Rollbacks?

This is the first we've heard of this practice. Can anyone verify? Here's a couple of comments popping up here:
  • Vote a NO to the Rollback judges at 26th and California. He's guilty. Shes's guilty. Then.....when no ones around....weeks later....at the sentencing hearing...Ummm...hrumph...umm...after further review I find him and her ..not guilty. What? What happened? ( later on in the day the poor citizen and the police officer see the guy and girl they thought got five years out in the street.) What? What happened? ....John Kass where are you??????????????????????????This is a new column in the making!!!!!!

  • This happened to me, too. 3 years turned into time served while I wasn't looking. Can't remember the judge's name, Room 600 26th and Cal is where it was in June 2009. Agg Batt to PO while on probation.

    The quip about this new thing about rollback judges is so true, especially in the last 6 months at 26th and Cal. My partner and I had thought we did a very good job getting all inventories and being present in court when notified. The ASA's congratulated us on a job well done after the defendant was found guilty in a bench trial in one of the 3rd floor rooms. The judges name escapes me now. But I distinctly remember the court room being in on the 3rd floor. Now the kicker is when I get my disposition paper it is signed by the ASA saying thanks for your help but the defendant got a finding of not guilty. I thought I had read it in error but nope. I called the ASA and when she called me back, she told me that this is becoming a frequent thing. I explained to her why? The ASA said she thinks that it could be a sign of the times with the jails being overcrowded. Well....I call another ASA that I knew well from another courtroom and ask him. That ASA informs me that he is seeing this happen more and more to in 26th and Cal and believes off the record that envelopes are being passed. Good grief......so now are all judges suspect? What is going on. The ASA's gotta know something. A new law enacted recently that we don't know about? One thing after another at that 26th and Cal for sure.
We have heard from a reliable source that judges are under orders to dismiss dope cases under 1 gram unless certain hurdles are met, and the hurdles are damn steep. Not surprising actually. We've even read that there's a judge that approves search warrants, then finds no probable cause at preliminary hearings on her own warrants - how fucked up is that? But this "rollback" sounds fishy in the extreme.

Of course, it wouldn't be the first time judges went to jail in Cook County. We can only hope for more to head that way.

This would happen to a lot of my cases up in Skokie. It happens more then you know. You have to tell the ASA you want to be present at sentencing!

That judge would be judge Chevere in br 44. She throws out up to 4 grams and no pc on all gun cases from New Years. She has thrown out pc cases on her own search warrants. come by and listen to her, all talk, no bite. the criminals know it too.

The judge is Marcus Salone. What happens is he will sentence someone to probation then when the is up later- say 6mo or year he will enter a not guilty on the court sheets with out notice to Sao etc. This is the same judge that made everyone that came before him register to vote for Obama and has a picture of MLK hangining in his courtroom. Former cop. Wife was victim of Armed Robbery few years back. He thinks he will become a federal judge because he played basketball with Obama. The kicker is Cpd knows about him CCSAO office Knows about him Clerks office knows. Short of an indictment the only person who can do anything is Chief Judge of 26th street Biebel. Good luck getting that ballless prick to do the right thing. By the way things are only going to get worse with Bill Hooks getting his own courtroom.

Twenty years ago I was going to Br 57 with PCS cases of a gram or less. The ASA would talk to the PO's and politely explain for us not to get upset but there will be a finding of no probable cause in dope cases of less than a gram. Sure enough, all my cases of PCS of coke or heroin less than a gram were tossed with a finding of no probable cause.

That was when I stopped making dope pinches.

Fast forward to 2008, suspected DUI on the street, fights in getting him out of the car, has a bag of heroin in his fist. Charged with PCS (.7 gram) resisting, battery to PO and a pile of traffic charges.

No probable cause on the PCS/heroin, all traffic cases tossed summarily and a plea of guilty on the resisting and misdemeanor battery. He took 45 days in CCJ on the two misdemeanor charges.

With his sheet, 45 days just allowed him to clean up a bit, no big deal. The only way this guy was hurt was on the vehicle impound. He lost his Ford Explorer when he finally got an appeal hearing at 400 W Superior, judge ruled for the City on the over $6,000 he owed in charges and of course he couldn't pay. that was a surprise since the City and state were so accommodating in throwing everything else out of court.

