Abbate Verdict

  • Five years after a video of Karolina Obrycka being beaten by off-duty cop Anthony Abbate went viral, a federal jury ruled it’s time for the city and Abbate to pay up.

    Jurors Tuesday night awarded the bartender $850,000 in her case against the City of Chicago and the disgraced former cop over the 2007 bar beating caught on security camera.


    The verdict against the city and Abbate came at the end of a three week trial in which attorneys for Obrycka alleged the Chicago Police Department’s had a code of silence and a culture of failing to properly investigate and discipline officers who used excessive force.


    When asked outside the courtoom where the $850,000 will come from, Abbate responded with a joke.


    “I think I got a Visa card in my wallet,” Abbate quipped. In practice the City will have to pay the entire amount, Obrycka’s attorneys expect.
Still an asshole, all the way until the end, eh Tony?

Of course, this means the lawyer can bill Chicago for their time, which we imagine will run into the millions of dollars.  And then there's this problem:
  • In order to prevail, Obrycka’s legal team had to prove not just that the code of silence existed, but that it was a cause of Abbate’s attack.
Get ready for a shitload of "training" and speeches, maybe even some sort of outside "oversight" since it has now been proven in a Court of Law that a "code of silence" exists and is perpetrated by the Department.

And then there's the unfinished business of the "fall girl:"
  • He added that the actions of Deb Kirby, who ran the police departments internal affairs division at the time of the beating, were “reprehensible.”

    “If it was up to me, I’d fire her today,” he said.

Just remember. Kirby has been sponsored by and continuously promoted through many superintendents. Rice, Rodriguez, Hillard, Cline, Weiss, McCarthy. And every single one of these fkhead superiors bragged about how smart and viable Kirby is. They should all be held financially accountable for her repeated offenses and messes.

She was in the very first promotion class of every rank she made - detectve, sergeant, lieutenant. Is it because she is just so damn brilliant?

26 years later it takes an observant outsider to prove her stupidity and wrecklessness and say to the world that she should be fired immediately. The dirty little secret that 95 percent of current and retired cops knew.

It's all "much to do about nothing" really. The taxpayers are good for it. We stuck it to them before and hung a "shared sacrifice" banner on it and they took that without much resistance. So we think we can pull it off again.

To hell with her resume. I wish it was up to him. And, her name is Debra. Why does everyone refer to her as Deb? It seems to indicate that she has a warm, friendly, approachable side. oh please. This was not a "court of law". It was a civil trial where a slick attorney was able to lie enough and create such a bullsh*t smoke screen to convince a civilian jury to give this woman money... no different than any other civil trial against officers. They hotshot lawyer does anything and everything he can to get an award... they dont even care what they award is, just as long as they get a win so they can send the city the bill. 9 times out of 10 the bill is bigger than the award anyways. They are a jury.. they are swayed by such things as a CSI tv show and episodes of matlock that they saw once. The only sad thing here is that abbatte should actually be paying this punitivly. At least when we get hit for punitive damages in civil court, 99 percent of the time the city ends up paying it or the award is thrown out as part of the deal. Ive been hit twice in my career. Once as a P.O for 20,000 and once as a detective for 171,000. After two months the 171,000 was paid by the city as part of the deal and in the other the 20,000 was dropped so they could collect the compensatory from the city. Abbatte should have to pay because what he did was HIS fault and nobody elses. Hope everyone learned, if you end up dealing with a jagoff drunken copper too bad... if they cant help themselves then why should you try to help them. Enough is enough.. if your out at a bar and you fuck up because your drunk then too bad.. no more boys being boys. if your gonna go out act like a regular person. Just because we are the police doesnt mean we can act like idiots at the bar.

First the city will appeal to the 7th circuit and get the claim against them tossed. Second, she was asking for ten million dollars from the city... She got 850 thousand instead. The lawyer bill will be about 600-900 thousand dollars.. A far cry from ten million. After is all said and done and the city claim is thrown out they will stick the 850 thousand on abatte which his attorneys will file a motion of being unable to pay and she will get next to nothing... Not a victory for the city right now but check back in 6 months... I'm sure that part will get zero press. The seventh circuit of appeals acts much different than the federal judges and juries... They commonly grant the cities motions and I highly doubt this case would be any different.. The city has a rock solid motion to dismiss the judgement

Nothing will happen to Kirby. If the city takes any action against her, it will only reinforce the jury's verdict. Only thing possible is that she's pressured to resign, but there's no way anything will happen to her otherwise.

