Aldercreature Sues Cops

  • Ald. Sharon Dixon (24th) is suing three Chicago police officers she says falsely accused her of driving drunk on Jan. 20, 2009 — the day of President Obama’s inauguration.

Dixon says she had a couple of glasses of wine at a friend’s house in Evanston and was driving home when she was cut off by a police car on Sheridan Road where officers were trying to control traffic near the scene of a fatal Rogers Park fire.

Dixon says she attempted to explain that the police roadblock was confusing and dangerous — but the officers became angry and agitated.

Yeah, we usually get that way when we stop people driving over hoses, endangering police lives and firefighters ability to save lives. Here's a clue dumbass - if you see blue lights, stop. If you see hoses on the street, stop. If you see fire equipment blocking the street, stop.
  • “When they resisted my input, were indignant over my suggestions and disrespectful of my personhood, I stood up to them,” said Dixon at a Wednesday news conference announcing the suit. “I asked them for their badge numbers ... that, asking them for their badge numbers, is what triggered my arrest.”

Police claimed Dixon smelled like alcohol and failed sobriety tests after arguing for 30 minutes.

Her input? From a drunk who disregarded state law and common Illinois Rules of the Road concerning emergency vehicles? And it seems like it was your drunken behavior that triggered the arrest, not the silly demand for star numbers.
  • She was arrested, refused a Breathalyzer test, and had her license suspended

If she had nothing to hide....isn't that the reasoning politicians use on us all the time?
  • Dixon said she spent seven hours cuffed to a police station wall — and argued that the fact she could endure the lengthy detention without a washroom break was proof she was not drunk.

Not that we're bragging, but we used to be able to go for twice that without breaking a sweat. Lack of urinary function proves nothing.
  • Dixon also contends “police forced me to wait until the press had arrived and then made me walk out of the front door.”

In February of last year a judge found there had been no probable cause to arrest Dixon for DUI — and the charge was later dropped. Dixon did, however, plead guilty to obstruction of traffic and paid a $200 fine.

Well, it's not like there are any dishonest judges in Cook County, right? The obstruction charge alone could have been interpreted as Probably Cause in any other court in the nation.

What an idiot.

I'm not very familiar with civil suits, but are they open to the public? If so, this would be a good case to display a good showing of police support....maybe even in uniform. I would also consider a counter suit option. What the fuck? Why not?

As GOD as my witness and as a WestSide copper where this BITCH lives and works, if I catch her DUI...she will be arrested and charged with everything that she is in violation. The WC may or may not like it, but fuck it. It will be a race to the computer to get that CB#

There's your probable cause! Wow. Why do we even bother? And she refused a breathalyzer. Why on earth would she do that?? Ummmm because she was sh*t-faced, thats why! And now she's gonne sue?? She knows damn well that she was drunk off her silly a$$! She should be happy that the judge let her walk, but now she's gonna pull this sh*t!? Unbelievable. I'll never forgive 24th Ward Alderman Sharon Denise Dixon for the shot she pulled on one of 010's very finest: P.O. Dannye Ward. Dannye, a stand-up guy well respected by all, was shifted from the area of 16rh & Pulaski to Little Village (Dannye no habla espanol) at the whim of this arrogant bitch. Former 010 Cmdr. Bea Cuello knows all about it.

I tried to persuade Dannye, a resident of the 24th Ward, to run for alderman vs. this nasty ----. Understandably, politics just ain't Dannye's thing.

Forced choice, I'd even endorse 025's "racist" Rodger Washington over that bitch Dixon for alderman of the 24th Ward.

To whoever asked the question about civil suits being public. The answer is "yes". The problem is this may never go to trial. Even if it does it won't be for at least a year. Those of us who have been sued (more than once for me) know you have to sit and wait. The waiting can be very agonizing.

The real question is who is representing the PO's? Hopefully this has been farmed out to a good law firm. The alderidiot has already admitted she was drinking. That is good new for the PO's. I say let it go to trial and pick a jury trial!!! The majority of jurors will side with the police on this one. A jury will see this as a politician getting off when a private citizen wouldn't have. Just my opinion.

Since she plead to the obstruction charge, she is likely precluded from bringing a Sec. 1983 action by the SCOTUS holding in Heck v. Humphrey. An arrest and a guilty plea or finding of guilt will not negate proximate cause for arrest in the civil case. See recent 7th circuit opinion in Jackson v. Parker involving a DUI arrest by a Chicag policeman in which the DUI was again dismissed by the court but the defendant was found guilty of the city ordinance violation of operating a B licensed vehicle on South Shore Drive. These police officers should be successful in filing and arguing a motion to dismiss and then sue the aldercreature and her attorney.

Had a case in front of a Crook County Irish Judge. The defendent's Irish lawyer had the case transfered from Br. 50 this this judge's call and branch. I new the fix was in when the lawyer knew all the court personnel like he owned the place. When the judge took the bench the defense attorney and judge greeted each other like they were best buds. After the trial the judge gave his ruling, not no probable cause. A "NOT GUILTY"! He put on the record that it is part of job to expect to get battered by the public, so NOT GUILTY! Guess what came next? Thats right a nice lawsuit from the offending shithead. Got to love the great judges Daley makes sure are appointed to the bench in crook county. Attempting to drive through a blocked off fire scene is not enough probable cause for a DUI arrest???????

90% of DUI arrests in the city walk as compared to 10% in the suburbs. Granted, your average CPD cop probably isn't as motivated, well trained or experienced to write them as a suburban cop, but its obvious that the "fix" is in. There might not be cash exchanged between the lawyer and the judge per se, but I'm sure those that contribute campaign money etc get favoritism. One DUI case I had, where the asshole had two previous and refused breath and field sobriety tests was continued 13 times. I told the states attorney not to notify me again that I would not show. She looked bewildered that I would say that. Its obvious to me that the 50 W. Washington does not take DUIs seriously, why waste my time and all the energy to get down there? You end up putting in 4-5 hours of time travelling and sitting for three hours pay to watch asshole walk? anyone can make a mistake and get a DUI, but they do this shit with people that have multiples! M.A.D.D. should do the research on this and call these fuckers out on this. Of course, somehow CPD would get the blame.

Anyone see this article?

http://archive.chicagobreakingnews.com/2009/05/ald-sharon-dixon-granted-drivers-license.htm

The article states that Dixon got her license back 4 months later because the judge argued that statements made by the officers involved contradict the DUI arrest.
Allegedly, the officers involved testified at the hearing that they told Dixon to get back in her vehicle and go home.

Based on that testimony, the judge gave Dixon her license back stating that it was improperly suspended.
