Um, What's This?

  • Chicago Police officers may have to wait until next year to negotiate a new contract with the city — and forgo a retroactive pay increase in 2012 — thanks to an embarrassing oversight by the new leadership of the Fraternal Order of Police, City Hall sources said Tuesday.

    Police and fire contracts are due to expire on June 30, but a little-known clause requires unions to notify the city between Feb. 1 and March 1 that they intend to terminate their contracts and commence negotiations on a new agreement. If they don’t serve notice during that time, the contract automatically rolls over for another year.

    City firefighters and unions representing police sergeants, lieutenants and captains notified the city within the required time frame.

    But City Hall contends FOP President Mike Shields missed the March 1 deadline, giving Mayor Rahm Emanuel an opening to either put off negotiations until June 30, 2013, or negotiate only those items that would cut taxpayer costs.

    A mayoral confidant emphasized that the city has not yet decided whether to “stick it in the ear” of rank-and-file police officers.

    “But we’re reserving the right to be selective in what we talk about because they blew it,” the source said.

"stick it in the ear?" How about a bit lower?

And if the deadline was missed, and since the FOP does all of the heavy lifting for the sergeants, lieutenants and captains, not to mention the firefighters, this can be characterized as a pretty big Grade-A fuck up.

One has wonder what the FOP is going to have to give up in order to make things right.

WGN-TV had a big story on it last night saying there was a lot of wrong information in it.

Decreased members had pictures in it. People who were out of the gangs still were noted as being "active". Looks like the book is not accurate.

Is that why J-Fled left?

Better pucker up again Chicago taxpayers. The city has announced that the Chicago Public Schools will have a $700 MILLION defict for next year! Looks like the Daley micro manager strikes again. Most of this will be from the city not paying into the teachers pension fund for 3 years. Our property tax bills will be zooming upwards folks. Hold onto your wallets!

Don't give up one thing. We're used to having to wait more than a year anyway, so what's the difference. I, for one, don't want to concede one thing to 9.5. He isn't going to concede anything to us. And there were plenty of hold over officials reelected with little Mikey that we shouldn't be in this uncomfortable position.

And all I could think is that Rahm is either going to screw us OR he's going to try to come out as a "benevolent" leader and not stick it in [our asses] so that the people of Shitcago (and those cops and firefighters who can't see past the ends of their noses) think he's a great guy.

Solution is to use our discretion in not writing parkers, movers, DUIs and a slew of other misdemeanors. Of course thats a pipe dream because we have no unity as police officers.

Wait a minute... A cost of living raise vs. the option of not going to the table at all this year? Not being the first one through the door when the shots are being fired? Letting someone else take the heat with a chance the economy will be better in a year when its our turn to step up to the table? Letting a LOVED department like fire get what they can first then we get to have a mediator who has no choice but to say "Well you gave it to the fire department?"

I am NOT a big fan of the current FOP. But it seems to me that as long as we DON'T STEP UP TO THE TABLE AT ALL, we could walk away from this pretty sweet. I mean what do I lose? My .00000001% raise for this year???

Can someone please explain if I am looking at this wrong? Again, as long as we don't HAVE to go to the table. From an earlier SCC posting:

Section 28.1 — Term of Agreement.
This Agreement shall be effective from July 1, 2007 and shall remain in full force and effect until June 30, 2012. It shall continue in effect from year to year thereafter unless notice of termination is given, in writing, by certified mail, by either party no earlier than February 1, 2012 and no later than March 1, 2012. The notices referred to shall be considered to have been given as of the date shown on the postmark. Written notice may be tendered in person, in which case the date of notice shall be the written date of receipt. It is mutually agreed that the Articles and Sections shall constitute the Agreement between the parties for the period defined in this Section.

Where in this mess does it say Tiny Dancer 9.5 gets to drag us to the table to only talk about "items that would cut taxpayer costs?"

And the well thought out plan is working!!!  We (fop) do NOT want to settle the contract now, or soon because we know that we are going to get fucked no matter what.....so what can we do???  Extend it. So now although we aren't GAINING anything (we never would anyway) we aren't LOSING anything. We get to enjoy our uniforrm, duty availability, medical, ect. Hopefully our Prez can extend it for a few more years!!!! Great strategic move!