You do not have any idea what you're talking about. Jury verdicts are rarely disturbed by the 7th circuit. Less than 5% of the time. And Judge St. Eve is an excellent judge, so its unlikely she made any reversible errors at trial. Finally, your spelling is worse than a 3rd grader's spelling. That detracts from your argument too and makes you seem even dumber than you really are, if possible.

I disagree, however, the city will still pay that amount. If not to her, then to their attorneys in fees for appealing it. And believe me, their attorneys will make sure its a drawn out process so they can milk the crooks, I mean, the city for every penny.

I was in her detective study group and 1st class, she WAS the most intelligent person in both. She was also a no-nonsense, hard-working detective in Area 2. And let's put something else in prospective. The beating itself was NOT a felony, no matter how bad it looked on the video. No great bodily harm, no weapon, no hospital.

I amnow retired, but as I recall if you handled a tavern case you had tonotify a supervisor and they should respond? Things changed in that regard? I wonder if a supervisor responded to the tavern that night? I also expect that the judgement will be reduced in appeal.All of the " injuries" of the bartender are emotional, little or nothing physical. The attorneys fees are 2 million in this matter. Thatg too will be reduced. They are greedy bastards.

If you really think that Kirby will be prosecuted and lose her pension you are living in an alternate universe. She might leave the department but there is not enough evidence to warrant a criminal charge let alone convict her. I just dont believe this coverup bullshit. Abatte did not have enough clout to do cause that . Aggravated battery, a felony, has always been tied to great bodily harm which the bartender did not suffer. Barely a bruise. But, the video was damning and public outraged as it looked so bad. Without the video it would have remained a misdemeanor and abatte would have been fired and that would be that.

Did you hear Ekl's little speech after the trial about thow FINALLY the code of silence is exposed and Rahm has a chance for change within the CPD.
Maybe ELK will clean up the Lawyers next with their "Code of perjury" that has been going on for years. Maybe EKL will do another "Hake the Fake" greylord style about things like "CBRs, Counselor bond releases" that let the courts be collection agencies for the lawyers instead of the bond going to satify the fine it goes toward the Lawyer fee. How about the reasons for all of the bullshit continuances like for "Professional Reasons" meaning the piece of shit didn't pay the piece of shit lawyer so the courts can again be collection agencies while the public and justice wait or should I say just waist another day of youe time and come back later for justice. I wonder how many Lawyers purger themselves each day in court and the opposing attorney gives his professional courtesy.

Consider that an officer on the NW side some years ago Bitch Slapped a shoplifter, on video and he attempted to retrieve that video. When they fired him, they threatened him with Conspiracy to Obstruct Justice. Abbate clearly attempted to Obstruct Justice by attempting to acquire the video tape, so why did the ASA choose to not charge the Felony. The settlement should be paid by the State's Attorney and Big Red personally. Instead the tax payers will eat the bill, because some ignorant suburbanites decided how Chicago operates. They need to ride the Green Line West, then they'd learn to love the police. Baby"G"

The lawyer bill will be about 600-900 thousand dollars.. A far cry from ten million. After being sued and being in federal court more then once I can tell you that the lawyers for the girl do not bill the city. They take their court costs out of the 850. Then they take their 30 or 40% out of the remaining balance. The scumbag lawyers cannot bill the city. My guess is miss bartender will see about 450k from how I was told it works. The city will pay court costs and fee because they lost but they do not pay for her lawyers.

The city gave cease fire a cool million without discussion or input from the tax payers. They sold out the tax payers on the 75 year lease of the,golden goose,parking meter contract.

There was no code of silence. The buzz word of code of silence was cleverly promoted by the slick lawyers who saw a big paycheck in their future. Federal court promotes more frivolous lawsuits then state court or any other court in the land because the winning lawyers get to bill the deep pocket losers 100% of their costs of going to trial. A bonanza for the winning lawyers that is often bigger then what ever is awarded to their client.

Abbate was and still is a piece of shit. How he avoided any financial burden amazes me. As for the verdict, I was torn during the trial which way I wanted it to go. I didn't think the city should be responsible for what an off-duty asshole did. If she wanted to sue Abbate alone, that wouldn't have bothered me at all. But I felt the city wasn't responsible.

