Redistricting Coming?

We don't doubt that there is a wholesale plan to redraw all the beat boundaries at some point in time. The question is when does Rahm pull the trigger? Uptown Update has a clue to the future. Maybe. We're going to post the whole thing:
  • We received this from someone who wants to remain anonymous. We don't know how true it is. We trust this person has contacted the appropriate alderman about his/her concerns.

    "I am a police supervisor who has been studying the department's proposal to consolidate police districts, specifically 19 and 23 come the first of the year. When that happens us Uptown residents will barely see a police car. Now, the 2 districts have a total of 18 beats. When consolidated, the new district will have only 15 beats, a loss of 3-6 officers per watch.

    Uptown, now comprised of 3 police beats from 23, will become a single beat in the new district. This means a loss of 3 (on days) and 6 (afternoons and midnights) officers per day. And let's not even talk about the tactical teams who will now be working an area 3 times in geographic size.

    All alderman should know, and the public too, that the mantra from the police brass that "buildings" don't police is a smoke and mirror job. The further a beat car is from its police station, the more downtime that car must have. Larger geographic districts increase response time. Imagine someone shot in Uptown. The beat car is down on an arrest and the nearest other beat car to respond is at Western and Irving. This WILL happen.

    And please don't believe that ALL the police in 19 will be assigned to 23. If that happened, 23 would have the largest manpower contingent in the city - 400 some cops. That's more than in Englewood and Harrison, districts that lead the city in murders and violent crime. That will not happen. Trust me, if the consolidations go through, you will see a lot less cops on the streets.

    Finally, our neighborhoods (Uptown, Buena Park, etc) built a brand new police station with a state of the art lock-up (jail) that has been CLOSED by the department. All prisoners from 23 go to Belmont & Western for processing. How senseless. And it is an increase in downtime for the officers who have to transport prisoners across a larger geographic area.

    This will also occur on the near west side when 13 closes and the near south side when 21 closes. Closing a police station is a big mistake and all citizens should be complaining about it. And so should the aldermen. But they are not.

Prices for homes around the local Dunkin Donuts and Starbucks just started climbing.

Makes sense to me. If you combine two districts about half your officers are going to have to drive farther to and from their beats resulting in more down time.

Not to mention the $5/gal or more gas we'll be seeing.

Now combine that with the new speed cams that may cause grid lock on the streets and the transport time will become even more of an issue.Beware the unintended consequences.

The brass has it's eyes fixated on all that revenue created by the speed trap ticket machines -- are they ready for the impact it will have on commerce?

8. Confidential Arrest Classification

a.The designation of an arrest as confidential limits access to sensitive information within the CLEAR system to members of the rank of lieutenant and above. A confidential arrest status obstructs (shades out) the arrest record's sensitive information.

b. Members of the rank of lieutenant or above have the authority and ability to classify, view, access, or remove the Confidential Arrest status.

c. The classification of arrests as confidential include, but are not limited to, arrest incidents involving Bureau of Internal Affairs' cases, police shootings, government employees, persons whose status is sometimes categorized as a "celebrity", or other such arrests which may generate extraordinary levels of interest, whether internally or outside of the Department. The principal rationale for classifying an arrest as confidential is to prevent the unauthorized dissemination of criminal justice information.

d. Members will refer to the online Manual entitled "City of Chicago OEMC/PSIT Confidential Arrests" for detailed instructions for procedures concerning Confidential Arrest Reports.

'Uptown Sgt.' clearly hasn't examined the 'problems' of redistricting as closely as he's stated here. Both 013 and 021 have closed lockups already, so what's the big deal here? The cops in 021 will now be assigned to districts that have OPEN, WORKING LOCKUPS, like 002 and 001.
Get a grip folks, because it's all going to happen real soon. For those of you who won't be fortunate enough
to remain assigned to one of the Disneyland Districts,
all I can say is, 'welcome to hell.'

