Well, 42.5 under the 4-and-2.

Is he eligible for an appeal?

UPDATE: The reason everyone is complaining that this seems excessive is that most of us remember a certain west side commander who used to actually bring a pillow to work and we don't recall her ever taking a hit for anything she ever did....including running illegal First Amendment Investigations while at IAD.

It's probably a SPAR since it was done so fast.

First you appeal to the Commander.

If no luck on that the Deputy Chief.

The SPAR wording calls it "lounging on duty".

Five days is four days too many. Is there a kitty where I can send twenty bucks for him? Eh; never mind. I'll get it to him myself.

Somebody ought to mind what the infamous videographer does with his spare time. I'm sure there's something networthy that HE can go viral for, too.

first prove he was sleeping. doing surveillance maybe or Praying ? Second thats a HUGE penalty which can be successfully appealed as excessive. A written reprimand unless he has a bad history. Then 1 day is fair.

No appear. The case was adjudicated in record speed. Mediation was the way to go. The department must have offered a five day suspension and the officer jumped on it. According to the mediation process, you waive your right to appear once you sign off on the agreed upon penalty. Good chance he had an attorney with him that gave him the nod.of approval. Lesson learned for all.

How did he get suspended for 5 days so fast? Every time I got a C. R. and took time it took two years or more for anything to happen. Hits media and a few days later he's off? WTF. Furthermore why is he not doing like an attorney and challenging it? "Prove I was asleep."

I.A.D. can give out any amount of days,however,must be in secession,verbal,written,1,2,etc.Canand will be appealled,just takes time. Hard to prove officer was sleeping or ignoring camera.

Funny how if you are caught by an Inspector or any other supervisor sleeping you get a reprimand or "maybe" a day, but if it hits the news, you get 5 days.....grieve this and it will be turned back, has to be! Total Bullshit!!

It says he agreed to it in mediation, so no appeal. I thought discipline was supposed to be progressive? Since he agreed to 5 days, does that mean he has a past history or did they arbitrarily come up with that penalty so they could show they were punishing him?

Regardless, this is a safety issue. He deserves to be punished and should be happy the guy filming didn't want to kill him, but 5 days seems harsh..

Just so information is correct. It's only 40hrs. Time taken for spars,suspensions are 8 hrs not 8.5.

OT it appears from the lack of street riots , looting , 24/7 news coverage , no comments from political leaders , community race baiting activists that Black Lives only matter if the Black was a person that resisted arrest , running from police with a gun in his hand , beat a community neighborhood watch persons head into a sidewalk , robbed your neighborhood grocery store , attempted to disarm a police officer . Something is wrong with society . Black lives like that 81 year old woman , 7 year old boy and now a four year old girl matter to the Police Officers and Society that respects Police Officers .

No one tells him to work vri or extra OT, he is lucky that man was only filming. That's why you need 10 hour days so you can have more rest. 5 days is a gift given the considerations. Could have been more. I suppose you can still use your comp time. Go to 3rd watch more sleep that way.

VRI is optional and to some extent so is VRE, how the hell are you gonna bring VRI into this. Endless VRI? Don't work it then and get your sleep at home instead of putting yourself in dangerous situation like this officer did. In a time when cops are getting assassinated in broad daylight and you guys are defending this officer, because he took "nap" in the middle of the day on a busy street like 63rd.

He deserves to be fired! How dare he involuntarily succumb to a bodily function! Cops should not be allowed to defecate while on duty either. Hold it in and have your bowel movements on your own time!

Think of all the tax payer dollars that are literally flushed down the toilet. We don't pay high taxes so the police can spend it on the dang toilet "riding the brown line" while our children are being slaughtered in the streets!

Bowel movements while on duty is another example of an abuse of "white privilege". That's money that can be invested in Link cards so less fortunate people can further increase their body mass index.

There are numerous officers that work 2, even 3 side jobs - excluding VRI, then come to work exhausted. Cost of living here is pretty high, and consider how the city conducts wage negotiations and raises. They drag officers through years of delay and when they finally agree to a contract, it is menial at best. Officers have to provide for their families and put kids through college while waiting for that 1% raise that is pretty much negated after the city raises costs of permits, city stickers, taxes etc. Meanwhile, Rahmmie the commie gives his administrative staff 10-15% raises for shuffling paper and spinning his rolodex. The city cuts manpower throughout patrol then subsidizes the use of overworked and under-rested officers through the VRI program. Why are they acting like this is such a surprise to find an officer that fell asleep during a brief moment of quiet? If they keep pushing this penny pinching, do more with less agenda on the police department they better get used to seeing a lot more narcoleptic officers.

I seem to recall some published pictures long ago of some of our famous or infamous Chicago Aldermen sleeping at City Counsel meetings.

You will probably never see that again because the newspapers fired all their photographers and the only pix seen are stately pix given out by the Rahm Press Machine. Anyone trying to shoot such a photo in the chamber will be immediately ousted.

If any supervisor in 8 had any balls, they would've initiated a spar as soon as they knew this happened, made the penalty a reprimand and finalized it. That way punishment has been levied and another punishment can't be handed down.

