Lawsuit Reinstated

  • Mark Geinosky's federal lawsuit against the city of Chicago and eight of its police officers is back on, after the Seventh Circuit Court of Appeals on Wednesday reversed lower court's decision to throw out the case.

    Calling Geinosky's allegations of harassment through two-dozen bogus parking tickets "troubling," the three-member panel remanded the case back to the district court, saying Geinosky and his lawyers sufficiently argued he was singled out by officers who wrote the tickets.

    The ruling, written by Judge David F. Hamilton, said that at first blush, the case might seem like a good candidate for dismissal by the district court.

    "A closer look at the alleged facts, however, reveals a disturbing pattern," Hamilton wrote. "Absent a reasonable explanation, and none has even been suggested yet, the pattern adds up to deliberate and unjustified official harassment that is actionable under the Equal Protection Clause of the Fourteenth Amendment."

And the fallout?

  • Late last year, Superintendent Garry McCarthy moved to have four officers fired for their alleged involvement in the case. Two of those officers are scheduled for a hearing before the Chicago Police Board on April 30.
With the lawsuit back, guess what the outcome will be at the Board.

It seems that the officers were writing these tickets to help out another cop over some personal business. If they did then I think a suspension would be more than sufficient. Firing these cops is way over board.

This may take some forensic document examination.

An officer can leave his/her ticket books in a squad car or roll call room while doing something. They could be picked up by anyone with a grudge who was stupid to write those tickets.

These cops are guilty of nothing more than doing what we all did in the unit, leave our stuff in our squad cars that we used everyday. 1 midget asshole, who we shall call TRP, took advantage of that and some got good cops in this position. Most people don't know the TRU facts about this incident. There was really only one jag off officer involved. Unfortunately this prick wrote all these phantom tickets with other officers ticket books which were left unsecured in police vehicles. Believe it or not this prick is still on the job and never even took a day for this yet all the officers whose books he wrote out of are set to be fired. Word to the wise, secure your ticket books because there are cutthroat weasels like this in a roll call near you.

I wish this case could be clarified better. I've heard everything from that one P.O. stole the others ticket books and wrote the tickets with-out them knowing, and I've heard that each officer was knowingly involved. I just wish we could all get the real story, because I'd hate to see P.O.'s get fired if one idiot stole their ticket books & wrote tickets without them knowing.

I worked with all the officers, they were not friends and for the most part did not work on the same teams. Some ASS HAT PICKED UP THEIR UNSECURED BOOKS AND WROTE OUT OF THEM.

Anyway, False reports, Rule 14 will get you fired. Went from 10 days to fired under Weis and it's not going back. Get it in to your heads: "airmail" tickets will end your career. I can't think of a more stupid or more embarrassing way to go.

Well if the Department had moved on this EARLIER, they probably could have gotten away with a suspension....now...bouncing back from the appeal court, hope for the best and expect the worst. There are cameras and recording devices out there everywhere....common sense will keep you safe. Try it you might like it.

Look behind the desk at any station. There is a box full of out of date ticket books. If you pre-sign those tickets, then put them in the box because they are out of service, it is no problem for an unscrupulous individual (PO or cleaning person) to then issue those tickets to anyone they want to and the tickets will be on YOU. It is my understanding that some of the coppers with police board hearings were off on the days that some of these tickets were issued. Please DO NOT pre-sign your tickets. And write canceled on any individual tickets that you put in the box. It will save you a lot of grief. Thanks asshole who put innocent coppers on the hook for your bullshit.

13 of the 24 tickets were issued by the same cop, nearly all sequential from the officer’s ticket book. Which means the only vehicle the cop writes tickets for is Geinosky’s. Even after the Orland Park man traded in his Toyota Highlander in September 2008, the tickets continued to roll in, issued to the old plate number—even though he took the plates off the vehicle and stashed them in his garage. Someone, he said, is out to get him. And he wants to know why.

Shaved had a post on this guy. I believe SCC originally commented about this when it hit the net/news in 2009.