Once again, there will no more PCS arrests and add to that battery, resisting, DUI and most traffic offenses. Fuck it all, no way am I taking chances any more to watch these jagoffs walk, no way will I spend time on paperwork and risk getting sued for no probable cause or just a few weeks in jail.

Red lights only, bus checks, event numbers. That is it.

But wait, there was one guy who I went to court on recently for over a year on felony agg DUI and driving on a revoked license. Over a year of court appearances. Finally he lost his last motion to quash and took a year in IDOC. Guess what, that year in IDOC translated into exactly 2 months at 26th street, then he was out of there.

I know, it was only only driving. Soon there will only be murders in jail, everything else will be "no probable caused" or "roll backed" or "plea bargained" with the argument that, hey, at least they didn't kill anyone. Now a year in prison means 2 months, if the state is lucky.

Truth in sentencing is but a distant dream now. Retirement is closer and looking better than ever.

Best of luck to all you who remain. And especially to those police yet to be hired who won't even have our pension to look forward to. Yes, that is coming. You will hear about it this year.

The Chicago Pension Commission will issue it's report this year and you can bet it will lead directly to a new 401k type pension for new hires on the CPD real soon. Instead of good luck, it is more like God help us.

The Judge in 48 does the same. Signs a warrant then no PC's it. How the fuck can it be no PC? A warrant is a paper that is the probable cause to do the warrant and he or she friggin signs it.

Shakman wants to now go after patronage hiring within state govt., he claims to have done a great job within Chicago and Cook county. WTF!!! More lawyer bullshit..
I wonder if the rollbacks in the court system are politically motivated, maybe these lawyers should start putting the real criminals in jail instead of in public office.

any copper locking a guy up with a gram of dope is wasting his fucking time anyway. Unless you want the 3 hrs OT for the prelim hearing then whats the point? These cases have been getting tossed for many yrs. And its not just 1 gram, my experience is anything under 5 grams with the occasional exception. If anyone is surprised by any of this then 1 you are not a copper or 2 you are just flat out fucking dumb. This shit has been going on in Cook county for yrs. Its damn near impossible to get a felony charge approved let alone a finding of guilty w actual prison time

If the courts are going to dump all 1 gram and under cases, why not just announce that and let everyone act accordingly. Save us all the trouble.

This kind of garbage brings disresepct for the courts and law enforcement when someone guilty as hell gets no-PC'd. That guy walks out thinking it's all bullshit and a joke.

If the courts would announce what they're doing, we could just stop arresting small possession cases in the first place, and maybe focus on more important things the courts ARE willing to deal with.

That's old news, where you been. I had this Judge back in 97 give me PC on a drug case. I was in the back working on my 101. The Deputy came back and said that the Judge wanted me back at the bench. I thought that was odd. Than when the defendant got to the bench the Judge reversed his rulling and gave me no PC. Everyone immediately moaned to that decision. I was shocked.......But hey citizens, know that if you want to commit a crime, do it in Cook County.....Just being rhetorical....

My first drug case thirty years ago. Went to Narcotics court at 26th St. for prelim. Guy was caught red handed. One gram or less NPC. Judge Bastone was very respectful but the unwritten rule unknown to me at the time was one gram or less and it's out. This is nothing new. It's just a matter of case control in the court sys.

The clean car thing came as a result of a pool car being returned to A/3 with mounds and mounds of garbage in it. From what i hear it was really bad. So the A/3 garage guys complained (and rightfully so) that they shouldn't have to clean our sh*t out of the pool cars being returned. I think it got all the way to dugan coming out and seeing the mess in the car. Hence, the new order. WE caused this problem. The f*cking slobs that are too lazy to take 2 minutes to clean their cars at the end of the tour. Thanks a lot.

OT---COZZI UPDATE--IMPORTANT

I just got off the phone w/Bill and he said arguments on his appeal are beginning on Feb. 18.
He and his lawyers do not have any idea how successful they will be, so everyone please pray.

Bill also said that he is still in the process of writing everyone who wrote to him, and is able to get out 50-60 letters per week. He did not want to send a form letter, so he is writing everyone individually because he is so grateful to those of you who took time to write him.

Bill is still EXTREMELY depressed, and keeps to himself and said he always has to have an eye open both ahead and behind him.

