First Degree Murder? (UPDATE)

  • Sneed has learned a criminal probe launched by Cook County State’s Attorney Anita Alvarez into the shooting death of 17-year-old Laquan McDonald is expected to result in first-degree murder charges Tuesday against 37-year-old Chicago police officer [...]

    [...] will turn himself in Tuesday morning, sources tell Sneed. Accompanied by his lawyer, the disgraced officer will be processed, fingerprinted and charged before appearing at a noon bond hearing at the Leighton Criminal Courts Building, 26th and California.

    ∞The shocker: If a first-degree murder charge is placed against [the officer], it will be the first time in Chicago history an “on duty” police officer was charged with such a crime.
Looking over the ILCS, the only phrase that we can find that even comes close to passing the smell test is this:
  • 720 ILCS 5/9-1(b)(11) the murder was committed in a cold, calculated and premeditated manner pursuant to a preconceived plan, scheme or design to take a human life by unlawful means, and the conduct of the defendant created a reasonable expectation that the death of a human being would result therefrom...
And even that would be quite a hurdle to surmount.

Releasing the video now will inevitably taint the jury pool and for a First Degree Murder trial, you want everything in order, double-and-triple checked, and no surprises. Anita is in a fight for her political life at the moment. Does she have something that justifies a charge this high or is she pandering in the face of a primary challenge from the Prickwrinkle arm of the Machine?

In the meantime, get ready for an ugly holiday weekend ladies and gentlemen.

UPDATE: Evidently, we quoted the penalty phase of the law. Here is the Homicide Statute:
  • 720 ILCS 5/9-1(a) A person who kills an individual without lawful justification commits first degree murder if, in performing the acts which cause the death:
    (1) he either intends to kill or do great bodily harm to that individual or another, or knows that such acts will cause death to that individual or another; or
    (2) he knows that such acts create a strong probability of death or great bodily harm to that individual or another; or
    (3) he is attempting or committing a forcible felony other than second degree murder.
The charge still doesn't fit the facts currently in circulation.

It's interesting so the department initially said officer was within department USE OF FORCE guidelines, with this being said how do you charge a First Degree Murder charge when the officer was AUTHORIZED to use DEADLY FORCE, now your unhappy at how much deadly force the officer used???

I'm leaning towards thinking that them making an example out of him could be tied into the liberals belief that Wilson got off lightly. If the guy donated to his cause, who knows what they could try and spin this into. Maybe they'll argue he was trying to get celebrity cop status or some garbage. The officer planned to run into someone carrying a knife and high on PCP that night who displayed aggressive behavior while slashing car tires and would not follow lawful orders?

Come on. There was no "preconceived plan" here when the Officer went out on duty that night.

You don't have to behave according to a politician's request. However, you do have an obligation to obey the fucking laws that exist in your municipality/county/state/ country. You want to destroy property or hurt others? Well, then expect to be arrested. You want to break laws and endanger others? Well, then maybe you get beat or shot by police. If this officer was not justified in this shooting then he should be subjected to the judiciary process. Stop thinking you are above the law because you are mad.

I guess it will continue as long as a certain segment takes out their frustration on cops, ignores the reasons why their people may be held to a particular position in society, and ignores the facts that result in most of the police shootings. You're looking at death kenalry aggravating factors (which because the death penalty is no longer an option, life in prison is the potential sentence. For First Degree Murder, look just to 720 ILCS 5/9-1(a) and subsections (1), (2) and (3)


Sec. 9-1. First degree Murder - Death penalties - Exceptions - Separate Hearings - Proof - Findings - Appellate procedures - Reversals.
(a) A person who kills an individual without lawful justification commits first degree murder if, in performing the acts which cause the death:

I'll bet her argument for charging murder will be (as you suggested) something along the lines of the officer intentionally placed himself in a position of harm in order to "justify" shooting the offender, thereby creating and following a preconceived plan to take the offender's life by shooting him. She will suggest the argument that several officers where "following" and attempting to "contain" the offender when the defendant officer knowingly exited his squad car in such a manner as to give the impression his life was in danger for the sole purpose of firing his weapon. She will also argue that the officer should have stopped firing when the offender "spun around." However, the officer then fired into the offender's back. (Don't let your heads explode yet.)

One problem with that is I think the officer/defendant was the passenger in his squad car. He could argue his partner pulled up to the scene and he exited the squad car, not realizing he was so close to the offender and fearing for his life, he fired.

