat. Talk to your taxpayers. Talk to your neighbor. They have to be part of the solution and not part of the problem,” he said.

The FOP is unhappy:
  • Fraternal Order of Police President Mark Donahue reacted angrily to Daley’s decision to pull the trigger on arbitration, a potentially risky move for both sides.

    “It sounds to me like the mayor hit his head on the boat when he was getting in. We’re still in negotiations with the city. We negotiate in good faith. It’s up to the city to show us that as well,” he said.

So far, the FOP is one of only three or four unions refusing to even consider givebacks to the city and they've actually played their hand decently. Other union leaders in the midst of selling out their members, are attempting to portray the Police and Fire Departments as greedy and out of touch and the media gives them play. The FOP really ought to slap back hard at Daley - his chronic mismanagement, his lies, his fake numbers, his two-faced negotiating in the media via intermediaries, his use of Chuck Goudie and other compliant media types to paint concessions we've made over the years in terms of allowances instead of raises to help hold the line on taxes and fees.

Daley is in a bad spot and arbitration is a risky move for all parties. The issues that are the subjects of "letters of agreement" could be in jeopardy and who knows if any of these will stand without a vote from the members?

OK, 70% of the city spending ---and, how much revenue does the CPD generate? There once was a time when CPD revenue was far greater than its spending. They had their own budget and "leftover" money went into the general fund. It became too tempting for City Hall and they included CPD in the city budget and didn't have to wait until the end of the fiscal year to get their hands on the extra funds. But those days are over and City Hall has seen to changing our mission. Rather than do traffic enforcement (including parking), the backlog for service calls requires more time thereby shrinking the window of opportunity to write the revenue generating tickets. City Hall created this problem and they want us to fix it.....

Well, the good thing will be that the city has to open the books and account for the money from the sale of our city assets. The same money that is being squirreled away for the olympics. The city has more than enough to pay for police and fire raises, just like they had for the aldermen. So go ahead...let the dice roll!

We all knew it would come to this and this is how he will satisfy the Olympic committees rules on contracts being fulfilled. Now, I do believe that the Arbitrator goes by past precedence but the city will still cry poor. What choice do we have. Any talk of loosing the money box for overtime or retro and we should and will march. He says that we all have to feel the pain equally, does he feel it? Do the Alderthieves? Property values have dropped but have any of our property taxes dropped. They vote themselves a raise and tell us to feel the pain equally. Well some animals are more equal than others just like in the book Animal farm I suppose. Do we all play the part of the horse who would work harder and harder for less and less until we collapse and get shipped off to the glue factory? They have done this, not us, through mismanagement of funds, raising taxes when they should be lowering them, lies and deceit. If we loose what we fought for we will never get it back.

Well, acutally we have given into concessions:
The lack of/or slow hiring in the CPD for the past two/three years is a MAJOR concession.
You figure the numbers out. If we lose 400-600 active members each and every year and last year he only hired 125; this year he only hired 46 @ 43,000.00 each.
Just the salary savings alone (no benefits) is over 27 million dollars!

I'd say that we have given into concessions far more than any other city department.

Is this a scare tactic, so that the CFD and the CPD will start to give up furlough days and unpaid holidays (comp time instead)to make us share the "pain" like the rest of the city employeees in exchange for going to arbitration?

The unions on the civilian side should of told Daley to go take a boat ride. If all the unions stuck together, this city would of been screwed!

I feel for the young members on the CFD and the CPD as their whole careers are ahead of them, seeing whats happening out there now. We ALL need to stay strong and let our Union leaders know that we do not want them to buckle under Daleys threats! Lets not surrender to Daley, like the rest of the civilian union leaders did!

Lets see:

Couple of federal things coming down the pipe. Gonna be big savings for city

1. Universal public option health care. (Citiies off the hook on health care)

2. Grant for cops on the street, Where the feds pick up the salary for police officers hired for the first four years. After the mass retirements for this contract. City will be hiring cops for the shortage and retirements (alot) all tab picked up by federal money for first year, with percentages for years 2 - 4. (same thing as Clinton). City is continueing to put all these costs in the budget as a negative.

See the city wants to show a huge deficit for the contract negotiations. They need the huge negatives for an arbitrator to rule in their favor. If the Federal grants and health care pass these negatitives are erased or at least minimal. He wants arbitration now so when the federal money comes he's got a bigger windfall at our expense with contracts in place.

Obama's holding the money as long as he can for Daley. But with his approval numbers going in the tank and the economy, he needs to get the money out there to secure 2010 Democrat elections for Congress and Senate.
Keep negotiations up and wait for the Federal money then go to arbitration if he doesn't give a better offer.

No raises and working with an expired contract (the economy was fine when our contract expired). Last night was the big night for city stickers. Easily could have written an entire book for $3000 in city revenue. Instead, you get $0.

The Lieutenants Association had an interesting article on Interest Arbitration written by their attorney in their recent newsletter. (http://www.cpdlts.com/jun09sentinal.pdf) Read it. You might learn a few things.

An example: In the case of Chicago Police

Get rid of the residency requirement!!! If we end up going to arbitration and get nothing in the form of monetary reimbursement, then we should be able to alleviate ourselves of the residency requirement. Not that I want the former, but I really want the latter.

