Illinois Supreme Court Decision

Here's the interesting section though:
  • Finally, it should be noted that today's decision will raise questions beyond the facts of this case. Because the court holds that residency has one settled meaning, and that meaning rests on a person’s intent, today’s decision will have implications for residency requirements for in-state tuition, residency requirements for municipal employees such as police officers and firefighters, residency requirements for school districts and other similar situations. This court should be prepared to address those issues as firmly and expeditiously as we have done today.

    Because of the breadth of today’s decision, we do not join the majority's holding that residency is the equivalent of domicile and that intent, therefore determines residency, even in the absence of any physical presence. Rather, we would answer the narrow question that was actually raised by the objectors in this case: Does a person lose his permanent abode if the [abode] is rented during the relevant residency period? To that question we answer "no." For that reason alone, we join in the judgment of the majority.
Looks like the door is opened wide to a challenge, and the ticket that embraces this opportunity might swing a union election shortly.

Apartment dwellers thrown out by eviction, foreclosure, or condominium conversion should, then, continue to be able to use that address as their legal address if they had "intended" to stay.

Hello SCC-land. Figured out the residency issue. I am an officer and have a two-flat in the city. I am willing to lease it to every officer in the city for $1 for a five year lease. We can fit over 10,000 people in it as none of us will live in it. This will afford you an opportunity to move out of the City, but by paying the $1, you can always say "I have the intent" to move back!!!

"Chicago Tonight" on WTTW had a good segment on the Rahm case. Two of the three panelists (the last was one of Rahm's lawyers so he was speaking politico the entire time) mentioned how this case will impact residency issues with officers, teachers, etc. Interesting.

I encourage all unions of the Department (FOP and the Sergeants, Lieutenants, and Captains) should send a letter to the General Counsel of the Superintendent and demand the Superintendent's interpretation of the Supreme Court's ruling and how it will impact the residency issue.

Granted, he will simply pass it off as he "does not engage in union issues."

So, send it to Management and Labor Affairs. Mandate they answer it.

They will state that it is not an issue yet as it is in the contact and the contact supersedes even G-d.

Still, push the issue. Piss them off. Challenge them.

Therefore, if a brave officer challenges the residency issue and disciplinary action is attempted, they will have the opinion of the Department already known.

What a crock of manure this here decision was that was handed down from the Supreme court. You have got to be pulling my leg. The law on the books firmly states the facts. But the Supreme court interpreted those facts to suit the big money people. They talk about corruption in Chicago and well, there you have it. I think I'll get a house in the suburbs now and move out of Chicago and claim my stake with the Supreme court. What a crock. The whole think stinks. Just like the local politition that forgot his guns weren't registered and had that law interpreted to his liking. I tell you, it just stinks. If it looks like manure and smells like manure.....hell, we just got all our feet stuck knee deep in it and haven't been kissed yet.

The new hires will be allowed to live outside the city in exchange for reduced pension benefits. You were REQUIRED to reside in the city as a condition for your employment. By the time court challenges are finalized your kid will be out of college.

Now that Rahm is on the ballot, it looks like all kiss assing that Master x3 and Ray Ray have been doing protecting him as his security consultants might payoff. Seems like Masters is building a power base in the Superintendent's Office by aligning all the units under the command so that as chief of staff; he will in essence become the old first deputy superintendent controlling the day to day operations of the police department. Which is a long ways away from what the chief of staff of superintendent's office use to do. The chief of staff use to be responsible for the day to day operation of the superintendent's office on the 5th floor only and not the whole police department. Masters is planning on remaining as the chief of staff for the new superintendent. Looks like the terrible experiment will not be over after jfed leaves.

Let's see if there isn't a new pension requirement passed that in order to "earn" credited time toward our pension, you MUST live in the city (NOT intend to return), AND in order to COLLECT our pension AFTER retirement, you MUST REMAIN in the city. So you can move out if you like, but it won't be counted toward your pension. He'll do it or something similar!

So how does that move out of the city look to you now? Emanual said he will discuss the residency requirement for police and fire. IF he is mayor, DISCUSSION OVER!

And btw, the sheep who are being convinced by the politicians and media that our pensions are destroying the economy are also of the belief that we should live in the city. NOTHING will change!

So that they live in a safer environment and have better educational opportunities, and then when they're finally done with school, and grown up,then move back to the city?

As you may have figured, it is my intent continue to live in the city AFTER my children are raised and given the opportunities of better school system.

What's good for the goose should be good for the gander. I would love to see this fly.

Following logic of ISC, a NYC parent can buy a studio apartment anywhere in Illinois, have their kid apply for UIUC, and claim "intent of residency" to obtain in-state tuition. Pandora's box has opened, and its affect on Illinois' university system could be significant given sizable out-of-state student enrollment.

