"Code of Silence" Stands

  • A federal judge Thursday turned down a city request to set aside a jury judgement that a “code of silence” in the Chicago Police Department played a role in the video taped beating of bartender Karolina Obrycka by police officer Anthony Abbate.

    The city said it would still pay the full $850,000 in damages a jury awarded to Obrycka, but had asked the court to vacate the judgement so it would not set a precedent for potential future lawsuits against the city.

    City attorneys had claimed the jury verdict was not clear and that the precedent set by it would be of little value in future cases.

    But Judge Amy St. Eve in her decision noted that when the city had a chance to settle, it decided to pursue the case, calling it “a matter of principal.”
So this means one of two things:
  1. The city will now have to spend millions more dollars defending the supposed "Code of Silence" each and every time it's brought up in court.....OR
  2. enact real reforms, end the covering for the connected clout babies and actually put qualified people in the spots that they are capable of managing.
Since this is Rahm and the democrats running the show, expect Option #1 - it isn't their money that they're spending.

I still don't understand the code of silence route? Why won't someone argue that IAD got involved and there was never a coverup. My understanding of their position is because he wasn't charged with a felony its a cover up. IT WASN'T A FELONY battery. And the copper didn't write Abbates name in the report. Well how the HELL did IAD get involved? This is just screwing the taxpayers and the coppers.
I agree that he should have gotten charged with simple battery and official misconduct but nailing him to the cross to serve a political agenda? I understand some people think he should have been fired and may have some clout but the facts of the case are more important then how he kept his job.

It may also mean an efficient, streamlining of how IAD cases are handled and a lot more Officers might end up losing time and or their jobs. Time to clean it up boys & girls. Been said over and over, act like you are being filmed, with sound at all times. Even in your personal life, since that seems to be the area most coppers fired for. Stay safe!

When will the 009, third district female be stripped. She is unsafe. Her husband should not be able to save her. If the new commander in 009 does nothing then he will be just as much at fault. The commander wants sgts to come down on pos over uniform infractions but he is unwilling to discipline an officer who clearly has some issues. What a joke. All yhe third watch bosses know whats going on and not one is willing to do anything. Sad.

I heard McFlatOutLiar speak at an event recently, and since he said this, it must be true:

He said that there was no code of silence in the police department, that the only code of silence began and ended with the two responding officers, and no code of silence existed anywhere beyond that, higher up...therefore the code of silence verdict should be thrown out.

He honest-to-God said that. So it must be true, right? Just like everything on the internet? I don't know if he actually believes the crap that comes out of his mouth or if he's just good at keeping a straight face.

I saw the report of this on channel two(Didn't know Bill Kurtis was back.) They played the same portion of the Abbate video in a loop so that it looked even worse than it actually was. Now I remember why I gave up channel two years ago.

Pretty hard to defend the one point the court and attorneys kept coming back to: The initial preliminary investigation by two beat guys at the tavern was woefully insufficient. In other words, it stunk.

This code of silence ruling is bad for us. I've been involved in several state and federal lawsuits over the last 20 years. everyone had a paragraph alleging the code of silence. Typically this allegation was discounted without merit or standing. Now a federal court says it exists. Watch and see, every lawsuit filed will allege a "code of silence" among officers. Juries will buy into it thanks to t.v. shows and get ready for punitive damages......

The code of silence is actually the how we should refer to the local media when addressing city governmental corruption. Always seem to miss these things. How about the silence regarding what "merit" is, oh and finally the overwhelming silence from our police unions, all of them regarding anything. Do something, say something! Useless FOP, PBPA.

Fuck this city. Let them pay and pay through the nose. Although I don't believe there was any cover up in the Abbate case, I do believe there is a "Code of Silence" with the clout heavy command staff. Its a disgrace. Although I highly doubt anything will change, there is slim hope.

It is undeniable that there has been a long history of misconduct by members of the Chicago police department that has not been effectively dealt with for whatever reasons.

I doubt the public at large understands the nuances of just how it is that the troublesome individuals are seemingly untouchable.

They just assume it is endemic to the department as a whole, whether it is or is not.

Given the extreme secrecy with which the department operates, especially the disciplinary side of things, what else are they to think?

On 20 Dec 12 on the 10 P.M. News, Channel 7 reported on Judge St. Eves decision on the Abbate case at approximately 2012 hrs. In the 14 minutes before the report aired, Channel 7 previewed the report by showing the female bartender being beaten up three times. Ron Majors and Kathy Brock really seem like fair and unbiased reporters don't they? It's time to change the channel.

I am really sick of everyone comming down on the two coppers that did the GOCR at the bar, not mentioning on the report that "Big Tony" may have been a Chicago copper.
Bar room bullshit (at the time).
no visible injuries to the "victim" (at the time).
Dog-ass Sgt on scene (at the time).
WE all know that it makes NO DIFFERENCE to the coppers on scene if the offender is listed as a copper on the GOCR.
Ask yourself, WHO has the additional work to do, when a copper is listed as an offender on a GOCR, and WHO likely discouraged that from happening.
It wasn't the guys wearing blue shirts...

Sooner or later, every bill comes due and has to be paid.

For years, Chicago had a 2-tiered discipline procedure. The "A" list skated regardless and the "B" (anyone not on the "A" list) got bit.

From discipline to the Hired Trucks to no-bid contracts, the City played.

Now they pay...or we the taxpayers pay.

The sad thing is that not the City will try to prove that there is no "Code" and they will do that by hammering any "B" lister that steps in it. Whether he deserves it or not.

And it only came out briefly that one of the persons fighting the city regarding keeping this in law just happens to be suing the city in another case, funny how that happens.

To both of you crying 12 and 13 disrict cops: I've worked in both districts briefly and was amazed with both. Amazed at how little you do and how much you complain. Both districts are made for each other. Sorry to the few officers in these districts that actually do their jobs and shut up, but you guys know what I'm talking about. Lot of career do-nothings and people that forgot how good they have it.
21 year vet waiting for right moment to pull plug. Still having fun and still getting paid on time

Glad that this ruling stood. Rather than tarnishing the CPD, the Code of Clout permeates the entire City of Chicago government.

The Code of Clout covers for anyone who is connected to the political insiders, just as Abbate was as described here on the blog.

Day after day, month after month, year after year, it's the same complaints on this job.

Workers vs. non-workers.

Desk dollies vs. street cops.

Clouted vs. non-clouted.

Good spellers vs. bad spellers. :)

Windbags vs. men of few words :)

I came on almost 27 years ago, and I can tell you, these are the same complaints I heard then--although not on a blog, of course, since we were doing reports with quills and inkwells.

Instead of constantly trashing each other and being worried about who is getting away with what, you should all do yourselves a favor and quit wasting your time and causing yourselves aggravation about these issues that were here before you got on the job and will be here after you leave the job, even if you only have 1 year seniority.

Be concerned with yourself, find people you can rely on out on the street. Do what you need to do if another officer endangers your well-being or your integrity. That's it.

Life is short. Bitching isn't going to change a thing, no matter which side you are on.

Go to work, have fun, stay safe, play the game as much as you can to your advantage. Worry about the things that really matter, your family and friends' health and well-being.
