Rahm Off The Ballot?!

We are indeed living in interesting times:
  • Rahm Emanuel should not appear on the Feb. 22 Chicago mayoral ballot, according to a ruling issued by the state appellate court this morning.

    Two of the three judges on the panel said Emanuel does not meet the residency requirement. The judges reversed an earlier decision by the Chicago Board of Elections that determined Emanuel was eligible.

Interesting times indeed. As I said in another topic, let's see if Illinois Supreme Court Judge and wife of slick Eddie Burke, Ann Burke, can influence the outcome at the Illinois Supreme Court level. If twinkle toes Rahm is ruled against at the Illinois Supreme Court level, look for US Attorney General Eric Holder to green-light a Fitzgerald led charge/indictment into Eddie Burke, which in and of itself would be a wonderful thing. Wow, this is hilarious and can only take place in corrupt Chicago and Crook County. Let the good times roll.......

OT: Two St. Petersburg Police Officers were killed today in a shootout. God Bless these officers. This is the 24th of january and already 14 officers killed this year, nine by gun fire. It's going to be a bloody year so stay safe and be alert.

If you look back at my original posting regarding Rahm's run for mayor... I said that Rahm was looking for a graceful way to exit the Obama's White House...

What would be a better way for Rahm Emanuel to exit the Chief of Staff position than to run for the Mayor of Chicago. It was a graceful way to exit...

But that wasn't the only reason... Rahm fully knew he would be ruled ineligible to run due to not only living in Washington DC for the last few years but also renting out his residence. Here is a man who made millions of dollars in his new found Chief of Staff position but he still rented out his house? And not only rented it out but to a guy who wouldn't move out so Rahm could move back in? Give me a break, Rahm is much more street smart than to let that happen.

Next Rahm ran to Hollywood where his brother is an agent to the major celebrities there. Rahm raises over 10 million dollars in campaign funds... Not a bad way to make 10 million dollars without even working....

So Rahm now has over 10 million dollars he can keep (just pay taxes on) and he doesn't have to be the mayor of Chicago which is in deep deep deep financial trouble... and he now has a ton of people (voters) feeling sorry for him which will benefit him when he decides what he really wants...along with over 10 million dollars growing fast in some interest bearing accounts...

And who will probably become the front runner with Rahm gone? Gery Chico, Daley's personal choice for Mayor. Remember that Gery Chico is Daley's former Chief of Staff and will keep all the corruption from being exposed from the Daley years...

Didn't anybody wonder why both the Chicago FOP and the Chicago Firefighters Union backed the 3rd place Gery Chico in the mayoral race? Knowing full well how much everybody knows that Rahm Emanuel is a cut throat M'er F'er to anybody or any organization that goes against him? The FOP & Chicago Firefighters Union would be looking at political suicide if Rahm became mayor...
It didn't make any sense at all... until now.

I called this the day Rahm Emanuel announced his intentions to run for the mayor of Chicago... And I still stand by my prediction.

good news for us but tragic news for the rest of the country. very violent two days towards police officers. a 20 year veteran officer was shot and killed in livonia michigan and two police officers were killed and a us marshall shot and wounded in st petersburg florida. not to mention the 4 officers shot in detroit and the two officers killed a few days ago in miami and the officer just killed in dc last night... these are dangerous times be careful.

"A person is not eligible for an elective municipal
office unless that person is a qualified elector of the
municipality and has resided in the municipality at least one year next preceding the election or appointment ***." 65 ILCS 5/3.1-10-5(a) (West 2008).

He raised 11 millions, i'm sure he's going to buy plenty of expansive lawyers with that and send them to Illinois Supreme Court. But time is ticking away. Early vote is a week from today.

2 Police officers killed and 1 wounded while executing a arrest warrant in St. Petersburg, FA this morning. At this rate the country is set to double the 61 officers fatally shot in 2010.
Be careful out there and make sure we are training and practicing all the time. Never hesitate to call for another car or put your hands on people.

Residence = actually lived there




statute requires residence, so it matters little that he intended to come back. He has to actually hand his hat there. PERIOD. End of story. THere is an exception for VOTERS, but not for CANDIDATES.

Appellate Justice Bertina E. Lampkin wrote a dissenting opinion.

"I disagree with the majority's contrary conclusion that the candidate is not eligible to be on the ballot because that conclusion is based on an analysis of two issues --- establishing residency and a statutory exemption to the residency requirement --- that are not relevant to the resolution of this case."

Isn't it funny that Judge Bertina Lampkin is the only one that says Rahm should stay on the ballot?? This is the same Judge Lampkin that was at 26th St. and time and time again gave probation and no probation violations to the one of the shit bags that murdered Officer Valasquez in 007. It's all legit folks.

Eddie Burke's wife sits on the next court up. That court can decide not to hear the case and it is then a done deal.
Boy, if that comes to pass, I will believe that there is someone up there looking out for us.

The Illinois Supreme Court does not have to take an appeal, they could deny Rahm's application and that would be all she wrote. Also, the Illinois Supremes have the wife of one of Rahm's biggest political foes-Anne Burke.

I read most of the decision. It says a 1938 case distinguishes between "domicile"and "residence." But then the decision goes on to talk as though they are synonymous.

Watch out boys & girls... 10-1 Emanuel gets back on the ballot. The "fix" is on. This will show how crooked this city is. Rules only apply for us who are deemed inconsequential. There is too much $$$ on the line for Daley & his cronies to lose if Emanuel doesn't win. We can only hope there are actual people of out there who see through this farce and have the power to stop it. Kudos to you judge Hoffman.. City politics have never been or will ever be fair. But you would hope that the person who would become mayor would make the correct decisions to safeguard the welfare of this great city and citizens whom reside within it. Change is inevitable., but the correct change will only come from someone who has no ties to this city or the corruption that has crippled it. To those african-american chicagoans out there. All you have to do is to get across that city line, out where they got their own well water and not Daley Kool-Aid, and you suddenly find judges who can see what's plain to the average muffler mechanic.