A little history lesson is needed. You may be a bit young to remember a twenty three day strike by firefighters that resulted in the first contract. There were no contracts and no benefits prior to the firefighters bitter fight. Other than the last contract, Local 2 has always been out front in contract negotiations. Rather than create anamosity why not lift together for the good of all.

Whoops! I'm sure this was an oversight! I'm sure this has nothing to do with backdoor dealing! It just happens to result in Police Officers being back doored. Mike Sheilds, I don't think that your security gig(as well as the conflict of intrest it might create) had anything to do with this. Hell, maybe pixies will come sprinkle ferry dust in the Mayors office and he won't fuck us.

Watch carefully what happens over the next year. But now our contract won't be an issue during our thorough preperation for NATO. Shame on you Mike. You screwed us all for your own benefit. As usual we did it to ourselves in part POs. My vote is one of no confidence in you Mr. Shields. Cops screwing cops! Can morale get any lower.

He's got no problem going in front of the microphones to talk about shortages, but when the heat turns to him, and when the media crosshairs are trained on him.. he finds a convenient hiding place.."responding in an email." President Shields is in spin control early today considering I got a email from FOP at 7:45 am where he talks about this just being a distraction and to not worry. Looks like this rookie is a fool and not up for the challenge and responsibility of being in his leadership role as FOP president. I voted for you MIke and supported you at the start but now I can guarantee I will not vote for you next time. Dougharty has my vote if he runs next time. Why would the FOP give a flying fuck about the Sgts, Lts, or Cpts? Maybe it was a conscious effort on FOPs part to let somebody else do their own heavy lifting.

I may be wrong but I don't see how the City can only negotiate what is beneficial to them. That's not the way arbitration works.

Give up nothing. We are going to be waiting 18-24 months for a new contract anyways. Also we still have a me too clause with the other unions let them start negotiations. On the FOP website it exPlains this issue better. I do believe they missed the deadline in the contract to terminate the contract, but the did it appears find a loophole in state law by sending a letter to modify the contract within 60 days of the end of the contract. This looks like we end up in the same place no matter what. We never actually terminate our contract anyways we just make some modifications each time. As far as this contract negotiation waiting for the economy to get stronger might be a good move. As usual the city is crying poor. Even though Rahm just had a few big news conferences to announce hundreds of millions in spending at city colleges. Maybe we should just ask for Ald Burkes cut of the CPS milk money contract.

don't worry cpd won't receive any raises next contract . city will take away uniform allowance , duty availability and supervisors bs 45 min a day overtime for doing nothing . city will offer a 3 % shifht differential for officers on the 1st and 3rd watches to get vote to pass contract , money for day time dollies and house cats gone.

Contract Negotiations Clarification

No matter what you read in the Sun Times quoting "off the record" sources, there is no dispute between the FOP and the City regarding upcoming contract negotiations. Our agreement was timely re-opened on March 20, 2012, well within the time limits that apply for modifications that would improve your labor agreement, address the critical issue of manpower, the safety of the public and of police officers, increase your wages and improve officers' welfare. Under the Illinois Public Labor Relations Act, 5 ILCS 315/7, a party to a collective bargaining agreement must terminate or modify the agreement by giving the other side notice of the intent to terminate or modify the agreement 60 days before the expiration date. Our contract expires June 30. Therefore, any notice before May 1 would have been timely notice. The IPLRA does not require us to give the City notice by March 1.

However, the labor agreement, Section 28.1, is anything but clear and unambiguous. The agreement provides that "notice of termination" must be given by March 1, 2012. FOP never intended to send a notice of termination. Our labor agreement needs modifications, not termination.

Your core negotiating committee has already solicited your ideas for improving our contract and the committee will be representing your interests in the negotiations no matter when the City comes to the table.

Granted the salaries included retroactive money, but the question still remains, "How much money are these guys truly making?" Will the current FOP administration publish their salaries in an effort for transparency?

"Um, What's This?" A CFD Lieutenant neighbor of mine told me recently that because he is also crossed trained as a Paramedic, and keeps his licence current, he qualifies for a 5% pay up grade. That pay upgrade is pensionable which means he pays for and will get the pension about equal to a CFD Captain.