The officer will take the 5 days, then grieve it and then he'll probably wind up getting some if not all of those days back as 5 days for this is absolutely crazy. But ... necessary as it went viral. The public is happy; "justice" was done and it will be forgotten like everything else. No media covering the subsequent grievance procedure.

I think discredit to the police department is an understatement. it made us look like fools. If it was just for sleeping then yes it was kneejerk reaction and they gave him excessive time. im no angel and have screwed up... alot. im at about 23 days of suspension time in my career of 19 years. most for stuff that I could have avoided... so im not throwing stones. live and learn and lesson learned. no biggie, now we all move on and its done. office, just enjoy your time off.. this kinda crap happens, just makes us all look like fools but we usually somehow do that on a daily basis.

First I want to publicly thank the anonymous West Side Citizen who some years ago when I closed my eyes staring at that damn computer in my squad car asked, "Are you all right, Officer."

I thanked him then and thank-you and God Bless you again whoever you are.

He was a righteous citizen not like the J.O. who wanted to ruin a Police Officer.

A neighbor and friend of mine, a Firefighter made this suggestion. Have ever copper in the city take a photo of themselves working and sleeping and then publish them. A real twisted sense of humor, I like that.
This would be great.

Hundreds if not thousands of possibilities.

Not just in squad cars, but in offices, in closets, locker rooms and break rooms. How about in the trunk of a squad car, or a crib.

God knows I have had people doze off at Roll Call.

Got a Lazy Boy or Serta dealer on you beat, go for a test nap.

There's always the park bench and maybe you can even find a hammock.

Somebody has got to be able to pose sleeping upside down.

I certainly hope if it was mediated he asked the union about it. Maximum on a SPAR is three days and it's progressive. But the 'out' with the spar system is nothing prevents them from getting a CR number instead. Still, comp and disc. history must be taken into account. Sorry it made the news, but, does the punishment fit the crime? Glad no one had a camera when I fell asleep for a couple light changes on midnites working 99.

Has nothing to do w balls. By the time a supv. In 008 saw it. It had already gone viral days before. Not everyone is checking you tube and Facebook to track every minute thing people do in their lives. You are right that had it had been caught in time this may have been done - guess what he screwed up - no big deal - he's going to get punished - but I totally agree 5 days is too much - BUT he signed off on it to make it just go away. Soon - something else will take its place - but don't blame it on the supervisors.

I feel bad for this guy, sometimes the eyes are hard to keep open.
That said, the above post strikes me in a way. I read the blog fairly regularly, and I see a lot of comments where commentator'so blast joe citizen for blaming his dumb and criminal acts on society, his lack of education, no daddy, no money blah blah. Everating is someone else's fault.

The department threw him under the bus? Did you see the video? He's sleeping, in uniform, in a marked car in daylight on a main street. Has everyone forgotten the two NYPD officers murdered as they ate lunch? There was another one today in New Orleans. He could have been murdered.

Maybe, just maybe he decided, hey, I fucked up. Give me the 5 days. I deserve it. I made the whole Department look bad. Maybe he just looked in the mirror and said, this one's on me.

Everyone, please. Stop with the excuses. He fucked up.

jesus christ, the guy was sleeping on the job! Ask around to your family and friends and find out what would have happened to them had they done the same at their job...they would have been fired. That unprofessional fool made the rest of us look bad at a time when we did not need anymore negative publicity. We are our own worst enemy and on top of that we make excuses for our behavior rather than own up to it and rectify it. Think back to a street stop when you would just wish the guy would just admit wrong doing instead of making excuses and lying to your face. How did that make you feel? how do you think it makes the public feel? All the would be defenders of this police officer who made a mistake need to let him take his medicine. It could have been worse, need i remind everyone that New York Officers were gunned down while wide awake..he's lucky the worst he came across was joe shithead.

Sounds like a raw deal but then, it depends on the clout "scale of justice" and not not the real "scale of justice".

If you were clouted, (like this woman you talk about, Barb West), justice looks the other way. (Even on multiple infractions)

But, for the unclouted, it's "Hurry up and sign on the dotted line, or who knows how far this can go?" Justice is swift and unforgiving.

Where is FOP? Shouldn't they be putting up some protest, even if it is "just for show" just to make it look like they are earning all the dues they collect?

Funny how things work in Chicago. Funny, if you're clouted. But not so funny, if you are not.

The bigger story here is why they waste manpower having a stationary post for months on end. This does nothing to curb overall crime in the district.

What is your point. The officer quickly admitted he made a bad mistake and quickly accepted his punishment. I know of many officers that have fallen victim to extreme fatigue but were never caught. We are not machines. I hope his supervisors also considered if there are other reasons that caused his extreme fatigue. He might need help. What do you want? I pound of flesh? This officer has to live with the knowledge he might have been shot in that situation. Leave it alone and move on.

Made one of my best busts when I snuck off to listen to the end of the World Series. Dozed off and woke up to hear some guys talking about good shit.