Never worked in 019 or 023, so wont comment on them. Did work in 002 over 10 yrs ago and it should be combined with 021. 002 is only a mile wide and should have been consolidated with 021 back when the last of the shit-hole cha buildings were knocked down.

Does anyone see the common denominator here? The districts being closed are of the quieter, tax paying based variety. Do you think for a second Rahm and McNutty would attempt closing a non tax paying, ghetto, revrun based district? Hell no.
He's pandering to them and wouldn't dare want to upset or irritate them. It's much easier to bend over the legitimate

O.T. Hey S.C.C. someone needs to bring this to light. People wonder why coppers are reluctant to any pro-policing anymore. Well when you have cowardly, balless supervisors, it's really not too hard to understand why. In the category of unfucking believable, this past sunday, a 007th district tact team executed a search warrant. The search warrant was written for the 2nd fl. Due to shitbird John Doe's description of the building, the tact team hit the 1st floor apt. instead of the 2nd fl. The way the apartments are laid out, you have to go up several steps to hit the 1st fl. apt. which can easily be misconstrued as the 2nd fl, since evidently there is also a garden apt which could appear to be the 1st fl.

Anyways, they hit the wrong apt. and bust down the door startling an older woman and two younger shitbirds in the apt. There is however a couple dime bags of weed in plainview on a table and one of the younger shitbirds admits that it's his weed. Well the old lady starts beefing big time about her door and how the police unlawfully entered her apt. Soon after, the team realizes that they hit the wrong apt. and should actually be going to the apt. above them.

Simple to fix right? Cover your ass and lock up the shitbird who admitted that the weed was his. Then you tell the beefer to Go Fuck herself about the door. After that you go upstairs and execute the search warrant on the correct apt. Right?

Fuck no!!! The fucking cowardly 007th Dist. Tact Lt. C. and their equally cowardly Sgt. T.W. (who was a wonder kid, bosses son, that goes right to tact in 008 after his probation, and shortly thereafter goes to Fugitive Apprehension for 4 yrs., then makes Sgt. with about a grand total of approx. 5 1/2 years on the job and gets a tact team in 007 right away. This guy doesn't know his ass-from-a-hole-in-the-ground about being the police or supervising, and has no business being a tact sgt. but that's another story) panics when the old lady starts screaming, apologizing and kisses her ass. They then order the PO's to not arrest the shitbird and leave the apt. making no arrests and even leaving behind the illegal contraband in the apt. Unfucking real right? Well it gets worse.

The 007th Tact Lt.C, goes upstairs to the correct apt. knocks on the door and tells the occupants that they are looking for the target because of drugs. No search is conducted, they leave and head back to the station and the mush Lt. actually fucking takes out a C.R.# on the poor po who was the affiant on the search warrant for making an honest mistake and hitting the wrong apt. Are you fucking kidding?!?!?! This is your reward for trying to be a hardworker?

Way to back up and lookout for your guys LT. C. and Sgt. T.W. Besides not covering their asses, you could have potentially jammed up the poor PO's even further. You can see it now IPRA- "Umm... Officer, why did you not make an arrest or at least inventory the illegal drugs after you hit the wrong apt. on the search warrant?"

How the fuck do you cover yourself now? How unbelievably pathetic and dangerous are these supervisors? Way to protect your PO's!!!! Why would anyone want to do any fucking work for these incompetent,and balless, POS? (Btw, side note: Sgt. T.W. once made a PO on his team burn a slip for raising money for fallen coppers and running in the Run 2 Remember, what a douche!)

These 2 jagoffs have got to go before they hurt even more coppers!!!!

