Return This Guy's Gun

  • John Hendricks recalls a split second between impulse and action before he took aim and shot Everardo Custodio just before midnight on April 17 after Custodio opened fire on a group in Logan Square.

    Hendricks was not charged for shooting the 23-year-old because he had a concealed carry gun license and was determined to have acted in self-defense. But he said he was questioned for hours by detectives after the shooting and, seven months later, hasn't gotten his Springfield Armory .45 back from authorities.
We get coppers's guns back to them in short order. But this guy is waiting seven months. He's way more patient than we'd ever be, especially in the face of this behavior:
  • Police have yet to return his firearm and are not returning his calls, he said.

    Police spokesman Anthony Guglielmi said an investigation into the gun was ongoing and that he did not know when it would be complete.

    He declined to comment on the specifics but said such investigations can include ballistic testing, trace comparison and other means of finding out if a firearm was involved in other incidents.
Yeah, that takes the first day. And computers have made so much of this pretty routine. No one thinks this guy was running around, lighting up the south side, and sticking up dope boys. Give us a fucking break. It's his gun, he did nothing wrong, return his phone calls, give him a Good Citizen certificate, maybe a box of ammo, and close the books. Stop being asshats for a political machine that doesn't love you and a 9-fingered dwarf who doesn't respect you. You serve the citizens.

Sounds about right. I have been in (3) department shootings. 2 of the 3 my gun was kept for over 5 months. There is no rush any longer SCC. Called and got the same lack of responses. Only mine also included "you have a loaner, what's the big deal " from the FOP They treat us just like the rest of the 2nd class citizens in this state.

"Authorities" in this town have a long-standing bad habit of being real a___holes about this when it comes to civilians -- even when it comes to returning stolen weapons that were recovered. Guy had several sporting rifles taken from his locked car trunk out at a gun show, and they turned up in the jets here. It was "Want 'em back, sue us."

Some cops just don't understand that people have constitutional rights. Even our own detectives are acting like libtards. Give the guy his firearm back. HE DID NOTHING WRONG! 7 months and you still don't know if it was used in a crime? WTF? Are they looking at ballistics results manually now? No database? No Internet? I really thought the CPD had a process in place to take care of a law abiding citizen involved in a shooting. I'm not the police, but during a domestic with my now ex-wife, the police were called and she wanted me out of the house. You know, the usual he's threatening me and all that non-sense. One of the first things the officer ask, is there a gun(s) in the house. I told the officers an old 22 rifle was in a box up in the attic buried with Christmas decorations. He made me go up into the attic and dig it out. They took the single shot 22 rifle I had when I was a kid and inventoried it. It's been two years, no domestic violence charges, and not even an arrest in my history. Every time I call and try to find out how I can get my rifle back, I'm told their back logged and the process is not complete. Monday, I'm hiring an Attorney to get this 22 rifle back. It's been two years and now its the principle of the thing. I want to pass the rifle to my son any I feel my rights are being violated.

– in Paris (or almost anywhere in Europe right now, except Norway), Hendricks would be hailed as a hero. A statute would be erected and he would have been awarded a Medal of Honor within a week. The best way for this fellow to get his gun back is to file a lawsuit against the city naming McFuckstick, 9 fingers, and the officer who inventoried his pistol for the cost of the pistol along with the lawyers fees which should amount to at least 5 times the value of the pistol and let a judge determine whether the city is purposely refusing to return the firearm. That should light a fire under someones ass.

C&D orders on weapons are routine, even if charges are dismissed. In the old days, they were often kept by judges or given to bailiffs or even court clerks. I seem to remember one case where a deputy sheriff got caught selling confiscated guns out of his garage.

I'd sue their asses off 7 seconds after the event if I didn't have my firearm back. Guy is a law-abiding citizen, CCW permittee (even though we can debate the 2A violation with that "permit" all day long), etc.

Law abiding person shot a criminal committing a crime. The proper response should be: "Thanks for your assistance. We've got your info if we need more details from you. Have a nice day, and here's your firearm back."

I was involved in a justified off duty shooting and it took an act of god to get my off duty gun back - 9 months. Area DC had to make a lot of calls before my weapon was returned. We are no different when it comes to off duty shootings so this CC holder should just keep being vigilant and demanding his gun back.

The city sold thousands of confiscated guns, rifles and pistols, to a retired army colonel who promptly resold them on the public market.Even when the city dumped the guns in the lake by the water crib, divers were standing by. That is when it was decided to take them to the steel mills.

This is what I unfortunately have to do. When I'm home up north in Wisconsin, I carry my Sig 245. When I go into Chicago for whatever reason I carry a cheap Glock or my XD 45. The Sig was expensive and will be returned to me by the Police in Wisconsin if I ever have to use it and shoot someone. In Chicago, if I ever have to use one of the guns, well this thread says it all. I don't care about the Glocks or XD's. They are cheap. The City can keep them. The 245, not so cheap and I want it back.