We all know this case will be charged on round-count only. Many who have been in shootings know many rounds are fired in a second or two at the most, especially when you fear for your life. There are hundreds of dash and body camera videos out now where officers fired several rounds after a person fell to the ground, or turned. There is a scientific argument in the use of force that explains action and reaction times.

Graham v. Connor is the U.S. Supreme Court decision that says an officer's force should be applied in the same basic way that an "objectively reasonable" officer would in the same circumstances. The the most important factor to consider in applying force is the threat faced by the officer or others at the scene. In other words, what did the officer know and do at the time of the shooting? The incident must be judged without the benefit of hindsight. Those instructions will be given to a jury.

I'd imagine the union is going to fight these charges to the end, therefore once the trial starts I'd imagine that every officer on scene that night is going to end up receiving a subpoena in roll call. I have absolutely no clue what happened out there that night, but for everyone's sake, let's make sure no other officers get dragged under the bus. Hopefully your testimony will help this officer, but please tell the truth regardless of who the testimony favors for the sake of you and your family. Only thing worse that one officer charged with a crime is two officers charged with a crime. Flame away at me...

Black Americans refusal to take to task those elements within their community that riot and burn in an orgyastic tantrum do nothing but further resentment and racism from outside their community. It is pathetic and paints Black America in a poor light when the greater community has an ever present worry of the violence and destruction from upsetting this specific group. It is akin to an entire family walking around on eggshells because mom or dad hand out beatings when they get drunk and mad. How can you expect people to view your community seriously if it throws tantrum like petulant children. What other group riots when it views itself being treated unequally? Did the Gay riot before they got democrats to allow them to marry. Did social conservatives riot because the Gay and democrats forced somthing unwanted down their throat(pun intended)? How patronizing is it that this behavior is expected? How low are our expectations of The Black community that we accept this? Acceptance of a thing is condoning a thing. Decent Black people need to take steps to get their house in order by coming out en mass and marching against the rioters by standing to protect property from being destroyed. Community leaders need to be in the thick of it and standing with the police and for law and order instead of continuing to stereotype police and spread prejudice against a few bad members of an otherwise admirable group or accept the lable of hypocrite. I can't speak to what I have not seen, and I doubt I'll every see the whole tape because the media will "edit" it. However, ask anyone who was in combat, you will hear many stories of guys shooting and not realizing they have fired the entire magazine. Its a stress related issue.
In the academy, they tried to train you to count your shots. That worked real good until my first shoot-out. It was a nice idea.
I feel sorry for this officer, because here in Cook County, it does not matter what your intentions were, its how the Democrats will spin this for every political and financial advantage they can get.

She may be overcharging, I don't know. His best bet would be to ask for a bench trial. With all of the publicity surrounding this, a jury will be pressured to convict him. Even if Van Dyke beats this, I am sure the Feds will go after him for civil rights violations. Either way his goose is cooked. I wasn't there, but like everyone else I will watch the video. Everyone is innocent until proven guilty and entitled to a fair trial including Officer Van Dyke. What I find interesting and I think is a problem for him is that no one else on the scene felt threatened enough to open fire. Either way innocent people, both coppers and civilians are going to be hurt by Van Dyke's actions. Action that set us back years. Bet he didn't think of that when he opened fire.

Don't forget, a federal juror found a police officer guilty of civil rights violations for just slapping an arrestee.

In the interest in a fair trial, the video shouldn't be released to the public until a verdict is rendered. But this being Chicago, who knows what will happen. Without seeing the video, I don't know what happened but again, I'm not on the jury so it's not my call.

Don't know if the allegations are true, but they probably charged him under 720 ilcs 5/9-1(a)(1) and (a)(2)

If you look at it from the standpoint of a mayor, what's happening makes sense.

The Ferguson and Baltimore riots happened mostly because the mobs were inflamed by a 'lack of action' by each city, with the media raving about no charges or punishment of the police officers.

So, in an effort to get out there ahead of complaints of 'inaction', our city has chosen to charge the officer just ahead of the video release. Now they can say, 'see, we DID something, we were proactive'.

I'm starting to think Anita sees the end of her career coming up fast and she overcharged our officer intentionally. This way, she does her part to satisfy the angry mob and maybe quell some of the violent response, but she knows he can't ultimately be convicted on the murder charge.

