Duty Disability Arbitration

  • The arbitration went well on Wednesday. In about two weeks we will have a copy of the transcript of the arbitration. The attorneys from both sides then have until December 5, 2012, to get their briefs submitted to the arbitrator. Once the arbitrator has both sets of briefs, he will send copies to both sides. Arbitrator Roumell is usually pretty quick with his decisions, but my guess is that it will be sometime in January before we get his final decision. There is a lot of evidence for him to read, and we want him to view all the evidence so that he can make a good decision.

    The arbitrator is well-aware that some members may go into a no pay status on February 1, 2013. Make no mistake, this is one of the most difficult arbitrations that we have done.
Something we saw posted a few months ago suggested that there might be a hard ceiling on the number of Limited Duty spots available for officers undergoing long term medical issues.  Is this part of it?

UPDATE: Someone is complaining we're blurring the line between duty disability and limited duty spots.  Sorry if that's the case, but in the last paragraph, we directly ask if the two are related in any way.  We're looking for info on all of it.

Sure would be nice to know whose opinion "my" is. Is it Aguilar? McCarthy? Geiger? Mikey?

Sounds like they are simply hedging their bets and setting up the members to be prepared for yet another arbitration loss.

Speaking of duty disability, a certain well connected meritorious sergeant miraculously just got disability for a bogus hand injury that was claimed on the job. Stole a sergeant spot and then go on disability..... Way to go junior.

it reminds me of the guy i work with who is happy his case report didn't go to both sides.

we are only talking about tens of thousand of dollars no big deal!

This is bullshit! The city expects coppers to put their lives on the line, then doesn't back them when they get hurt? That's disgraceful.

Nothing was posted about the Lieutenants Association and the Out of Grade decision.

Just shift the responsibility to a lower level, no promotions necessary.

This arbitration will affect only Non IOD limited duty Officers. The FOP has suggested they would like to have all of these Officers grandfatered in so they may finish their time. This has been past practice for over 30 years. It has also been suggested by the FOP that new hires under the new contract would have a new set of limited duty rules. I work with a few very dedicated and hard working limited duty Officers who are faced with this. How dare the city even suggest giving any working Officer the boot. Lord only knows when any one of us could be faced with a sickness or injury that could end in this status. To say they may be faced with a "no pay" staus sickens me. No working Officer should be faced with this regardless of their status. This is like playing the Super Bowl and in the 4th quater the rules get changed. Lets be thankful for our health and pray that these Officers can finish the career they started with pride and the support they deserve.

Facts please? Is FOP spending dues money defending the officers named in Sun Times? Let me tell you, if the retirement age is raised to 67, the scammers will be paid 75 per cent for NOT IN THE LINE of duty bogus injuries another 20 yrs and more. Roumell better do the right thing and order them back to work and pay back the pension they stole.

one third of coppers on duty disability should be required to work in headquarters , homan square or district secretarial units and removed from cpd pension immediately . it's a joke , 30 and 40 year old coppers doing nothing for 75 % pay , that's bullsh--

I have to reside in Chicago if I want to keep my job. 2- I can't strike. 3- If I hold a government pension and have enough quarters in Social Security, my Social Security gets penalized 60%. 4- The Mayor wants me to contribute an additional 5% to my pension. 5- There will be a freeze on raises for the next 10 years. 6- Any Referendum I vote for means absolutely nothing. 7- If I purchase an automobile outside Chicago, I have to pay Chicago sales tax. 8- If I purchase tobacco out of state, I have to pay Illinois state taxes. 9- The Chicago Board of Education may raise and lower my taxes, but I can't vote for or against those who do.

So my questions are, why are scamming disabled officers allowed to reside out of the city? Why is the FOP their clout in receiving a permanent 75% disability benefit if not catastrophic? Why are they allowed to work other jobs! In my opinion, this Arbitrator better do his job and vote to bring those officers reported in the Sun Times either back to work or fire their asses. Then sue to get our pension money back. USDOJ better get indictments against those who used connections to be awarded a millions of dollars in disability benefits!

SCC, Let me set the record straight.
I am one of the officers affected by this policy the department implemented. When my medical time runs out, I will be one of the officers probably forced onto disability.
I have been in very close contact with the FOP on this issue.
This is probably the biggest arbitration decision that will affect the membership from now on.
While I don't agree with the lodge on a lot of issues, I can assure you that they are diligently fighting this new policy with every resource available!
To the younger, healthy officers that say fk em and call us "dead weight" and "house cats", be careful what you wish for! NOBODY asks to become injured or sick in their later years. IT"S CALLED AGING JUNIOR!
While I realize that there are a few officers that abuse the system and attempt to ruin it for everyone, there are officers that EARNED the right to light duty, convalescent spots. It's called paying your dues! Something you new guys have NO concept of!
I was one of you "go getter" coppers in my younger years. TACT, GANG TEAMS, MISSION TEAMS, etc.. I will put my career numbers up against any of you next generation coppers!
So, before you start with the negative comments about this issue. Please try and use some of your required college education you used to get on this job and actually try having true brain thought! Almost EVERY ONE of you will regretfully get sick or injured at some point later in your careers. If this policy goes through, GOOD LUCK trying to survive and raise your family on 50% of your paycheck, now paying for your insurance and not having social security to rely on.
I'm sure you'll just blame us "OLD TIMERS" for not doing something about this sooner, just like you blame everyone else for everything that happens to you.

7- It's called a 'use tax' you are using it in Chicago -- see? not a sales tax. Aren't they clever?

That's the point of the arbitration. To allow officers to work instead of hitting disability.

For every 4 years you have on the job, you are allowed 1 year of non-duty ordinary disability at 50 percent of your salary and you pay your own health insurance. Not many cops are on this type of disability, and if they are, its because they truly are "old and sick".

The majority of cops on disability today are IOD disability. They are the ones gettings 75 percent salary and free healthy insurance. Lots and lots of young cops are in this category.

Roumell is on the list to choose from as is Benn. It depends on their schedule and who is left as both sides choose. Like choosing sides in a softball game. Whoever is last is the arbitrator.


Roumell has been very fair with FOP, I have no problem with him.

What doesn't make sense is that they forced these limited non iod officers on medical for months now. They r fully capable of working inside doing paperwork. Most wish they could be working cause they don't want to use there medical time Instead they stayed home all summer on taxpayers dollars and did nothing. Also why r some forced on medical and other non iod officers still working? Anybody have answers

It is time that the city/department brings out short term and long term disability insurance. Private industry and many police departments around the country have had this for years. Yes, there are scammers who are on duty-disability, those with clout and it needs to end.

Truth be told,most of these officers on duty-disability, the vast majority, were not the victims of an assault but were slip and falls.

I am on duty disability! I would love to be working with my friends as I did for a long time. I would love not to be on the shitload of meds I am on right now and all the doc appts with more needles surgeries,sleeples nights due to pain. I would love to run or ride my bike but I can not due to the pain. Just so you know not everyone on duty disability is a scammer!!!!!!!!!!!!!!!!!!

The ones who were forced onto the medical are the ones whose Doctors refused to agree in writing that the P.O. could effect an arrest of an active resister, even though they are limited duty.