And this is a guy from Orland Park......Getting over 26 tickets in under 20 months for the same area of West Englewood?

Sorry about the long post SCC...but this is one of those things that should scream "DON"T DO THIS EVER" to a police officer in this city. Because people love to whine about the parkers they get even if it was for the Right Reason.

It's pitiful that because it's a heater case the one tact officer who has an excellent reputation has nothing to do with any of these guys may lose his job cause he left his ticket books in his car and some pos copper wrote tickets out of his books. Should he get time for leaving the books in the car. Absolutely but fired no way! Sorry hh that all the years of ur excellent police work has come down to this! In a court of law u would have to be proved guilty beyond a reasonable doubt. But for us officers we r guilty if it's a high profile case regardless Look at cozzie!

Not only did they write hundreds of dollars worth of tickets, but after not knowing they were written you're talking about thousands of dollars in fines, boots, inconveniences....sorry I support you guys as much as possible but not the ones who do stuff like this. You shouldn't get to screw with regular people's lives and get off with a slap on the wrists and write it off to helping a cop out with a personal problem. These are the police officers who yell “we are the police!” (Sometimes they do yell “we the police!”) The implication of their words is that they are police officers and therefore they can lie, cheat, and steal. But it never ceases to amaze me that, even with video cameras everywhere and tracking mechanisms for most activities, police officers still risk getting into trouble for something that is not worth losing their jobs for. But I digress; I prefer to keep my job along with my great benefits while still assisting the public.

That's exactly what happened and it's sad. The problem is they kept with their not believeable story that all their books we taken by one guy who wrote all the tickets. It's to bad that the a-hole that got them in this mess over a woman is still on the job.

The accused officers never wrote those tickets.

But there were police officers who did. And they never manned the fuck up. Beating them into the ICU would only ensure the accused or friends of the accused a lengthy stay at a LA prison.

No one is going to convince me that several of the involved coppers just left their ticket books in squad cars. Perhaps someone left a book unattended, but several, over the course of a year? And this rouge copper just happened to always find unattended books and wrote off them. That ridiculous. It is highly unlikely that handwriting or other forensic testing will be done. Just remember, these admin cases are based on a preponderance of evidence, and I'm sure that level exists.

There are just a few simple things to keep in mind in today's environment to keep you out of trouble: don't do childish, stupid things; don't leave the equipment you are responsible for unattended; don't steal; don't bitch-slap people because it makes you feel better; DON'T WRITE FALSE REPORTS. Who cares if your case gets tossed in court? lying on a case and arrest report, or even a ticket, to make it sound better (drop cases) isn't worth getting fired over or worse, getting indicted. COMMON SENSE prevails.

I am very skeptical of the claim that some officers did not know that their ticket books were used by others. Mayso. Sounds far fetched, but maybe so. Anyway, the standard of proof in a work related trial is far less then needed in a court of law. this case is going to trial in federal court and all of the officers involved will have to testify under oath in a deposition. Lie on that and they could be sitting next to Burge in jail.
On another note, the case of Daleys nephew will soon be heard in a special grand jury by a special prosecutor and most people believe that there was a coverup, by the detectives and by the prosecutor. The judge's comments are not favorable to the detectives involved in this matter. Another stain on the department.

For the writers here who say they have the " facts" about who wrote the tickets, have you made your statement to IAD in an effort to save the jobs of your supposed innocent co-workers? If not, why not? Have you presented your evidence? This case is going to federal civil trial and everyone involved will undergo a depostion under oath, not like some interview at IAD. You say handwriting experts? Well that is possible. Not just your career and job on the line, but your financial future and possible jail time of you perjure yourself. As always the coverup is much worse then the crime.

I agree that there is no way that many officers accidentally left their ticket books in their squad car and one bad cop kept finding ticket books in every squad car he drove.

It sounds like that was the initial story, which didn't fly, and then the one bad cop came forward and admitted he asked the other officers to write the tickets.

The lying compounds the severity of the original allegation. This victim is gonna win.