First Degree Murder, must show premeditation, how are they going to show that?

All this stems from a 911 call, an armed individual who refused for two blocks to drop his weapon and was high on PCP. Answering a 911 call, that's as basic as you are required to do on this job. How are we going to tackle crime now when officers are going to be reluctant to even answer their calls much less be pro-active?

I haven't seen the video, so I don't know what is right and what is wrong with the shoot, but I find it hard to believe that it constitutes first degree murder AND no bond. Murderers get bond all the time. Murderers go free by posting anywhere from 50-100K. The person of interest in the Tyshawn Lee case is free by posting 100K (posted by his girlfriend after receivng a settlement from a lawsuit against a hospital).

Officer Van Dyke, no matter what you did you are entitled to a fair trial and the best defense you can get. Start by replacing Herbert, this is miles above his head. As for a fair trial, it already looks like the deck is stacked against you.

Shame on Judge Villderama, shame on the peckerhead that filed the FOIA, shame on Rahm for passing judgement after claiming he didn't see the video (bullshit), shame on Anita for overcharging, shame on the media for convicting him already (18 complaints in 14 years is NOTHING for a working officer) and shame on the judge for holding him without bail.

God Bless the police and the good people of this city, we are going to need prayers in these trying times. There is a reason why St. Jude is our patron saint as supposed to St. Michael. Policing here is a hopeless cause.

Second City, I have always admired the brotherhood that CPD has. I'm a officer from a suburban department and comradity is something we are missing. Stand behind and support your brother. Nobody knows what was going through his head but him (and those of us who have been involved in shootings). The law doesn't state how many times you can shoot someone. It says you can shoot until the threat is ELIMINATED. Being involved in a shooting is scary and you're life flashes before you. Second City you need to put something together and support and stand by your fellow brother. If the other side wants to protest and march that is fine. So can the boys/girls in blue. And we are more organized. Everything is done for a vote. Well guess what we have a lot more votes than they do. We can all vote us with our family and friends can really dictate who holds office and who doesn't. SCC don't leave this copper out to hang. Let's unite and stand up for him. wtf EVIDENTLY YOU ARE NOT THE POLICE. People charged with murder along with other serious crimes are held with NO BOND all the time
That said he should be able to post bond and the judge set next Monday for another bond hearing where he will consider setting a bond. Judge should have held the total bond hearing today so he wont have to sit in county until Monday
Probably was a political thing, keep him housed to keep the animals down until at least Monday

You are citing the wrong statute SCC, 9-1(b)(11) is from the old death penalty law, which has been repealed - that was one of the aggravating factors to use at sentencing if someone was found guilty of 1st degree murder.

The first degree murder law says this:
"A person who kills an individual without lawful justification commits first degree murder if, in performing the acts which cause the death he either (1) intends to kill or do great bodily harm to that individual or another, or knows that such acts will cause death to that individual or another OR (2) knows that such acts create a strong probability of death or great bodily harm to that individual or another."

I won't say a lot here because this site is monitored by too many trolls. This is a great forum for cops to exchange info, intel, etc., but too many media outlets, defense attorneys and sub-par individuals troll here for insight. With that said, 1st Degree murder charges was the decision based on political fears. No matter what you think of the actions of the officer, 1st Degree murder is not a provable or sustainable charge. The only reason for that charge is an attempt to appease the politicians and to ruse the public into thinking the officer will be punished by being sent to prison for life. If I were the officer, although I would not want to be in his position, I would welcome that charge knowing full well it is unsupported and I would never be convicted of that crime. It will be the companion charges in the indictment that this officer will have to answer. I suspect he will be found guilty of one of the lesser charges solely based on public opinion and in fear of the actions of some that are expected in the black community. Having not seen the full and unedited video I reserve opinion on his actions but suspect his actions may have violated department policy therefore keeping his job is unlikely no matter what the outcome of the criminal charges. I suspect guilt on 2nd Degree/(manslaughter) or reckless homicide but only with political push. The same push that kept Vanecko out of prison will have this officer facing it.

I still 100% back the concept that this guy deserves fair treatment, but "fair" means maybe he was right, and maybe he was wrong. At some point between "shooting to stop the threat" and "pumping lead into a guy laying on the ground motionless", it seems reasonable that the evaluation would shift from "justified" to "murder". How many shots once the threat is disabled and further shooting becomes unjustified does it take? 2 shots? 16 shots? 100 shots? How many times would a reasonable person continue shooting at a disabled threat? If shooting continues beyond reasonable, and the shooter is a cop, does he receive special treatment JUST because he's a cop? Hmm...I wonder what this guy's record looks like otherwise. Model citizen/officer? Or would that be off-limits, because taint?