Could his be our way of getting the Out of Grade Pay for Acting Desk Sergeant, FTO, Watch Commander pensionable through the ME TOO clause?

I called the FOP today upon reading this story in the "news paper" and spoke to someone from the FOP who advised me this wasn't the case but I kind of felt like I wasn't getting a YES or NO answer...more of a lengthy explanation. Mike Shields please address this, Did you miss the deadlne or not ? YES or NO? I urge other FOP due paying members to do the same until a YES or NO public answer is given. The person I spoke to was very polite and professional, but still something doesn't seem right.

Cops are negotiating at our negotiations and not as well versed in law as lawyers. I brought this very fact up at a meeting years ago and the powers that be were real smug about my comments. I said if you were sick, you would see a doctor, not a cop. I said if you wanted your taxes done, you would see a tax accountant, not a cop. I think you get my point. How this union of ours functions day to day is beyond me. With all the monies the FOP has in paying lamebrains you would think our monies would go to a few high powered attorneys to deal with high powered attorneys on the City of Chicago side. Unbelievable. Just really sickening to think that our best interests are not taken into account by the very people we trust to look out for us. Sometimes you have to wonder if we can sue our union for malpractice.

The membership should not let these comments distract us from the fact that FLOP and President Shields made a huge error. Don't lose sight of the ball officers. I personally supported Mr. Shields for President yet I which I could take back my vote. I believe he has good intent but the President is showing his inattention to his duties at a very important time of his tenure.

This is what happens when people take things for granted be it the FOP President, the Alderman, the Mayor, the Governor, the State Legislature, your Democrat or Republican leaders, the US President and the US Congress.

CPD has over 10,000 officers right, and apparently not one of them took the time or effort to look over their own contract and questioned the clause that's in question and if procedures were being followed in their own interest.

It's not much different on the political level so you can take comfort that you're not alone. If that means anything.

It's well past time that ALL these people be held accountable for their positions and the duties we have empowered them with. If they fail they must be called out, replaced, and held accountable.

You don't organize, don't vote and you get the leadership you deserve. How ya liking it so far?

If it strengthened their negotiations, why bother telling the public that the "stupid" FOP fucked up? Why not simply do nothing and then tell the public how smart Rahm is.

It's because, while the FOP did fuck up, the fuck up fucked up Rahm's master plan. Rahm does not want the contract to stay in place. Rahm wants to cut the
pay, cut the benefits, and cut the protections out of the contract. He's counting on new negotiations, otherwise he can't balance next year's budget when the parking meter money disappears.

If Rahm were happy about this, then Rahm would just screw us. He wouldn't telegraph it. He'd just do it.

The truth is that the FOP mistake, and believe me it was a mistake, is the best thing the FOP could do. Even if they never realized it.

One year of no raise while keeping all other benefits. That's the best possible outcome for us.

There were no contracts and no benefits prior to the firefighters bitter fight. Other than the last contract, Local 2 has always been out front in contract negotiations. I understand both points of view: 1) Do not attempt to renegotiate a contract in the midst of a recession/depression, rather just wait until the economy rebounds and then negotiate and 2) The FOP is in bed with the city and has screwed us. Instead of all of the name calling and mud slinging will someone from the FOP please comment and inform us of your strategy? Do it here or put it in the newsletter. Someone please step up and stop keeping thousands of blueshirts in the dark.

The president is not the only one to blame, each and very officer at the FOP is to blame. At least 50% of the old regime staid on. They knew or should have known. All should have known. It is not about whether it benefits us or not, if it does it is by sheer accident. This is not how a union that charges its thousands of members over 45$ a month every month for.
I voted for Shields along with many others because we were sick of business as usual. This is unacceptable.
All members of FOP should be voted out. ALL!
We should NOT pay for mutiple Vice Presidents and bullshit committees.
We need to lower the salaries of those officers because the high pay has not helped to prevent corruption. It is exorbitant. In my opinion they have never earned it.
Lastly we need to put a cap on our dues. It is to the point that they greatly cut into our salary. The FOP should not get larger raises and spending accts each contract than the rank and file.
The FOP messed up. Period. Filing some other paper is fine and dandy but if you don't know the legalese of THIS freakin contract so that you can follow IT'S guidelines then you are in denial!