People can't sell their houses now, if they lift residency you can forget about trying to move, the home values will plummet as people try to under-cut each oither to get their properties sold in the mad dash for the burbs...

We are in the midst of a typhoon, time to dip into the rainy day fund. He won't do that because he then couldn't give out no - bid contracts to his friends, who in turn kick back to the prick in the form of campaign donations.

HE needs everyone to forget that while the economy was tanking he, along with his merry band of alderthieves, voted for and passed a 6% raise for themselves. Oh, and let's not forget the raise of their "discretionary" fund that they use for "office expenses."

And could someone please explain what exactly a RAINY DAY FUND is? I know what Daley tells everyone it is: a fund to be held in reserve for when the city is experiencing a crisis.

So just how bad does it have to get before he releases these funds? And is it just me or does it sound like a contradiction to have all this money set aside and then cry poor? Just imagine if you wanted to declare bankruptcy and the judge discovered you had a sizable savings account. What do you think would happen?

Not too long ago there were dedicated and younger members of our "Union" who presented alternatives to the POS "Fraternal Order of Daley." Excellent arguments were made and supporting documents were on-hand to prove that the members of our "representatives" were squandering our funds and lining their pockets while pretending to assist us with our futures.

So...what happened?

the majority of our rank & file voted them in and continue to vote for them.

BLAME YOURSELVES!

There is no reason why we should not have professional negotiators steering our "boat" through Daley's sewer instead of a under-educated "union" who attends a few seminars, collects a check for each meeting and claims he is qualified to negotiate for us.

All these shootings....there is no reason why we can not have on-call ATTORNEYS who will come to assist us and protect our rights before the round-table instead of some drunken prick who shows up bringing pizzas. NOTE: The FOP DOES NOT HAVE CLIENT PRIVILEGE SO WATCH WHAT YOU SAY TO THEM. Right S.D.? (Claim chest pains and go to the ER)

You can say what you want, but I used to attend every meeting and I saw the same thing for ten to fifteen years. The FOP will do what the city wants. The arbitrator will do what the city wants. And the majority of us will continue to vote for the same brand of idiots. We need professionals on our side, not greedy politician/lobbyists who pretend to be the police while the steal our money and provide no backup whatsoever.

Daley and the Aldercreatures seem to forget that they voted themselves a nice 6% raise to go with their office expense fund, their vehicle expense fund, their re-election fund, their unaccounted for slush fund and their bonuses for serving on any committee.

I will be happy to do my part and play along with the unpaid days when these fools start leading by example. Let's see them start giving up double digit percentages across the board for every fund they are ripping off the tax payers (us). Let's see them start paying for their health care. Let's see them pay into their retirement. Let's see them eliminate their slush fund and car fund. Let's see them serve on committees for free.

Just a reminder for Daley and the Aldercreatures, since some of them can actually read. You were elected by the people and your place is to serve the people, not the other way around.

I would love to see a referendum for term limits for all these scumbag politicians.

Since none of this is actually going to happen, I am rooting for Rio to get the Olympics even though the billions Daley has squirreled away for them has already been spent bribing the committee members. If we don't get the Olympics none of that selling off asset money will materialize. It has already been spent. Our children and grandchildren will be left holding the bag.

I am bailing as soon as I am able and I would advise everyone else to do the same. Don't just leave the city when you retire, leave the state. If we get the Olympics, the city will be completely broke and will be relying on the State to bail them out.

guess what boys and girls. take this to the bank. the 10 percent offer the city has is going to be cut by the arbitrater to 5 percent. the city is in a GREAT position. this is all a ploy by the city. they wanted the 471 layoffs because now the arbitrator has no other option except to side with the city. no chance in hell an arbitrator is going to give us more money after 471 city employees just lost jobs because of the economy and city debt. ill be very suprised if there is any type of retro.. i see 1 percent a year and a small increase in duty availability and uniform checks. its gonna be a tight couple of years with money boys and girls. lets not forget, we are ranked #3 when it comes to big city police officer salaries.. we dont have much room at all now to argue when it comes to arbitration. any raise at all in arbitration will be a gift. hate to say it, but the city won this war. we will see what happens in 3 years when next contract is up.

An arbitrator does not care what raise the alderman received...he doesn't care what the head of streets and sans makes...all he does is look at comparable police departments to come to a decision on salary and retro,etc. Somebody look at NYPD, LAPD, and Phoenix to see what they received or gave up....This could get scary.

Dear Brothers and Sisiters:

For those of you, who have missed it, Mayor Daley announced at his July 15th State of the City Address that contracts for both the Police and Fire would now be decided by an Arbitrator. It has always been my understanding that arbitration becomes necessary only when the two parties can no longer make progress in negotiations and have reached an impasse.

On June 25th 2009, just three short weeks ago, we met with the City Negotiators and their was absolutely no mention whatsoever of impasse or arbitration. In fact, we actually tentatively agreed on several smaller-scale issues.

In a meeting with the City today July 16th 2009 we reaffirmed the fact that the City of Chicago has NOT rescinded the 16% raise offer. The Mayor's comments are contrary to the current status of our negotiations.