In Wisconsin, ownership of a vacation property doesn't entitle household to in-state tuition at UW-Madison, which has significant Chicago-area student enrollment. Even if parents move into that vacation home, it still takes a year's residency AND employment to establish in-state status.

I believe Emmanuel should be on ballot, because the other candidates are very weak leadership and executive management material - including Chico. Chico's career history is solely public-sector entitlement and political patronage with little accountability or administrative flair, so a vote for him is still a vote for "business as usual" clout-meistering.

Otherwise, but leverage did Burke have over the likely next mayor? Neither Obama or Emmanuel have ever been beholden to Burke and his crew. ISC has Burke's wife, who's as corrupt as he. Problem is that Emmanuel is likely not to uphold his end of the faustian bargain that rammed through the ISC ruling yesterday via Burkes.

the real problem now is that he is the front runner and if he wins we all know what he wants to do with the pension--- moody has just reported that the state of illinois is currently in fifth place among all 50 states with unfunded pension liabilities--- illinois currently has close to a 7,000 dollar per person hit to become solvent---- OUCH !!!!--- good old rahm made 325,000 dollars a year sitting on the freddie mac board and what a disaster that was--- now he is magically a financial wizard and can cure all of our problems--- if this guy gets in we are screwed.....

I have always supported CPD and CFD to be able to live wherever they want to. However, "intent" hasn't helped any police or firefighters before this but now, but because of one clouted individual, the entire system has ruled in his favor to accommodate him. Interesting. And I think the ruling states that very clearly.

Can you imagine having most or a very large percentage of police and or fire personal living outside the city limits? Wouldn't that be nice! Nice to move out to the burbs. Where the schools are better. The taxes are a little lower. The neighborhood is better served. And so many more better things, too. However....for a moment...can you imagine a catastrophe happening in the city and there are no additional policemen and firemen available, because they live outside the city? In the event this ever happens, there will be no extra protection for the citizens. Those who are paid to protect the city from destruction will be stuck in traffic in order to help when needed. I don't want to imagine what would happen in the event that these men and women, who swore to protect our city, will have the ability to live outside the city limits. The bad dream is that I and many more citizens of this city will watch in horror as the city burns! Self destructs! When that happens, who will stand up and take blame? Who will be held accountable? Funny, I already know the answer!

Lets not forget that although the money for our pensions comes from us and from the city, the pension is controlled by state laws. Only our legislators can impose changes on the police and fire pensions, not the mayor or city counsel. This is not to say that the legislators cannot be influenced by the mayor of chicago, we all know that can be done. Then, do not forget that the recent pension reform legislation was passed and signed into law by Quinn over the strong objections of Daley and the mayors of other major cities in this state.At the channel 9 debates, both Rahm and Chico stated that residency will be on the discussion table.

There is that little issue of the affidavit we all are required to sign agreeing to the City's residency policy. No affidavit, no job. How does one get around that?

What politicians do and what they require us to do are two very different things.

Unlike the landed gentry who run things, we are like the tenant farmers who have no choice but to take whatever shit the ruling class throws down to us.

Michael Kasper is Rahms attorney AND our NEW Pension Board Lobbyists!!! Not sure exactly, but I heard he was getting paid $70,000 a year to lobby for the Pension Board. He was recently hired after ALL the pension board trustees voted to hire him.

Michael Kasper is also tight with Mike Madigan.

Does anyone honestly think Kasper is going to do anything for the good of any Chicago Police Officer, active, retired, & widows?

I don’t get it, why does our Pension Board need a lobbyist? It’s the FOP that submits our Pension Bills not the Pension Board and the FOP has a lobbyist.

How did this guy get the job, who recommended him, Daley???

KISS YOUR PENSION GOOD-BYE!!!

We will now have a Mayor to screw us out of our pension & and lobbyist that YOU pay from the pension fund screw YOU also.

This is the most important election of our time. Rahm has told POs to their face: "I will take away your pension and give you your money back". THAT IS HIS PLAN.

FOP made the right call on who to back , the Sgts Assoc too. As usual, the Lts. Assoc lacks the balls to take a stand.

While I am on the soap box, don't vote for a PO for Alderman just because he is a PO. That doesn't mean he will have our backs. Look at the man and see if he is an arogant self-centered ego maniacal prick without an altruistic bone in his body. You know, the usual politician.

Remember, Eddie Burke was once a copper that got his degree on the Department's dime. You see what he has done for us...nothing!

The most appalling thing to me is the content the Supreme Court justices displayed in their decision. Granted, I am not a lawyer, but the case is not so clear cut. The case they are basing their decision on is 150 years old. Things change. And no one knows the “intent” of the gentleman who tried to run for office 150 years ago and left the state for eight months.

The essentially pissed on the two Appellate Court judges interpretation of case law. However, these egomaniacs have been in their robes way too long.
They are ELECTED just like the other politicians. No system is perfect, but as we know by our aldercreatures, ELECTED just not equate to SMART.