As far as visiting, he said he does not want to jeopardize anyone coming to see him. He stressed that the part of the country he is in is crime-ridden and the people do not like northerners. He said he thinks it is too dangerous for anyone to make the trip, and he will not even let his family come to see him. He also said that the prison personnel treat northerners badly and he does not want anyone to have to go through that to see him.

His lawyers are still working on getting him transferred closer to Chicago, but understandably are more occupied with his appeal.

Bill said that although we tend to bad-mouth Chicago, since he considers himself 'at the gate of Hell,' that he still loves the city and the CPD.

He said he has enough books and magazine subscriptions and he is grateful to the two persons who have arranged for him to get the Tribune. He said getting mail, reading the Trib, and going to bed are the only highlights in his day. I had been sending him news clippings, but the prison sent them back.

I am thinking that Bill might like some photos, maybe of the old district, maybe a roll call, Chicago landmarks, anything funny, etc.

Please keep sending cards and letters. He really can't receive much else.

I will add another update next time I talk to him.

Good! If most of you guys werent slobs then nobody would have to check. But when the car is filled with garbage and has coffee spilled all over maybe if someone gets written up over being a slob then you will pick up after yourself.

I know for a fact about a judge doing something similar to this stuff. Marcus Salone will sentence people in open court to 2,3 years probation(if you get probation from him, you probably deserve 10-15 years IDOC). After 6-12 months he then enters a non guilty if they haven't violated probation. Nothing on their record then. At least with 14-10 probation that's given to minor drug defendants you have a misdemeanor conviction on your record after you serve felony probation. With him it's nothing! And it isn't just drug cases he does this on. It's PSMV, UUW, Burglary etc. To the surprise of the CCSAO, he started doing this about 3 years ago. He's the judge with a big picture of Martin Luther King hanging on the wall behind his bench. MLK was not an elected public official. MLK was also a proven Anti-American communist, and adulterer. Everyone is entitled to their political beliefs, but could I hang a picture of Rush Limbaugh or Glenn Beck in my courtroom?

Got up this morning and poured myself a cup of coffee. I put on my glasses and camoflauge pants. I turned on the computer and checked the SSC site. My cup of coffee was soon spilled on my camo pants and I was jumping up and down pointing at the computer screen livid after seeing the column about Rollbacks. I knew I wasn't crazy. This has already happened to me not once but twice with all the defendents being convicted felons. And the fault is because of a lot of combinations. I fault mostly the ASA's who tell us we don't need you to go to the sentencing hearings because your guy is already found guilty. Mmmmmm, maybe the ASA doesn't want us there in the courtroom at the sentencing hearing because the judge is going to ROLLBACK the finding. Nice gig huh??? There is something going on but I am not sure how to go about doing anything because I have already told people and they have told me we'll look into it. This was since the month of may 2009 by the way. Long term investigation? I had told my sarge, my lt. and they laugh and guffaw and say you made the overtime right? Get em next time. Next time might be too late. You hear the horror stories. the convicted felon that has a rap sheet miles long, let out on early release or whatever and then kills somebody like a cop or little kid. It's all a joke to a lot of people in Cook County. My superiors, and the ASA's all think it's no big deal about this rollback. I guess they got more important things to worry about then this rollback. Until something bad happens to them or their families.

I just posted about Bill Cozzi...Is there anyone willing to copy SCC into a word doc, print it and send it to Bill every week? He loves to get it and I've been sending it, but I'm off for awhile due to surgery so I have to print it at home. I don't mind the expense, but it's hard for me to get out and get ink refills.

I copy the posts into word, along with some of the comments. You could save it to a flash drive...print it on the city's dime.

Please let me know if anyone is willing to do that for him. If you could send it weekly that'd be great. I will check the comments section for volunteers. Maybe someone could copy the posts and someone could copy the comments.

I will say this, and I will get roasted for it but it is my feeling. Judge Deboni in branch 42 is a great Judge and will be retiring soon which is a great loss. He tough but fair. Has no problem signing a warrant when a shit bird shows up 5 minutes late in his court room. PO's get pissed off when he dismissed cases when they show up late and the case is called, but fair is fair. He also gives prob cause for any arrest where the facts mitigate a prob cause finding. Again PO's get pissed off when he finds no prob cause but in all the years I've been going to the court the cases he finds no prob cause on, I would not find prob cause on because the PO's testifying sound weak. He's even given me prob cause on 1 rock cases, obviously not drop cases because those should be thrown out for the most part. Like it or not, when he is retired and replaced I think branch 42 will suffer the same fate as other branches

There's a judge at 51st & Wentworth who regularly approves search warrants for PO's and when they come up for probable cause hearings doesn't hesitate to find no p/c. This judge is also running for Appellate Court Cook County Judicial Circuit. And of course if the defendant has a private attorney, it's likely there will be a finding of no p/c on decent cases all over a gram.