We have scheduled a special meeting of your Local 2 Executive Board for July 23rd 2009 and are looking to set up another round of negotiations for late July or early August 2009.

We will continue to keep you apprised of any developments as they happen.

My cousin served in Vietnam and died from agent orange. My uncle flew fighter planes in Korea and was never the same when he came home. My father served in the navy and my brother served in the army. Another cousin is in Afghanastan.
Many friends in desert storm and some now in Iraq. How many of your family and friends served in the wars, how many didn't come home or were seriously injured. It doesn't make a difference why they were sent there, they thought they were going to protect us and protect FREEDOM. That is the only reason I want residency lifted. We should
be able to enjoy the freedom that any other citizen has. No one should have that much power that they can dictate where you live and raise your family. I probably wouldn't leave at least not right
away I'm not going to take the hit on the house just like a lot of us. Also there are many that won't leave because their families are here as well as for other reasons. But we should be able to enjoy that right that is afforded to us by our constitution. We should be able to enjoy the same right that illegals enjoy. I know we aren't fighting like the ones I mentioned above, their fight was for the country. A city or municipality should not be able to take away from us what others fought for, to me its a form of dictatorship and oppression. Thanks for the rant.

No, the city does NOT have to open its financial books to an arbitrator.
No, the arbitrator CANNOT force the city to open its financial books.
The arbitrator could care less whether the city has $$ or not.
The city can cry poor but all the arbitrator will look at is past settlements (contracts) and what other cities have received in their contracts.
The arbitrator will also look to see if both parties have been negotiating in good faith.
He could concievably force both parties back to the table as well, (that is unlikely given we are two years out of a contract).

Not quite.

That contract also includes us dispatchers...but we're not listed on the SEIU page because we're in a separate [powerless] union. Our contract expired the same day yours did...July 1, 2007. The 6.25% on 01Aug09 is a "catch-up" of sorts for the last 2 years without a contract, so it's actually 3.125% retroactively for each of the last 2 years, followed by another 3% in January, for a contract expiring at the end of 2010.

It's 9.25% over 3 and a half years. And no retro.

Drop residency? Either you don't own a house or you live in a crappy neighborhood and you'll lose money anyway. Where will we go? IF they EVER drop residency, I am sure there is some type of rule that would state that you have to live within xx amount of miles from Chicago city limits.

Here is the legislation as to residency:

Residency requirements for police and firemen are even more complex. According to Section 3.1-10-6, municipalities with a population of not more than 500,000, may adopt ordinances that allow policemen and firemen to reside outside the corporate limits.[4] In addition, recent legislation has made residency negotiable during collective bargaining for both police and fire.[5] It is now a subject which can be resolved by an arbitrator, thus making it an item on the table during negotiations. How this will eventually play out in the legal system is unknown. Interestingly, the General Assembly, in this new legislation, did require residency in Illinois. Remember, however, that collective bargaining is only available to municipalities with 35 or more employees or where the city and employees both agree to unionization.

all of those looking to get residency lifted instead of retro better start looking at some of the taxes your going to pay outside the city. You can pretty much triple what you are paying now. Does the education benefits equal the increased taxes that you have to pay the next 20yrs?

we have to stick together now more than ever. our 30% management in the ranks is dividing us because they are suckholes and have no balls to stick up for themselves. we all plan progressive marches, threaten absolutely no ticket writing, and take our time to hot calls, let the bad numbers go up, were short anyway. then we DEMAND our pay raise, and what little rights we do have. we dont give ANYTHING up! if the FOP cant get the job done, we vote them all out give it to those who can stand up for us. we have so much power we dont even realize it, all it takes is organization and desire to get what we DESERVE! I dont give a fuck what our contract says about not "striking", if we dont get what we deserve, we stay home for 1,2,3, 4 days. No writing tickets, we shut this mutha down. That is all it would take, call in the military to protect the streets, thats what we need anyway! we are in a combat zone now! Nobody would bring the olympics here, that would solve that problem, cause you know people are waiting to get rich while we suffer on the side.

I had dealings with Bedford Park about 8- 10 yrs ago. Son backed up and hit a Bedford Park squad at Best Buy. They got their damage estimate and allowed us to pay them cash for the repairs! (no having to go thru the ins. company, especially since he was only 17 yrs old).
Class acts all of them.

I want to start out by saying; I know everybody has bills, tuition, vacation and every other damn thing to pay for however, my idea is let’s try NOT signing up for any overtime detail……NONE. Let’s shut them down….all of them ….CTA, CHA, Obama, Safe Summer or Safe Streets and all the rest of the overtime indicatives. Fuck’em lets shut them down. I know it will be hard to get everyone to do it but what the hell we got to do something. Even if it doesn’t work it would be fun to fuck with the bosses. Spread the word let’s try it for a month, a month won’t break anyone…come on just one month… the most you could get a month is four days anyway….four days won’t break anybody…I know it will hurt but it won’t break you. Spread the word …no one sign up for the month of September for any overtime indicative…let's all stick together just this one time and show this A-hole…just one month.. spread the word SEPTEMBER