CPD = Clear and present danger for your mental and physical health. Let me explain it to you guys yet again... Less cops means less arrests,less OT,less reports, less Cr numbers and less law suits to fight, less pensions to pay out, less health care, less promotions etc...A by-product of that rahm/daley strategy is that you the cop will have more STRESS. The CPD is in institutional shock! This job is no more. If you try to ignore that fact, it will eat you up like the most malignant cancer.Example: They will make it HARD for you to make arrests, they have already made it hard for you to WANT to make arrests. You have to organize locally and demand participation in the drawing of new beat boundaries, demand the retention of tactical teams and demand the retention of community policing personnel. You're right about the ignorance of local Aldermen about the consequences of these district consolidations. Most of them weren't around the last time beat realignments were done, and I know for a fact that they have not been informed about the certain loss of tactical team coverage. Travel times of officers assigned to outlying beats will rise to the point that they'll become ineffectual. Consider officers having to travel from the new 12th District station, South of Roosevelt, to what is now Beat 1311, in South Humboldt Park. Yet, this new burden , as great as it'll be, will not compare to the loss of tactical teams, and that is something about which local residents and politicians are completely uninformed.

Wait until you see what they do with the D-unit. Even now, if I have to travel from the unit to interview victims or check addresses, it is a 2-3 hour excursion. I will be able to do maybe 2 interviews a day if I am travelling all over bumfuck Egypt. I think I may have just made my last arrest. Fuck 'em. And you younger det's, have a plan for travelling from your home near O'Hare to Area 1 or 2.

I'm calling BS on this one. Uptown is not a far drive from 23 and if manpower per shift is reduced then it is the allocation of manpower that is to blame. Not the location of the district.

And to drive "farther to the beat" I think the city put lights and siren on each squad car if you need to get somewhere fast. What it could mean.... and dare I go there, is increased work for a slow northside district.
Go listen to the zone in 6 or 7 and then come back and tell me how you "need manpower". I'm not buying this dog and pony show one bit.

don't feel sorry for any of you idiots out there still being the "police". where did this happen again? oh, 007. wish you guys spent all that time and energy protecting the homefront. sorry, don't care what happens. bunch of hair gels fighting for their tact team spot being led by a hair gel sgt. and I know who you are talking about.

this department needs to have a mandatory time on the job before you can test. at least 10 years for sgt, 10 years for fto, etc. i always look around at the old timers faces in roll call and try to figure out what they're thinking when one of our three sgts (made with 5 years) are blabbing their gums about going out there hitting the street being the police. and they are all f'in wussies.

Holy fuck! Why the hell would the tact lieutenant in 007 take out a CR#? And for what? Shit like that happens every once in awhile. Its no big deal, the affiant made an honest and understandable mistake. There is nothing to take out a CR# on. Being a supervisor myself, I'm appalled. Your supposed to support and protect your troops. Not try and jam them up unnecessarily and for no reason. It was a mistake. No wonder supervisors get a bad name. And how do you not make an arrest or at least inventory the drugs? I hope that doesn't come back later and hurt the poor coppers.

Sounds like that tact sgt. In 007 has no business being in charge of a tact team. This is what happens when you make rank with no time on the job or experience. If you don't know what your doing, or how to look out for your guys, then you should be riding the desk or another clouted admin. spot. This way no one gets hurt or jammed up.

I feel sorry for the po's on that tact team in 007. Watch your ass and ask another supervisor whom you can trust and knows what to do, the next time shit hits the fan. I mean this wasn't even that serious an incident. What's gonna happen the next time, God forbid, if it was actually something to worry about?

Hang in there guys. I can't blame you if you don't wanna do shit, especially if your supervisors don't have your back or know what they're doing. I would feel the same way. These supervisors should not be in charge of a tact unit or anyone else for that matter.

Fuck no!!! The fucking cowardly 007th Dist. Tact Lt. C. and their equally cowardly Sgt. T.W. (who was a wonder kid, bosses son, that goes right to tact in 008 after his probation, and shortly thereafter goes to Fugitive Apprehension for 4 yrs., then makes Sgt. with about a grand total of approx. 5 1/2 years on the job and gets a tact team in 007 right away. This guy doesn't know his ass-from-a-hole-in-the-ground about being the police or supervising, and has no business being a tact sgt. but that's another story) panics when the old lady starts screaming, apologizing and kisses her ass. They then order the PO's to not arrest the shitbird and leave the apt. making no arrests and even leaving behind the illegal contraband in the apt. Unfucking real right? Well it gets worse.

