Hey, Where's Ours?

  • Chicago officials have issued more than $1.2 million in penalty payment checks to hundreds of paramedics who a federal court judge determined had been shortchanged on overtime pay.

    In addition to the penalty payment checks, the city also issued checks totaling nearly $2.5 million for the overtime it owed to paramedics but had not paid — for a total of more than $3.7 million to more than 700 paramedics, according to court documents and city officials. Paramedics recently began receiving those checks.

    U.S. District Judge John Darrah ordered the payments to make up for underpaid overtime wages dating as far back as 2004. Four separate class-action cases filed between 2006 and 2012 led to the order.

    The cases relate to the odd hours worked by the paramedics in the Chicago Fire Department Bureau of Emergency Medical Services. Paramedics work 24-hour shifts, with days off between, often logging 48 hours a week. For all hours that exceed 40 per week, they get paid overtime, at a rate of 1 1/2 times their salary.
Um, don't we work 9-hour days? Four-on-two-off only equals six days, so the seventh day you work, you're actually working 45 hours in a calendar week four weeks in a row:


So that's 20 hours of overtime minus the 8 hours for the short weeks, means we've been getting shortchanged a net of 12 hours every six weeks.

Hop to it Dean - we aren't seeing that casino money any time soon, so we better make our nickels and dimes while we can.

It's 171 for a 28 day period under flsa subsection k. So for us we get screwed by 11 hours per week with no overtime while for civilians it's 160 hours when flsa kicks in.

Your logic would have been sound, however, this contract revoked the 40 hour work week for us. When we agreed to the 4-2 schedule it came with benefits of more days off. We didn't take a pay cut for working less so why would we get overtime?

We don't work 45 hours in a week. The most is 42 1/2. And then when we work 4 days in a week it's 34 hours that week. It all evens out. Move on to more important things. 4-2 sked is the best.

With the addition of the 9 hr day, how did the city get away with stealing furlough days from us? If your WORKING DAY is 9 hrs how do you only receive 230 hrs in Furlough time? The 25 WORKING DAYS should mean just that, not 23 and burn YOUR time for 25. Anyone with this situation should call the lodge and demand they address this,it's a no-Brainer for them.

I had been saying the same thing about the six day work week since I was hired 27 years ago. From the first day we worked to the last day was 48 hrs. I am glad that a Federal Judge has vindicated me. As for our current schedule, I'd like to see the FOP file suite, but I won't hold my breath. After all, the FOP does have to protect the city's interest.

Police and Firefighters are exempt from FLSA (fed labor standards act) singe role medics are not. Would have to cross trained to be exempt.

Police officers and firefighters are exempted by federal law for overtime pay for regularly scheduled hours over 40. Paramedics are not. They won a similar lawsuit in the 90s and the city still short changed them.

CFD Paramedics work hard and that's a burn-out job.

I can guarantee you that Rahm is pissed off at this and will seek his revenge and CFD and the public be damned.

To cut the overtime he will probably cut the number of ambulances available and tighten up protocols for dispatching ambulances.

Most probably he will order them on a different shift system, no more 24 on 48 off. But the CFD has a REAL union and would fight that.

Police and firefighters don't fall under protection with that law. It's for paramedics only. They initially won the 1st lawsuit around 1994. That is when the citychangedtheir schedule for 1 on/2 off,to the schedule of 1 on/3 off. Trust me Iwish that we all could reap that benifit

Uggg. Here we go again. The working day furlo was converted to HOURS(200 of them). Add up the number of HOURS you actually work in a YEAR, if you had no vacation. I'll bet it's LESS than 2080. (52 weeks*40hrs) Therefore, to offset some of that, you have to add 1/2 hour to BFD's and get 'shorted' 1.48 days on your V-Days. It all comes out in the wash, if you look at it over a whole year. And, It's a 8.5 hour day; when you take CU, its 8.5, not 9. Now, if you'd like to negotiate something more in your contract, like the supervisors did: (sell back hours, more P-Days than BFD's) then go right ahead.

We know for a fact that city hall was annoyed with coppers
retiring with YEARS of C/U on the books and being cut big
checks.

This annoyance coincided with that inbred cretin Crime King Shorty
being told by Burke y Cia. that the built-in budget gimmickry was no
longer sufficient to cover-up the riotous "friends, family and campaign
contributor thievery was getting very hard to keep concealed.

We knew coppers who accumulated tidy amounts of time who have
retired over the years.

It went from grudging lump sum payments to "we gotta cut you checks on the
installment plan because what you're owed queers the day-to-day operating expenses."

The result?
"We gotta try and keep these coppers from accumulating so much time."

That...
Is when they started peeling away court time and our ability to
"Bat For The Cycle."

Policemen had firm control over how much or how little money/time
they could make because there was plenty of court.

Plus if you were agile enough, you could rack up a couple or three
conveniently concurrent trials...

This was when Chicago Policing WAS about HUNTING Bee-Ay-Dee
muthafuckahs and putting that ass in Jail/Prison.

Love of the law and hatred for these wild, unchecked street criminals,
giving a shit about the little guy trying to get in the damn door before
the rising back-wash of what ails this city swept him and his small bag
of groceries off his porch.

We had no problem with telling a wild, unchecked street criminal that
there was no love, care or concern and that they represented nothing
to us other than court time.

Nope....if I work 8.5, and I take off and it costs me 8.5, and a p-day is worth 8.5, my v-day and BFD should also be worth 8.5.