O.T. 2 officers are shot and killed in a shootout in St. Petersburg, FL. One officer laid wounded in the house. The department used a vehicle in pounch a hole into the wall to rescue the wounded officer. Big difference when Inv. Airhart was left wouned with the FBI in charge. Police place a high value on life. Rahminator, annouced he was leaving the white house before Daley even announced he was not running again. SO, where was Rahminator going to do, what was his intent, when he already knew he sign another yr lease with his tenants. his wife & kids in D.C. with his kids already in school. So while Rahm Emanuel and his attorneys head to Springfield to appeal this afternoon's decision to toss him from the ballot, City Clerk Miguel del Valle now gets the top slot on the ballot for next month's election. Del Valle's name is followed by Carol Moseley Braun, Gery Chico, Patricia Van Pelt-Watkins and William "Dock" Walls III.

Below is video of the Press conference Emannuel held earlier this afternoon regarding the Appellate Court's decision. He's putting up the brave face here but would have loved to have been a fly on the wall for the stream of profanities he likely spewed when the decision was announced.

We don't make the decision if he is allowed on the ballot to become Mayor, the law interpreted by a judge does. This country's form of government is not a democracy where the people vote on each issue, we are a representative republic. But I suppose you want to go the route the current administration in the White House goes, which is around the law.

I do not like Rahm. on the ballot or not, I would not vote for him, nor in my opinion should anyone who is planning on a pension some day. Or is on one now.

That said, I do think he should be on the ballot. There is a provision in the rules which accounts for being in service of the country. regardless of whether you like his or his ex boss's politics (and I don't), he had a job that he was asked to leave by POTUS. He was asked to help POTUS run the country and agreed to do so. Yes, he could have said no, but chose, for whatever reason, to go. The chance to run for mayor comes up, he decides to give it a shot, gets penalized for deciding to work for the president. Seems unfair to me.

As to the appellate court, the two who voted him off owe their spots to Burke, as he was king of judicial slating when they came up for placement on the ballot. Burke is anti Rahm, so off the ballot he goes.

I read this blog often, and I hear about unfair and wrong decisions by judges and different courts. Lets say that one of us (PO Smith) had a case which was going in front of an appeals court with three judges. Lets further say that two of those judges were put on that panel with the blessings of a criminal enterprise like the gd's. I know, far fetched, but go with me for a minute. So PO Smith's case goes up, and the two gd judges say no go and Smith goes to jail. Would we feel that Smith got screwed, or he got a fair shake? Rahm did not get a fair shake.

That appeals process is part of due process. Due process is supposed to be about procedural fairness. This was not fair.

I'm voting for Chico anyway. Best of a bad lot.

Yes, the fireman's wife works for the Mayor.

This is placing the already short district down a car every tour, for what? Leaving more more for other officers, and endangering their lives.

There is no guarantee the Illinois Supreme Court will even agree to hear the case. In fact, it is a fact that they rarely agree to hear cases decided by the Appellate court involving city ordinance law, unless there is a gross "departure from the law", which there isn't in this situation. IF, it is heard, bear this in mind: There are 7 Illinois Supreme Court justices. Of these 7, 3are Republicans and 1 of the Democrats is none other than Anne Burke. Otherwise, all I can add is that Tom Hoffman was honorable, brilliant and a really good guy. He worked midnights in Area 6 Auto Theft while going to law school and left the CPD for greener pastures after the CPD paid for his education. He later became an Appelate Justice for the 1st District. If you check his record, he is widely respected by other jurists and members of the bar. God bless him.

Meanwhile, gimme a break. I don't need this shit. However, in retirement, I do have a healthy case of "don't give a fuck".

Based on indisputable facts, I totally agree with Justice Hoffman's plurality decision.

Hey Mr. Rocket Scientist: Mayoral and Aldermaninc elections in Chicago are "non-partisan." If you can't find a dictionary on-line, that means no party affiliation. Candidates just run and the winner has to garner 50% + 1 to win. You have now doubled your knowledge base.

One news clip showed that Rahm filed a Federal Income Tax Return using a Washington D.C. address.

Then later he filed an AMENDED RETURN showing a Chicago address.

Did he ever, and did he do it on time, file an ILLINOIS INCOME TAX RETURN?

Just curious.

Several newscasts, including George Stephanopoulos, said when the President left Washington for the holiday he was going to his “home state of Hawaii.”

The Illinois Supreme Court should go out, buy a few lattes, then issue a one line statement at days end that they see no reason to hear the case.

The Illinois Supreme Court does not have to take an appeal, they could deny Rahm's application and that would be all she wrote. Also, the Illinois Supremes have the wife of one of Rahm's biggest political foes-Anne Burke.

Sometimes, by law, we are guaranteed an appeal, and Rahm got his. I don't know if he was guaranteed that appeal, but he got it. We are never guaranteed a look by the Supreme Court. We'll see.

Stop doing business with the businesses that are empowering the evil doers with campaign contributions.

I mean really, think about it.

If someone in California or anywhere other than Illinois donates a few million to a Chicago candidate are they doing so to support the best candidate for the people? Or are they doing the exact opposite in the hopes that Illinois falls apart in which case California doesn't look so bad and may benefit with jobs leaving Illinois for example.

Follow the money trail.

We need to break this corporate lobbyist-political connection.

Until we do government will represent what is best for corporations and not for individuals and the corporate interest are not always congruent with the middle class taxpayers.