Are you fucking kidding?!?!?! This is your reward for trying to be a hardworker?

Way to back up and lookout for your guys LT. C. and Sgt. T.W. Besides not covering their asses, you could have potentially jammed up the poor PO's even further. You can see it now IPRA- "Umm... Officer, why did you not make an arrest or at least inventory the illegal drugs after you hit the wrong apt. on the search warrant?"

There will be a limit on how many po's the new 023 can carry. Redrawn boundaries would make those outer border districts wider and guess who gets the excess manpower from 019/013....the neighboring district. Not much to look forward to if you're low on seniority.
The Dept could care less how long it will take you to get across town from station to your assignment. And if you need a wagon transport, wait in line-only one wagon per district & the crosstown lockup is backlogged. D/C's & W/C's will be bitching up a storm like they did when 012 closed their lockup, feud between 001 & 012, and eventually 011 because of the influx of arrests. Never was there a 'happy' lockup keeper.
Stupidity on the part of this Dept never ceases.
I think they'll wait on this whole process until after the g8 riot.

Heard this one today for those in 023/019. Plan is is to consolidate both districts. Plan b is to Eliminate positions. For example, since 023/019 are one dist. Their is only one desk, so 3 Sgt.s are not required. One caps office, 1 Sgt. Not needed. Eliminate 3 tact teams, 3 sgts. Not needed. So far the new 023/019 is 7 sgts. Over staffed. This can be applied to PO,s as well. their are 23 sgts assigned to 023 and 26 to 019. At total 49 sgts. Now 7 sgts spots no longer needed the new 023/019 needs only 42 sgts. (I'm sure these numbers are going to increase). I cannot think of a single district with 42 sgts. Assigned. No, I think all the bid sgts. From 019/023 will stay a total of 30 sgts and the rest are management , they will be gone. Then the following yr. All sgts. Will bid and those who don't have the time will then be the management sgts in the district. Same goes for PO,s.

Read carefully:

15 Beats in a COMBINED district made up of TWO INDIVIDUAL districts. 18 beats in two individual districts becomes 15 beats in the new combined district. That is what is in store for the new 019/023. Three beats eliminated off the top. That is at least 18 police officers and three sergeants gone also.

The new beat maps showing the redrawn beats are already in the hands of the Command Staff. They have been seen by certain industrious patriotic police officers who will remain unnamed.

I would imagine that the same will happen in 012/013 and 021 and whatever district that 021 merges with.

The Jefferson County, Alabama Bankruptcy case just hitting the MSM is the result of a Chicago/cook-county-like environment that initially borrowed/financed the complete rebuilding of the sewer system. Because of corruption, it had to be re-financed several times, and each time the clouted, corrupt ones profited immensely from the said refinance!

Could we potentially suffer the same fate with a Rham initiated rebuild of our sewer system ?????

This closure and the eventual re-assignment of some of these office will help solve the summer manpower "crisis" in Area 2. The problem was solved this summer with the 90-day detail where officer could not move around, but, when the detail had to end. Then bid spots were opened up mostly citywide. Most officer were trapped in Area 2, but with retirements, medical, military leave, and IOD the city needs more and more bodies to do more and more with less. But, at some point the city will just "boil" over.

Citzens in these areas should start taken proactive measures to protect property and lives now by staying home on weekends, working from home, and not staying out too late to reduce the chances of being the victim of a theft or a robbery. As the police won't be around in these nice areas to watch your "stuff" for you.


When the G8 and NATO comes around the taxpayer will become the real 99-percent, with no police protection as everyone will be dealing with the REBELS downtown and protecting the confrence attendes including POTUS.

Another interesting point. on th e15th of this month there will be a community meeting about the merger of 19 and 23 to be held at Lake View High School. Of course it would be of interest to off duty police officers working in those units to be there. However, it is at the same time as retirement parties for 19 as well as A/3, which might limit police participation. At this stage of the game I can't help but wonder if it was scheduled that way on purpose.