The Supreme Court justices need a reality check; they need someone to put them in their place.

However, we cannot threaten them (and I would never advocate violence….because you will end up in prison and it would give them a larger pulpit to piss off of). We cannot ask them to clarify because they will not.

Instead, they get their charmed existence, their personal driver/assistance (not legal assistants, interns, clerks). They get a state tax-dollar assistant that drives them around.
Stay on that gig long enough and these people will get a pension from the state!!!! (as well as their former job. E.g. Chicago Police???

We elected them. When will the voters of Illinois understand that their vote does matter? We need to vote. We need to be a voice. We need to be a conduit for others to understand the hypocrisy of this State and the City.
Only then, only when we stand united as one will we truly make a difference.

The law of residency needs to be challanged, then overturned as it has been found to be unconstitutional. Then we can use residency as a bargaining chip in contract negotiations. (pension/insurance after 2013)etc. It would be the firsts time we acually have a chip in the game.

Is this a silver lining? If nothing else, we have just gained a bit of leverage when it comes to the contract and perhaps other issues. Rahm has said he is "open to discussing the residency issue" which is political speak for "nope, not gonna happen but how can I say I'm against it?", but now we have Illinois Supreme Court justices practically inviting us to challenge the residency issue as soon as we'd like.

Dear Friend,

Have we learned our lesson? Do we now know to nip aspiring, radical, charismatic Chicago politicians in the bud? We missed our chance once. Now a second chance is coming around again.

Rahm Emanuel - the most ruthless, aggressive, ambitious, radical, take-no-prisoners politician in America - is running for Mayor of Chicago. The bottom rung of his ladder. From there, it's the Senate and then the White House. This time as the boss.

Let's knock him off the bottom rung before he rises further. Stop him before his political career metastases.

His style? Do anything, attack anybody, adopt any pose to get elected. Sound like his mentor in the White House?

So now we have a chance to intervene and stop Rahm.

I know you probably don't live in Chicago. But we all live in the United States and, make no mistake, the presidency is Rahm's goal.

There is an alternative. Gery Chico, former Chief of Staff to Mayor Richard Daley, is Rahm's chief competitor. (Not counting former Senator Carol Mosley-Brown who conveniently forgot to pay her taxes last year). Chico is not ideal. He's no tea party activist. But he is honest. And he's to the right of Rahm. And he's running second.

Our goal? Force Rahm into a runoff against Chico. And Chico can win. And we will all be saved from Obama II in the form of Rahm Emanuel.

It's real simple. Did Rahm live in chicago or not? No he did not. He took a job in DC, moved his family there, rented his house, and has been living in DC for over two years. Residency in not temporary. It's not like Rahm left his family in Chicago and lived in a hotel. If Daley did not retire Rahm would still be in DC and would probably be there as long as Obama was president. Once again different rules for different folks.

We need to make note of who these judges are and look for them to get federal appointments or other favors after the smoke clears from this decision. You can bet phone calls were made with the "wink wink" and a smile. The stench of chicago politics is in DC.

Our only chance is Chico, who I will vote for, but I have serious questions about him. He is a creature of Eddie Burke, and the machine, which should raise red flags for all of us. He has made big money off all the connnections he made during his time as schools chief etc. They are all going after our pension, no matter what they say. Residency, forget about it. There are rules for some, and rules for others. This decision is a classic example of that. I have said it on this site before and will say it again, especially when shortshanks decided not to run. Be careful what you wish for. I dislike Daley as much as anyone here, but we may look back on his time in office as the good old days.

I dont know how often the alpha star query/employee search is updated, but I wonder if the department is keeping recent retirees on it.

How about department members who know of recent retirees check if they are still in CLEAR.

Two things. Very few peole are going to try and sell their house in Chicago right now due to the bad market. So there won't be much escaping for the next few years. They are counting on that for sure.
More importantly, if this interpretaton has always been the correct one and I was prevented from just having a rental place in Chicago and living and educating my boys in a better school district, why can't I be reimbursed by the city for the Catholic school tuitions I was forced to pay so my chldren wouldn't be subjected to inferior CPS educations in elementary and high school. HHHMMM?????

But the Supreme court interpreted those facts to suit the big money people. They talk about corruption in Chicago and well, there you have it. BTW a google search of "Illinois pension law court cases" (or words something like that) yields a handful of court cases in PDF format which overwhelming state that an existing pension CANNOT be 'altered.' So said Illinois courts, reasoning that the pensions are contractual, and any change would be a breach. Bankruptcy, or simply inability to pay out - that's a different story I guess.