Seems unfortunate though that going for first degree murder ups the ante, and a failure to convict will REALLY turn the race spigots on.

At work on my watch we still have idiots getting into foot chases, car chases, taser deployments, multiple trr reports, etc. Here are some examples: 1. Two idiots are fist fighting and the officers approach them. Both subjects run away. The foot patrol officers run after them. One of them is caught. The other gets away. Great job officers! 2. At a t-stop the driver refuses to get out of the car. So the officer opens the door and tases him. Great job officer. 3. An officer issues a parking ticket. The owner comes out and confronts him. She is talking shit. She takes the ticket and rips it into pieces, throws it at the squad car and walks away. The officer asks her for her id. She refuses. She tries to run into her house so the officer tackles her (a 55 year old female 1) and strikes her multiple times to gain compliance. This guy is a super idiot.

If he would have done the right thing, then he would not be in this mess. Well we are going to get tasked with providing more training. You guys have to learn to be the police. None of us truly enjoy seeing a cop bring discredit and disgrace on themselves and us all. We all suffer from it. However, it really makes me look at officers that are in severe denial when the guy is actually guilty or deserving of a charge/termination etc. and we are staunch supporters. But then we think we are better than some banger's mom declaring his innocence. I actually would rather deal with the hypocrisy of our "clients" and their denial than a cop's. I expect more from us. Say what you want. Servin should have been tossed for firing a weapon over his shoulder let alone shooting into a crowd. Most of us would clothesline an officer flagging us on the range without his finger on the trigger but now it's okay to shoot in a direction you're not looking in? I haven't seen the video yet but some of you are reaching. Officers who have seen the video are overwhelmingly not coming to his defense. What does that say? That they lack solidarity? Wrong is wrong. Badge or not. 16 rounds connected, with no one else firing, the majority of them while the suspect is on the ground and outside of any distance to harm you or anyone else. The first shots taken don't sound questionable at all. The next 13 or so I doubt have any reasonable explanation. If I'm wrong, I will admit. I doubt that is the same for those of you championing this cause.

I would hate to be on any use of force paper of yours. In case you're not aware of this: you can lose it all if you took 2 shots and only 1 was justified. Each shot/punch/strike/ kick/slap whatever force you want/need to use has to be articulated as reasonable.

Go and march yourself. I'm kind of busy going to work, taking care of my family and spending my free time either helping with stuff around our church or juggling military responsibilities. There won't be rioting by my house and God have mercy (my earnest prayer) and prevent ANYONE from attempting to illegally enter my home or inflict any harm upon my household. I think you know what is waiting on the other side of the door for that foolish man/woman. My kids are loved and nurtured, doing well in school and have manners that humble me. My wife made me blow a gasket today but I'm not leaving her. We're sticking it out for better or worse. I kind of think my house is in order. I guess I have to break it to you: there is no such thing as the black community. I've told other black people this to there dismay and now I'm telling you. You can't trace black people to anything homogeneous, except a continent with 50 some countries. That's like saying the European community. I guess Russia and Italy has the same culture.

First degree murder my ass!! Just watched it on youtube. He was walked angled away from them but in an angled away direction of the unit that pulled up behind van dyke. This fuck could've turned towards that next unit at any time. Or thrown that fuckin knife at any of them. Clearly in a fucked up state of mind. Offender never let go of the knife and didn't stop moving until the final shot. 16 shots was excessive but who knows what else this fuck had on him or could've done with that knife while on the ground.

I just saw the video. Not nearly as grisly as I was anticipating. This whole thing has made me sick to my stomach though. I see no wrongdoing in this video. The thug had a knife in his hand and walked up on a squad car. If you watch closely, he even takes a step in the direction of the officer before he guns him down. What the hell is he suppose to do? After all of the hype I was expecting to see a clear cut case of murder, like the guy was on his knees with his hands up. This doesn’t even rise to the level of Walter Scott. I think Anita Alvarez (state attorney for Cook County) has lost her marbles.

I would have preferred to hear the commands, but I predict upon a quick perusal no conviction.