Wrong, you made an unlawful entry into an apt, yes it was an honest mistake, but a mistake none the less; you do the sheet, get them a new door, and admit the mistake.

Yes you can then serve the warrant on the second floor, where the warrant is written for, but why bother? he heard you down stairs and flushed or got rid of everything anyway. The error falls on the C.I. who failed to give correct info to the affiant. Why tell thew people in the wrong apt to "go fuck themselves?" if your door got hit accidentally you would raise holy hell, and rightfully so. So they had a little weed, who doesn't in the hood?

Stop doing warrants and you won't have this problem.. Yes you will get sued, and the city will cover it based on the error in the warrant, suck it up and move on. Oh, and did I mention to quit doing warrants??

I've lived and worked in 019 for many years. No, we don't have the volume of calls as out south. We still have bullets in our pistols and still get shot at. I saw Rick Francis every day until he was killed a few years back right in front of the station. Early in my career Richard Clark was killed at the beginning of an HBT incident. John Lyons was killed in the line in a police car accident.

No, it isn't 6 or 7. If it was I'd be somewhere else. If I couldn't carpet bomb the damn area I wouldn't want to work and for and deal daily with what is essentially the enemy, an armed insurgency that only vaguely resembles human beings.

If you like your 6th and 7th district I urge you to stay there and enjoy. I'll be retired next year this time no matter what.

Here are the facts: The Police have no duty to "protect." Go look it up. The (most-recent) reference: Castle Rock.

This case was about a woman with a protective order against her estranged husband. The estranged husband ultimately murdered all three kids, then died in a shootout with police.

The United States Supreme Court ruled that there is no duty of protection toward any particular citizen by the police.

A previous poster was right, if you hit the door on a search warrant and it's the wrong apartment, then you are protected under the color of the law. You can make the arrest if you want, we all know that it will get tossed out due to the amount, but they should have at the very least inventoried the drugs. Technically you are supposed to take some action if you observe illegal narcotics, not turn your back on it. Like I said, at least inventory the stuff at the bare minimum.

I would leave the tact team or not do shit til those bosses are gone.

To the guys in 007, keep the faith. Good for you if you guys want to go out, be the police and work. There is nothing wrong with that, just do it for the right reasons and better bosses. O.T- All this talk about closing districts to free up more police, why havent they even looked at IAD-Confidential Unit. Watch police that live outside the city, for what? They dont fire them, they just keep sitting on the house or wherever they are supposed to be for months and months, no discipline action taken. So the officers continue to shop and do whatever they can get done in the 6-7 hours they are on the clock and then go home to start all over again. WTF! Another interesting point. on th e15th of this month there will be a community meeting about the merger of 19 and 23 to be held at Lake View High School. Of course it would be of interest to off duty police officers working in those units to be there. However, it is at the same time as retirement parties for 19 as well as A/3, which might limit police participation. At this stage of the game I can't help but wonder if it was scheduled that way on purpose.

There is however a couple dime bags of weed in plainview on a table and one of the younger shitbirds admits that it's his weed. Well the old lady starts beefing big time about her door and how the police unlawfully entered her apt. Soon after, the team realizes that they hit the wrong apt. and should actually be going to the apt. above them.

Simple to fix right? Cover your ass and lock up the shitbird who admitted that the weed was his. Then you tell the beefer to Go Fuck herself about the door. After that you go upstairs and execute the search warrant on the correct apt. Right?

Covered under the law in civil court maybe, where they will certainly end up; the city will have to eat this one and settle, but as far as locking people up after hitting the wrong door? sorry but aside from a case report and in,iventorying the weed, that's it, you have no probable cause to arrest based on hitting the wrong door; this wouldn't get past the watch commanders que let alon a pc hearing. You made a mistake, take the hit, learn from it and move on. Again I ask, did I mention not to do warrants?