My favorite is when the asa decides to make it very easy for the judge to come up with a finding of no pc by asking so few questions of the po that the pd can doesn't have to cross at all. I know these are lesser cases, but try the case the right way and put the onus on the judge for finding no pc. A well tried preliminary hearing by an asa will go further to discourage a civil rights lawsuit than a towel thrown in.

Nothing new here! Dumping good criminal cases ( fill in the blank regarding type) has been going on in the cook county courts for a long time and I mean a long time. I can go back to 1970 and it has been happening. The courts have used one system or another to do this. It is their way of unclogging the court system, and clearing their court calender so the court staff can get out for the day. Not the right thing to do, but the judges are slated by the democratic system and rarely get voted off the bench. If the powers do not want to prosecute people for violating certain laws, then why have the laws on the books? I say the politicians can look tough on crime to the public by passing these laws knowing that they will never be enforced and knowing that the criminal justice system cannot handle the volume. Average joe public does not have a clue as to what goes on in the courts. Just compare the size of the Illinois criminal code now to what it was 30 years ago. It is a good 15-20 times thicker. No one, not even the cops, know what is in the criminal code.

CPD should be up in arms over this and should go to the US Attorney's office, Fox News and anyone else who might take it seriously. Rollback is shorthand for "motions to fix need not be in writing". You risk your lives arresting drug dealers, gangbangers, armed robbers and other criminals and the judges in the PC courts routinely find "no PC". Loevy and Loevy, Kulis and other bottom feeding plaintiff's lawyers then file lawsuits against the POs and the City alleging violation of constitutional rights under 42 USC 1983, malicious prosecution and false imprisonment. Against the City they also allege a failure to train and a practice by the City of permitting their POs to arrest people when there is no PC using as examples all the no PC findings by the state court judges. As a result, the City is inundated with cases against its CPD officers and the City itself. This practice by the PC court judges has dire consequences for the POs and the City and for the public in general.
If they don't want to find PC for these violations, then take the laws off the books. Don't require the police officers and the city to defend law suits for attempting to enforce the laws that are on the books.
It's a wonder any of you make any arrests or do any police work. The deck is stacked against most attempts you make to keep society from being plundered by the savages. Stay Safe!

It amazes me that there hasnt been a class action suit against the county for all of the unlawfull arrests that occurr due to to the FNPC on anything less than a couple of bags. Basically the judge is saying that you had no reason to arrest that person by his finding. There are drug court cops that have had hundreds of cases thrown out just because the defendant doesnt have the magical number of bags as determined by the county to meet probable cause. Something really needs to be done about this before someone is held liable for the wink and nod rulings that go on in prelim court.

You have a job to do, so do it. If you come across criminals with drugs, lock them up. If the judicial system of this county wants to set them free, so be it. Police don't control this corrupt system, but refusing to lock up criminals you have in your grasp because you believe that some judge is likely to set them free is nonsense.

And, one visit to your branch court is worth about $100. That's $100 per week for your felony court and another $100 per month for your misdemeanor date. That's an easy $7000 per year. Just under 10% of your base salary.

On the other hand, if you are spending all of your time searching for one bags because you want to change the world, you're delusional.

I'll do my job. If the judges and juries refuse to do their's, that is out of my control.

This shit is really true. The mutt we arrested was found not guilty of Attempt Murder (bench trial Bridgeview)on me and my partner but was found guilty of 2 counts of Agg Bat to P.O. Pcs, and lesser charges only to find out later that the MF got 56 days TASC, and was out walking the streets. Not only that, but somehow and I don't know how this MF's rap sheet reflects a Misdm conviction and not a fukn felony. I pulled his rap sheet after getting a letter from the ASA's office requesting our appearance regarding this mutt's attempt at reducing the charge or expunging his record 3 yaers later. We went to court and said HELL NO! they still changed it on his sheet so this MF could get into the service.