On the other hand, the upper echelon of this department is made up of hacks and merit promotions who are clueless and ALWAYS take care of themselves. I wouldn't have doubted a cover-up for a minute. Abbate was clout heavy and I'm sure he made his phone calls. I've dealt with a thousand battery jobs that were worse than what Abbate did and if I called for a felony I would have been the laughingstock of this department. Yet the higher ups pretend they got personally involved in this case and called felony review. I highly doubt that also. It doesn' bother me on that front that the city was held liable.

Debra Kirby was shown to the public what an incompetant bitch she really is. She was shown she has no management skills and even did a bad job of lying to the court. The City farmed out this case to a private Attorney who performed so poorly that they did not even prep the people they were calling to testify. The City paid $3,000,000 to defend this case. YOU'RE wrong. The city pays for lawyers fees when the plaintiff is awarded ANY monetary compensation- even as little as $1. There is a separate hearing by a judge to award plaintiff attorneys fees. If you've been in a federal civil trial you should know this.

Allow supervisors on the front lines to properly do their jobs. With officers like Abbate, there is too much interference from higher ranking people to not make waves, (ie "You never know who he knows," "You dont want to make us look bad for passing him along the whole time," "You will get sued by him.").
Above are just some examples of what I have heard over the years. There are plenty more. Even if you are the supervisor who does his job and writes up the officer in this type of situation, you would be suprised at how many times the paperwork disappears or the investigation is administratively killed off, as if it never existed. That is why I save paper copies of everything when I am involved in these situations, for when they say it never happened.

You sure about that? THis was a 1983 case, and those include attorneys fees right in the statute. THe reason attorneys fees are right in the stastute is that COngress wanted to encourage peoplel to bring suit against governnent wrongs, at or least not be discouraged from doing so for financial reasons. Pretty sure I heard on the news the atorney's fees the city will be on the hook for go over the $2M mark.

Just thinking out loud. Not sure.

Yes, the city does pay the Lawyers fees. In Federal court when a case goes to trial, regardless of the award the city has to pay the lawyers fees. The lawyer bill will be about 600-900 thousand dollars.. A far cry from ten million. You have a few things wrong there. This case WAS in Federal Court. Rules are different. Winner's lawyers get their fees on top of the judgement. Loser has to pay the other side's legal fees. If City prevails in Federal Court, they can go after the other party to recoup legal costs.

In state court fees come out of the award.

People's Law Office sued on behalf of one of the Wilson Brothers, who murdered two CPD officers. Flint Taylor asked for damages of $1.00 (one dollar) Jury gave him $1.00 (one dollar) and People's Law Office got to bill the City for one million in legal costs.

The families of the slain officers had a court judgement against the Wilson Brothers so any award would have gone to the officer's families. Scum Flint Taylor knew this and asked for only one dollar so he could get paid. And he did get paid.

So yes, she will get her $850 and the lawyers will get their totally separate from her money. I didn't hear if there were any damages assessed to Abbate. Should have been.

From what I remember reading, everyone in the U.S. is afforded civil rights, legal or illegal--that includes visitors. Don't think a civil judgement is considered income, either, but I could be wrong.

I'm a retired Detective but during my career was sued twice in Federal,Court by Former Police Supt. Richard Breeze -Ache,, his history as a private attorney was to sue Police Officers in federal court and the other was to represent Polish immigrants charges with shoplifting. He got his law degree working the desk on midnights as a Youth Officer,never did police work but an expert on police ethnics as he is an expert on marriage behavior, I believe he called himself at one time a sex addict.

The case was in Federal Court because it was a Section 1983 Federal Civil Rights lawsuit. Victims of a Motorola employee can't sue Motorala for Civil Rights Violations--only Governmental agencies can violate civil rights. Motorola is a PRIVATE business. These attorneys needed to use the "Code of Silence" in order to tie the case to a governmental body (Chicago) to have a federal Civil Rights cause of action.

The City got stung because the coppers F'ed up. The bartender told the responding officers his what she thought his name was and that he was CPD. No mention of that in the GOCR. No mention of the video. No Sgt notified. No CR initiated.

Since the incident occurred inside a tavern, where was the Field Lt.? He is supposed to be there.

The IAD Lt. contradicted Kirby on the stand. Said he wanted felony charges, she didn't. The ASA didn't.

Any other copper did that beating and there was no felony, she would have gotten an over-ride.

It's time to face the fact that the management of CPD is out of control and needs total top to bottom re-vamping, not more playing musical chairs with bosses. Many need to retire, some need to be fired, others need to be demoted or resign. The rank and file no longer has any respect or confidence in their leadership, although most will only say so in private. None the less, it is true.