P.S. I agree no cr should have been pulled, city fixes the door, dope inventoried, and then wait for the beef and civil suit..

HERE IS A QUICK LESSON IN PROBABLE CAUSE:

FIRST THE DEFINITION WITH A LITTLE CASE LAW TO BACK IT UP:

PROBABLE CAUSE

A reasonable belief that a person has committed a crime. The test the court of appeals employs to determine whether probable cause existed for purposes of arrest is whether facts and circumstances within the officer's knowledge are sufficient to warrant a prudent person to believe a suspect has committed, is committing, or is about to commit a crime. U.S. v. Puerta, 982 F.2d 1297, 1300 (9th Cir. 1992). In terms of seizure of items, probable cause merely requires that the facts available to the officer warrants a "man of reasonable caution" to conclude that certain items may be contraband or stolen property or useful as evidence of a crime. U.S. v. Dunn, 946 F.2d 615, 619 (9th Cir. 1991), cert. Denied, 112 S. Ct. 401 (1992).

It is undisputed that the Fourth Amendment, applicable to the states through the Fourteenth Amendment, prohibits an officer from making an arrest without probable cause. McKenzie v. Lamb, 738 F.2d 1005, 1007 (9th Cir. 1984). Probable cause exists when "the facts and circumstances within the arresting officer's knowledge are sufficient to warrant a prudent person to believe that a suspect has committed, is committing, or is about to commit a crime." United States v. Hoyos, 892 F.2d 1387, 1392 (9th Cir. 1989), cert. denied, 489 U.S. 825 (1990) (citing United States v. Greene, 783 F.2d 1364, 1367 (9th Cir. 1986), cert. denied, 476 U.S. 1185 (1986)).

ANALYSIS: (I'll try to keep this short)

The officers accidentally hit the wrong apartment, but they were acting in good faith. (although, one could also argue that even if they hit the wrong apartment on purpose, they still had probable cause to make the arrest).

Once inside they observed suspect cannabis in plain view.

Then an offender steps forward.

That means they had a reasonable belief that a person has committed a crime. (somebody had some illegal pot in the house)

and

circumstances existed within the officer's knowledge that were sufficient to warrant a prudent person to believe a suspect has committed a crime (A CONFESSION!)


Now, could all of this be challenged in court, sure. But would the officers be liable in any way, NO!

Acting in good faith, they happened upon a crime (pot) and immediately identified and offender (confession from dumb-ass).


If they accidentally hit Jeffrey Dahmer's house should they turn around and walk out the door?

Probable cause is probable cause!


Based on the facts given about the entire warrant incident,
The offender should have been taken into custody and the suspect cannabis inventoried.

The warrant should have then been executed on the 2nd floor.

We also have a number to call to get city carpenters to come out and fix the door on the first floor; they come out within 24hrs.

As far as the CR, I don't see any reason to obtain one based on the facts given here.

Then again, I wasn't there on the scene.

not that they have bothered to say what sort of extension will be allowed--Will it be to your rdos before and/or after the segment?..of course the current strict limit on extensions in patrol only applies to most members on the watch-- not lts, capts or special officers

To the 07 search warrant discussion. The Lt did not have to obtain a CR# on his own police officer unless the owner/occupant of the apartment that they hit in error demanded one. Then the CR# could have been answered later and justified. The officers hit the wrong apartment in good faith based on the information they had. As long as they did their homework on the place the best they could, they are covered under the law. They should have arrested the individual that had the weed. It was not only in plain view but the subject in the apartment openly admitted ownership.

Covered under the law in civil court maybe, where they will certainly end up; the city will have to eat this one and settle, but as far as locking people up after hitting the wrong door? sorry but aside from a case report and in,iventorying the weed, that's it, you have no probable cause to arrest based on hitting the wrong door; this wouldn't get past the watch commanders que let alon a pc hearing. You made a mistake, take the hit, learn from it and move on. Again I ask, did I mention not to do warrants?