I was never comfortable with a sergeant in the car with me even if it was a friend of mine. Thats not because I thought they would rat me out for anything, but only because I didn't want to middle them for some of the stuff I was responsible for.
The pigpen car thing just amazes me, thats your office! I can't understand carving on the steering wheel, leaving chicken bones under the seat or mambo sauce on the dash.
The only reason I can see for a small pcs arrest is for probable cause for a search warrant (bolander warrant). I would take weis's job at sergeants pay, but the only people that would be happy with that would be coppers.

They don't care because they do not get sued for civil rights violations, false arrest, false imprisonment; if they did, this shit wouldn't be happening.

It's time for state law to be enacted that gives the police the same indemnification as judges and prosecutors against lawsuits, or else the police should just show up,do a report, and let it burn.

Someone who trained me when I first came on the job told me that once the handcuffs go on, you've won. You've done your job. You have no control over what happens from there on.

Contrary to what they would have you belive, its not your job to get convictions. That lies completely on the ASA.

We're right to be angry about rollbacks, but for the wrong reason. We're residents of this county and should be pissed off about this practice!!

The Supreme Court of Illinois suspended the law license of Cook County Judge Adam D. Bourgeois Jr. for two months Tuesday for lying on five questions on his application to become a judge.


Bourgeois admitted that he did not mention as required on his application that he defaulted on his student loan. He lied about not being held in contempt of court for failing to pay child support and his student loan. He failed to reveal that the state's lawyer disciplinary agency had investigated complaints against him. He had lied about whether he had ever been sued, failing to mention the suits about his student loan, his missed child support payments, and failing to pay his rent.


Bourgeois was previously sentenced to one month unpaid leave from his job as a judge by the state's Judicial Inquiry Board for failing to mention on his statement of economic interest that he owed money to the state, to the IRS and to a landlord. He also did not mention he had been sued for non-payment of child support.


During the investigation, Bourgeois has been performing marriages and handling other administrative duties.

Again PO's get pissed off when he finds no prob cause but in all the years I've been going to the court the cases he finds no prob cause on, I would not find prob cause on because the PO's testifying sound weak. He's even given me prob cause on 1 rock cases, obviously not drop cases because those should be thrown out for the most part. Like it or not, when he is retired and replaced I think branch 42 will suffer the same fate as other branches

Why do you say that drop cases should automatically be thrown out. A ton of my narcotic arrests have been legit honest to goodness drop cases. Why all of the sudden are they to be tossed out. If i saw him drop it, then why in the world doesn't that constitute prob cause? Does that mean that they are saying that i didn't see what i saw?

You have a job to do, so do it. If you come across criminals with drugs, lock them up. If the judicial system of this county wants to set them free, so be it. Police don't control this corrupt system, but refusing to lock up criminals you have in your grasp because you believe that some judge is likely to set them free is nonsense.

And, one visit to your branch court is worth about $100. That's $100 per week for your felony court and another $100 per month for your misdemeanor date. That's an easy $7000 per year. Just under 10% of your base salary.

On the other hand, if you are spending all of your time searching for one bags because you want to change the world, you're delusional.

I'll do my job. If the judges and juries refuse to do their's, that is out of my control.

$100 per court visit??? What the hell pay scale are you on? I make about $60 and i've got just under 10 years on. I would say that's average from what i hear.

OT---COZZI UPDATE--IMPORTANT

I just got off the phone w/Bill and he said arguments on his appeal are beginning on Feb. 18.
He and his lawyers do not have any idea how successful they will be, so everyone please pray.

Bill also said that he is still in the process of writing everyone who wrote to him, and is able to get out 50-60 letters per week. He did not want to send a form letter, so he is writing everyone individually because he is so grateful to those of you who took time to write him.

Bill is still EXTREMELY depressed, and keeps to himself and said he always has to have an eye open both ahead and behind him.

As far as visiting, he said he does not want to jeopardize anyone coming to see him. He stressed that the part of the country he is in is crime-ridden and the people do not like northerners. He said he thinks it is too dangerous for anyone to make the trip, and he will not even let his family come to see him. He also said that the prison personnel treat northerners badly and he does not want anyone to have to go through that to see him.

His lawyers are still working on getting him transferred closer to Chicago, but understandably are more occupied with his appeal.