A clouted officers sole job is returning guns inventoried and the case has been completed through court.

I know you never seen the opening for this spot and he is the most qualified.

The officer handles all those mysterious guns the tact team throughout the city seem to FIND.

Want to report a straw purchase or an ass hat that loses his guns and then has no serial number guess what?

Another unit that does not answer phones. Did you miss the post for this unit? again clouted spot with little over-site.
Comp stat? They can also run the fed computer but guess what they never answer the phone if patrol runs up on a case.

The exempts do not want to do their jobs and sign weapons back typical.

Sounds about right. I have been in (3) department shootings. 2 of the 3 my gun was kept for over 5 months. There is no rush any longer SCC. Called and got the same lack of responses. Only mine also included "you have a loaner, what's the big deal " from the FOP They treat us just like the rest of the 2nd class citizens in this state.

Their are some real assholes in the CPD, just like any organization. Generally, they are the paper pushers.

About three years ago, I had my brand new cellphone lifted in 18 at a Coffee shop.

They caught the guy a few weeks later lifting phones at the Starbucks around the corner.

The investigating officer or det. on my case made it his business to drop his card off at the shop my phone was lifted from and he told the staff they caught the guy. I don't know why nobody from CPD notified me. Anyway, next time I'm in the coffee shop, the person behind the
Counter says, "Hey aren't you the guy who had your phone lifted by the guy who was in here pushing Streetwise?" I replied, "Yes". He said, "They caught the guy at Starbucks. He was selling them in Chinatown where they then got shipped to China. Wait here a minute, the officer left his card."

Well, I get a hold of the officer and he pawns me off to another guy in some south side district who is supposedly the guy running down the case. Repeated attempts to reach him are unsuccessful and he never returns my messages. Eventually, I get to speak to, if I recall a desk seargant, a woman, who in a pissy demeanor tells me they have a lot more important things to be doing and that my phone was at some central evidence facility on the west side. I don't know why she was on tilt, but I blew it off because I figured she was having a bad day. I wasn't disrespectful to her. I asked her if she could give me the number to this west side evidence facility. She says in that same demeanor, "It's evidence, you can request to have it after the case is closed."

I was so disgusted, I just gave it up, tossed my notes and chalked it up to a $600 contribution to the CPD (It was an Apple OEM unlocked iphone5 if I recall. Right when they came out.).

Most of CPD are great people, but you have some bad just like anywhere else.

That's the last contribution I will ever make to the CPD as an organization.

You as individuals, I'll give you the shirt off my back.

This is what I unfortunately have to do. When I'm home up north in Wisconsin, I carry my Sig 245. When I go into Chicago for whatever reason I carry a cheap Glock or my XD 45. The Sig was expensive and will be returned to me by the Police in Wisconsin if I ever have to use it and shoot someone. In Chicago, if I ever have to use one of the guns, well this thread says it all. I don't care about the Glocks or XD's. They are cheap. The City can keep them. The 245, not so cheap and I want it back.

Keeping someone's gun for an extended "investigation" is not uncommon is city police departments. Others do the same thing.

One is probably going to have to file a lawsuit to recover the gun. While the CPD may give you some BS about "we don't know where the gun is" should be a total crock. The E-Track inventory system works in such detail that if you pull up the history you can track each and every time the item was moved at EARPS.

But what happens when it goes to the Illinois State Police Crime lab? Don't know. Wouldn't be surprised if one of the civilians doing the transport or intake glommed it.

Here is an interesting question: If you are involved in a shooting and it is found to be justified and there are no charges, what is the agency's authority to sieze the gun? And to examine it without a search warrant?

I really thought the CPD had a process in place to take care of a law abiding citizen involved in a shooting. I'm not the police, but during a domestic with my now ex-wife, the police were called and she wanted me out of the house. You know, the usual he's threatening me and all that non-sense. One of the first things the officer ask, is there a gun(s) in the house. I told the officers an old 22 rifle was in a box up in the attic buried with Christmas decorations. He made me go up into the attic and dig it out. They took the single shot 22 rifle I had when I was a kid and inventoried it. It's been two years, no domestic violence charges, and not even an arrest in my history. Every time I call and try to find out how I can get my rifle back, I'm told their back logged and the process is not complete. Monday, I'm hiring an Attorney to get this 22 rifle back. It's been two years and now its the principle of the thing. I want to pass the rifle to my son any I feel my rights are being violated.

He was in direct contact with a significant player from both groups shortly (within hours) after leaving the investigation by CPD...

They only gave him a referral to an attorney......