This was a non-issue the first time it was posted on SCC.

Apparently Fran reposted it to get in good graces with City Hall, her boss. And you saps all fell for it.

The Opt-Out clause was in the at least the 2 prior contracts. And don't just read that one clause. Read the WHOLE section. If fact, do yourself and everyone else a favor and read the whole dang thing.

What it means is that at a certain time, either party can void the contract. Back to the days no contract. No seniority rights, no bids, no grievance procedures. Could Rahm, absent a contract, reduce pay by 30%?? With no contract, what would there be to stop them? Neither side wants that. And nobody with 2 working brain cells wants it either.

As it stands now, the existing contract remains in full force and effect until a new agreement is reached. Pay, seniority rights, step raises, etc. In the meantime there will not be any pay raises. But neither will there be any reduction in benefits. If the FOP were to opt-out, everything in that book would be gone.

This issue is nothing. A lot of coppers and others are getting worked up, bashing FOP and its leadership. You are playing right into Rahm's hands!! He will see that the membership does not have Shield's back, so he can do what he wants.

People bitch about the FOP leadership. Well, what do you expect?? Most coppers have no effort infested in their bargaining unit. When there are election, only about 35% vote. And most of them are retirees.

And for those of you that bemoan FOP's low effectiveness:

What percentage attend union meetings on a regular basis?? Maybe 200. Out of 15,000+. How many units/watches have no unit rep? How many people don't even know who their rep is? Only about 400 are eligible to even run for FOP office. Can't make 5 out 10 meetings in a year????...and then you want to RUN the whole show??? ROFLMAO!!!!

I do remember that strike 14 Feb 80. It was a Valentine Gift to Jane Byrne. But you are a little misinformed. The FOP got us the 1st Contract in 1981. After that contract the firefighters got theirs. The FOP has always led the firefighters in being the leaders in contract negotiations. Local 2 has a "Me Too" written into their contract because they cannot stand on their own. The jobs are different & have different needs. Local 2 followed FOP & got time & a half for their members, when they got stuck at a late fire when their relief would take the CTA to a fire instead of one of their cars. Before the time & a half they would drive their own car to a fire & relieve the others who would inturn drive the new on duty firefighters cars back to the house.

If you are going to recite history you should know the story.

If only we followed every Law and General Order to the letter. Within 3 months or less this city would come to a f***ing halt. The reverends and politicians alike would be begging for us to go back to being the police. We could get just about whatever we wanted come contract time!

But of course I am dreaming. We can't get the goofs on this job to stop writing parkers or movers let alone play by the rules that have been set against us.

Imagine it though, "reasonable suspicion" and "probable cause" followed to the letter. Arresting people based only on what was actually observed and writing paper the way it actually happened to the letter. Explaining to a witness their actual rights and obligations in felony cases. Telling them the truth about how much time they will be spending at the Area on a homicide.

Unfortunally, most coppers go above and beyond to put animals where they belong. It's just in our blood but it is also our Achilles heel. We do this outside the letter of the ridiculous laws and general orders that the powers that be have created. It's time to stop! Start playing by the rules that they have set for us. Let it crash and burn!!! Then, when reality sets in, then the tiny dancer and McRockhead can gives a call. Maybe we will be willing to work something out.

Whew... sorry for the rant. I just woke up from my dream. Oh well, let me know when this nightmare / reality has ended!

We don't need one or 2 lawyers, we need a team that will focus on police officers rights, coming to roll calls to show us support and also to answer questions that we might have.

This is why I will never join a union. I'm an independent contractor andi work based on my skill directly with my employer. This is why I am a True American Individual and the rest of you are stooges.

Who is your employer? You don't work for this city, if you do you're a dope or connected! We need unions- we don't need idiots in charge of them. As for american individual, get back to work! Why are you on a computer, you do enjoy working 18 hour days right? That is until you can't anymore and your employer will hire someone else. Keep stuffing cash under your matress!

As I've been working straight for 29 years, I've got a pretty good record. I've been out of a job before and got back in. If I'm out again, I'll work for myself as an independent contractor.

Point is, you have to watch out for your best interests. If you think the union masters who are cashing your checks have your best interests in mind, I suggest you wake up and smell the coffee.
