Secret Recordings Jeopardize Prosecution

  • Attorneys for a man charged with shooting a Chicago police officer in 2012 dropped another potential bombshell Friday: the existence of a recording that could contradict the sworn testimony of a Cook County prosecutor.

    The disclosure further raises the chances that the judge hearing the case could throw out the arrest of Paris Sadler, who is charged with the attempted murder of Officer Del Pearson, Sadler's attorneys said.

    The defense disclosed at a court hearing Friday that they had just learned that Sadler's mother, using her iPad, had secretly recorded video and audio of an approximately 30-minute interview of her by prosecutors a day after Pearson's shooting.
This would be a complete cluster-fuck of immense proportions.

Okay, what is with all the 'secret' recordings? Why aren't the people who ILLEGALLY record any number of things (including that Paula person involved with Clinton) not prosecuted?
Why do we even have privacy laws or recording laws when no one follows them or prosecutes those who break the laws?

Hate to tell you but this has happened before. There were two cops from ocd shot in 5 about 3 years ago. The offender was caught and admitted to shooting the cops and still was found not guilty.

Cook County, what can you say?

The department will be changing their performance evaluation system on Jan 1st. The new system will give points for various activity and paperwork completed. The points will be added together at the end of the year and divided by the days worked. This will not be used for discipline or counseling but will give the department a more accurate count of who is staying busy. Example: case reports 1 point, misd arrest 4 points, felony arrest 8 points, contact card 2 points, etc. This will get rid of favoritism during the evaluation process which the brass has seen while reviewing the old system.

The eavesdropping law in Illinois is meant to protect the political class. Do you really think that Madigan and his circle would be so willing to cut deals behind closed doors if the potential existed for a hidden recorder? If this official lied then they should play the tape nd give the recorder immunity from the harsh law. Total BS. Reminds me of the point system in gangs west years back. The largest arrest point total was 20 for a murder. On one occasion, my partner and I worked 2 days on a murder and nothing else. After 2 days we closed in on the offender and called in the gang specialists on the case to close the back door. Shooter gave up without protest. 20 points split between my partner and I and the two gang specialists, 5 points each. The fact that my partner and I did nothing else for 2 days, an average of 2.5 points a day, less than writing two contact cards in the BS system described above. A great way to evaluate performance! ha Good luck with that unless you want to turn the department into contact card writers. What are parkers , bus checks, and school absentees, a point apiece? If you think this is a great system to identify the working police, I say back to the drawing board.

First I remember that day and was there... Way too many guys trying to be choefs and not enough Indians... Including some blue shirts who thought they knew it all. Every white shirt, unit Sgt, district sgt LTs etc were all trying to have the next best idea to find the bad guy and steal the show to take credit that they know what they are doing... Well guys, it's all imploding now. This is what happens when over zealous blue and white shirts do things before the detectives either get there or tell them what to do. Don't do anything till the dics get there... This was not the case on this one. Hope the medals and awards were all worth it guys... At least you guys all looked good on your Facebook posts with the awards... To del, my friend if this gets screwed up I feel terrible for you but always remember, you're still alive and there are many worse things that could happen.. You're alive and move on. This job is not worth what happened too you or to continue to stress out about. Stick around if you can, enjoy yourself and retire happy and healthy one day... Hopefully the real bosses look out for you and make sure you and your families needs are always taken care of and considered

I have no problem with this punishment. I'm tired of having to wipe food off the PDT, and then pick up chicken bones and smelly bags of food that have been sitting for hours. Not only disgusting, but shows a total lack of respect for your coworkers. I'd hate to see what their cars and houses look like.

Illegal recording in a City or County owned building is not admissible. Even if the SAO fucked up. And under no circumstances would I allow an SAO to conduct an Interview at anyones friggin' home.

Post that advice on your bathroom mirror so you see it every day before you go off to work. Use the possibility of being recorded to bolster yourself, not put yourself in a trick bag. There are people in front of you, next to you, behind you, and above you who could be recording....God forbid, even another copper. Think before speaking or acting as to how your actions/speech could play out in front of a jury or police board. Learn the phrases that will protect you and use them--ex: "stop sir, down sir", etc.

Now if only someone could get secret recordings of Rahm while he is on the clock. . . .

Wrong.

1) The law allowing recording of police in performance of duties was not in existence at the time of the recording. Sunday's Libune says she made the recording 3 years ago, when that would have been felony eavesdropping.

2) Today's Libune says she recorded prosecutors. Prosecutors are not police. It is felony eavesdropping to record non-police without their consent.

3) Today's Libune: "It's not clear why Sadler's mother, Talaina Cureton, came forward only recently with the 3-year-old recording."
Well, let me take a guess (because here's where it gets really interesting). The statute for a felony eavesdropping charge against her would've expired 3 years after the recording was made. And lo and behold, after 3 years she comes forward with the recording. Maybe she went to the defense team with her recording a long time ago. Maybe the defense team knew she had committed a felony by making the recording and told her to wait and keep her mouth shut. Maybe they continued the case to make sure they could spring the trap just beyond the statute of limitations.

Now that the defense team is calling for an investigation against the prosecutors, maybe a special prosecutor and should be appointed to look, along with the ARDC, into possible misconduct and possible charges(conspiracy, obstruction, contempt) by the defense team.

I hope the Feds are doing that already.

Sometimes when I call customer service of some companies, I always ask for American based customer service (not India, Mexico etc.). When I hear the phrase on their greeting, "This call may be recorded for quality control purposes." I sometimes hit the speaker function on my phone and the sound recorder on my laptop. Never had to use it yet, but nice to know I have it if they do not deliver what was promised or what I paid for.

Prosecutors are attorneys who are subject to licensing rules enforced by the ARDC.

The ARDC can't file criminal charges, but can file and investigate ethics charges.