Bill said that although we tend to bad-mouth Chicago, since he considers himself 'at the gate of Hell,' that he still loves the city and the CPD.

He said he has enough books and magazine subscriptions and he is grateful to the two persons who have arranged for him to get the Tribune. He said getting mail, reading the Trib, and going to bed are the only highlights in his day. I had been sending him news clippings, but the prison sent them back.

I am thinking that Bill might like some photos, maybe of the old district, maybe a roll call, Chicago landmarks, anything funny, etc.

Please keep sending cards and letters. He really can't receive much else.

I will add another update next time I talk to him.

I also had Salone let a guy off. He was a shooter from out of state. We caught him with a pistol in the process of doing a hit on a 4CH. He was found guilty in bench. Later I get the notice that after a motion to reconsider he was then found not guilty. Saw shooter on street weeks later. Asked him who he paid and he had that "you caught me" look on his face and he just laughed.

I want to start out to say how much I have always respected the Police. I started reading this "blog" after someone told me about it. I sympathize with your frustrations regarding the politics of the city, your department, and the public in general. But sometimes in reading this I wonder if any of you really "care about each other" anymore. So much of this blog is utilized "slamming" other units, police officers, and the department in general. I think I speak for many when we say please do not turn your backs on us"the citizens" because you are so frustrated with the "politics'. You are not alone, even the citizens are frustrated. By contract, daley must lay off ALL civilians in the police department before he can lay off ONE police officer. That has been in the contract for quite a while.

Of course, he has broken the contract before... He will have to lay off all those political heavy weight district managers first. That actually would be an improvement.

the whole cozzi situation has really demoralized me and several other members of the patrol division who work with me... as you sit and think about what happened to this poor guy you realize that the enemy is not the jagoffs on the corner but the slimy snake that is slithering around on the fifth floor over at 3510 s michigan----- we will never forget what you did to our fraternal brother and pray everyday that you will be gone soon--- it's really disgusting watching you put on that uniform trying to pretend you are one of us when you really are a yellow bellied back stabbing prick.....

We have heard from a reliable source that judges are under orders to dismiss dope cases under 1 gram unless certain hurdles are met, and the hurdles are damn steep.

I would not be at all surprised. The sheer volume of cases means they have to do something to handle them all, or the system would just collapse.

Not that it is an ideal situation, but it may be the only practical solution.

First off go back and look at my original post. I stated that drop cases should be thrown out FOR THE MOST PART. You have to keep reading and process the full thought. I have made a lot of narcotic arrests too, and yes sometimes shit birds throw the stuff to the ground. But too many coppers use the "subject dropped from his right hand a clear plastic baggie containing a white rock like substance" and that is all they write. There is never mention of previous surveillance, prior interactions with the subject, etc. Just a catch all sentence. If I were a judge and saw 50 cases a day and 47 of them were drop cases I'd have a hard time believing that offenders are just tossing dope all over the city streets willy nilly. I actually had a drop case where dude dropped to the ground the narcotics which were contained in a cheetos bag. I put in there the surveillance we did, the transactions we observed and then charged dude with littering which was our PC for the arrest. Search incident to arrest we found the narcotics, judge found probable cause, we won the trial dude got 6 years based on prior convictions. Just be a little more vigilant and maybe, just maybe the judges might start to believe what we see

I asked if someone could copy the blog and send it to Bill......can you or someone you know? I just sent 19 pages of it to him yesterday. Thanks to anyone who steps up. I try to send him a card or letter every couple of days, and I have never met him. If you talked to him on the phone you would be heartbroken. And not ONCE, has he ever m'fed J=Fed or anyone else. My favorite is when the asa decides to make it very easy for the judge to come up with a finding of no pc by asking so few questions of the po that the pd can doesn't have to cross at all. I know these are lesser cases, but try the case the right way and put the onus on the judge for finding no pc. A well tried preliminary hearing by an asa will go further to discourage a civil rights lawsuit than a towel thrown in.

I had to sit through drug court a couple weeks ago and the judge threw out EVERYTHING ... so what? who cares //// I just wish the judge would have thrown it all out without having to sit through the nonsense testimony ..... not saying the cops were lying .... just don't care to hear it .... takes forever and you know damn well no matter how legit the arrest the judge will say the magic words ' NOT PROBABLE CAUSE '