Rahm is seriously considering mandating a city employee permit for non-residents of the city. This will be a tax on suburban residents workers for the privilege to work in the city. This way all the money they are making in the city can't all be removed. After all they are using all kinds of city services to work here, they might as well pay up. This is case is only about residency as it relates to running for elected office. As it stands this case does not change the residency requirement. However, should you choose to move out of the city and then get fired for doing so, this case will definitely be one that is brought up in your lawsuit to get your job back. I am not sure about you, but with the judicial climate as it is, I sure as hell don't want to be the test case.

If Rahm wins there will be a 6 month window to retire with your pension if you qualify. After the 6 months there will be the reduced benefits or a buy out of your pension contributions. One will have to figure out the many options. Do You have a family and young kids? What is your health situation and the health of the members of your family? How much do you have saved? What do you need to live a healthy and happy life style until the age of 80? This might be the way things are going to go anyways no matter who get elected as mayor. I still feel we are better off without Da Mayo!

I would hate for anyone to actually READ the law, but the definition of "residency" is different in the two statutes. In the one for city workers it requires "physical presence." This decision does us no good.

Of course, you can do what city employees have been doing for 150 years. Rent an apartment with six other cops, move your family to the suburbs and "live" in your apartment. Might be nice to have a crash pad in the city . . . Hell, my grandpa did this for decades while the family lived out in Barrington.

funny that the city fired a co-worker of my fathers from streets and san because they followed him home and determined that he wasnt residing at his home in the city and that he was residing with his girlfriend in the suburbs.....funny how something applies to some and not others. city is a joke.

Today, at the 009th dist., the city wide team was there. I asked the question concerning taxing our heath care for the coverage of "Obamacare".
They our aware that the city will be puting a price on dependent coverage that the city claims they pay. Next year you will be taxed on that coverage.The city is NOT taking out taxes on this! Please set aside money to cover taxes as the Feds. want thier money. Bella is aware of this. I informed him that most
members of this department are not aware of this. I felt that the F.O.P. should inform the membership of this due to some members will be have to pay the goverment extra taxes at the end of the year. He said he would bring it to the next board meeting! I feel that you need to know now that you need to set aside money for these taxes.Please dont blame the city or the F.O.P for this tax just prepare yourself on that Federal taxes WILL need to be paid for this next tax season.

However....for a moment...can you imagine a catastrophe happening in the city and there are no additional policemen and firemen available, because they live outside the city? In the event this ever happens, there will be no extra protection for the citizens. Those who are paid to protect the city from destruction will be stuck in traffic in order to help when needed. I don't want to imagine what would happen in the event that these men and women, who swore to protect our city, will have the ability to live outside the city limits. The bad dream is that I and many more citizens of this city will watch in horror as the city burns! Self destructs! When that happens, who will stand up and take blame? Who will be held accountable? That's funny, are these the same citizens jumping on the bandwagon to change our pensions? The same citizens that are always against the police? And the best part is you want us there 24hrs a day, but again we dont deserve our full pensions.? The "citizens" complaining that they dont have a pension, really? Are these citizens on call 24 hours when the shit hits the fan? Of course not, there is no argument not to pay what is owed the 1st responders. Why? Simple...because the "citizens do NOT want to be there when the shit hits the fan, they all want to be standing behind us looking for protection, more than willing to let us get injured, thats our job.

The city wants Quinn to change the demands on meeting the pension. They want to pay 80% rather than 90%. and they want 50 yrs rather than 25 yrs.
So since Daley failed to meet his obligations he wants again to change the rules so he still doesn't have to meet his obligations, this time for 50 yrs.
If this works, I think I'll call my credit card company whom I have a contractual duty with, and ask for an extention of 20 yrs interest free.

As part of my over all plan to enrich myself at the taxpayers expense, I am proposing a plan to have the city purchase 1 million dollar life insurance policy's on every juvenile arrested with the city being named the sole beneficiary (and by the city I mean me, candidate x,) I encourage all all police and fire personnel to get their insurance licenses so that they can write the low cost, tax funded, policy's as part of the arrest process for juveniles and collect the government paid premiums. Unfortunately, you're wrong, and several of us were fired every year for residency, until recently.

Lately, IAD has suffered the same shortages as every unit, and there is no residency team anymore. Don't get all excited, though; an irate ex-girlfriend or a spouse who didn't get what they felt they 'deserved' in the divorce decree can still drop a dime and wreck your life.

Between them and the obnoxious neighbor, that's how almost all of the cases come in.

Yes, im going through financial hardships right now.So im gonna go live for free at mom and dads coach house in Napperville for freeand rent my house out . Save about three years of mortgage,pay the taxes ,water bill and leave some stuff there with the full intent of moving back ,when I get on my feet. We r talking about saving around 40-50k.

This issue may divide the department more than the steady watch issue. Officers with real estate investments in the city and grown children will resist the lifting of residency. Younger officers who rent or have young children will benefit the most by the change, we should look long and hard at this issue once it comes we will be stuck with it.