P.S. I agree no cr should have been pulled, city fixes the door, dope inventoried, and then wait for the beef and civil suit..

So you're saying that if you hit the wrong door and find .... let's say a bunch of guns on the table, you don't make an arrest? What if you found someone being held hostage, taped up to some chair? You still don't make an arrest?
You see what i'm getting at? Once the mistake was made, ok there's nothing you can do about that part, but once you find a crime being committed in front of you, then it's your job to enforce the law not look the other way.

Just a bit of info for you out there interested in the beat manning factor. When we got our first contract in 1981 the manning factor was 1.5. Hence the 3 men assigned to a car per period. As of now, with increased furlough days, baby furlough days and cu the manning factor is 2. Meaning it really takes 4 people to man that same car. So if the new 023 loses 3 beats to realignment that is a total of 36 POs off the district rolls. Not to mention rapids and inside staff. MORE WITH LESS.

Have you ever tried to drive from the South end of 023 to the North end? After dodging the perpetual construction and heavy constant traffic, you hit about 3 or 4 diagonal streets with the most screwed up traffic lights.
Now lets talk about the sirens you speak of... try explaining how you wrecked that lovely Tahoe when going lights and sirens for a panic alarm or any call for that matter?
The important matter of all this is officer safety. Responding to a call from a fellow officer could be dangerous for the responding unit as well as those waiting for back up.
Now what's all this talk about slow district vs busy district?.. Really? I've worked south, west and now north, they all have their issues! I have actually worked just as hard in the north-side dist as I did west and south. Less volume for sure, but most of those calls in the ghetto are BS Shithead vs. Shithead, so who really wants to drive like a bat out of hell to go help Pookie and his 5 baby mamma drama shit?
Just because you work in a busy dist. does not mean you are better than any other officer. I still like dog ass police better than 3rd generation link card, he was working on his GED, SSI gettin, baggy pant wearing, the world owes me a living bag of shit!

1. They blew it. They hit the wrong apartment. It happens, but when it happens, you man up and admit it.

2. The lieutenant, or anyone aware of it, is OBLIGATED, by general order, to report 'wrongdoing' within an hour. Better that it's your unit investigating than the witch-hunters.

3. Anything found in the wrong apartment is 'fruit of the poisonous tree'. It would be thrown out in court. It wasn't in plain view, because you TECHNICALLY never could have seen the inside of the apartment, except for the accidental illegal entry. This is to protect the innocent from the 'oopsy' excuse of "oh, we so silly; we hit the wrong apartment, but we found all this ---". (The moral dilemma, of course, is 'do we inventory the guns, bomb, pile of grenades in the interest of public safety and let the court determine the disposition of the guns, bomb, pile of grenades'?)

4. And good luck mouthing off to the lady whose apartment you wrongly hit. Were you raised by wolves? If another cop broke down my mom's door in error, I'd expect him to sincerely apologize, like any normal human being who made a mistake would do. Make nice. It's easier to make and keep a friend that way.

5. A review of search warrant procedures, before you serve your warrant, should also include one sentence on how to inform an owner/tenant to get payment for their damaged door. Being embarassed about hitting the wrong location is no excuse for not simply telling the lady what the procedure is. It wasn't HER fault you hit the wrong place. It's yours.

6.Which takes us back to number one. Be adults and own your goof-up. It's not the first, or the last, time it'll happen. Even we make mistakes, and in the grand scheme of things, this wasn't a big one. No one got killed, abused, scarred for life (except your pride), or harmed in any way beyond maybe taking a day or two.

Just behave with a little dignity and do the right thing, instead of trying to justify having done the wrong thing.

Re the 007 search warrant post. The affiant will not be liable in civil court because his actions were "reasonable" given the circumstances. Also he would be indemnified in a civil suit because his actions were within the scope of his employment, which is how the Illinois statute reads. This is simply a case of john doe giving bad info, and its all on him not the officers. To those of you who say younger officers or those of us who like to work are the stupid ones, I won't even dignity you with a response. Stay safe.
